Does any one know of any good medical law case sites? Im taking medical law and ethics and i would like to find some good sites for cases in the medical fields...if you know any that would be good. and they dont have to be in americas legal system either they can be from other countries.

Medical Law...? One of my family members that has been living in my house, and we have been taking care of for 7 years, has to have surgery for her hip. The surgeon that she is suppose to have has the worst reputation in the whole state. She wont give us the power of Attourney, but we need to somehow not get the surgery to go through. She has thin blood that does not clot, and this minor surgery might kill her. Please, if you know any way that we can get another surgeon or just cancel the surgery, please tell us, QUICKLY! Thanks.

Legal question: How is a state law that conflicts with a federal law resolved (medical marijauna use in CA)? I am teaching the concept of federalism to my students. We are examining a recent case in California where the County of San Diego is suing to overturn a law (proposition 215) that allows for the medical use of marijuana. Marijuana is listed as a schedule 1 narcotic (most dangerous classification) by the federal government. I am not debating the merits of the law one way or another. I am interested in finding out how the federal law that bans the use of marijuana is resolved with the state law in CA that allows for the use of medical marijuana. How does the federal government punish a person for doing something that is legal in the State of California? I am sorry if this is confusing, but I am trying to understand it myself.

How does stark law affect spouses of medical physicians? I was told that it would be illegal, due to stark law, for a physician to invest in pharmaceuticals or medical tech companies. I want to know if there is a law stating the max amount allowed to charge a patient if they were to ask for a copy of their medical record. is there a texas law that requires medical buildings to have handicap accessible power doors? i was in an auto accident and crushed my leg. i went to a new medical office and mri imaging building and it was difficult to open the doors. no auto open or a button to push. an older crippled man helped me. what an atrosity the handicap have to deal with daily to access(especially a medical building) buildings. if there is no state law that public buildings must have an automatic door or button operated door, how does one go about getting these type of laws started? i no longer take for granted anything.
medical law? my mom is in da hospital sick, unconsious, she is stable, she is not dying, but they got to da point where they dont want to care for her anymore, they said the insurance company wont pay for her to stay there if she is not receiving treatment, she is fully covered, she is on a feeding tube but no hospitals or nursing homes wont except her due to that and the fact that she has a traict, in her throat, so it looks like she gone to be sent home and we care for her, i need help to find out what to do cause if she is fully covered she should be able to stay in the hospital, im not going to starve her to death, please help, this might not explain the situation to good, but i just want to get help

Computer Science / Law / Medical school? ok, I just obtained a good-for-nothing, I-have-been-robbed by-my-university degree which is WORTHLESS. Its Business and Information Systems......anyways...I don't know what to do next but I have to do something because I need to fix my bad choice. Do Law and Medical schools look at all 4 years of college grades or just the Last 2-3 ? I really really messed up my first year at University by failing some courses and getting a few bad grades, it was so bad that I was asked to withdraw in my first year. But after taking a few community college courses and getting A+ in them, I was allowed back into my University and consequently proved myself with getting A- and A+ in all my courses, even though I was in academic probation for 1 year. Now I am in third year, my GPA is a 3.5 and I am wondering if that massive slip up I had my freshman year is going to haunt me when I apply to medical or law school next year? Will I be rejected flat out? Fellow academics and students feel free to add any and all input. PS - I am a Canadian University of Toronto student looking to apply in the United States for professional school as well.
Does anyone feel the U.S. should have Socialist Medical and Law Fields? Right now the cost of medical insurance is out of control and if every American payed into it the same as we are now it would be cheaper and as far as Law shouldn't it all be the same for all people not just the ones who can Buy Justice. There is a medical law...? in Minnesota that states a doctor/ health care provider(s) may with hold from, and lie to a patient about any test result. They may also with hold dianosis or give false diagnosis. And at the same time give all test results, dianosis , and info to some other person (without the patients consent) or health care provider(s) so that they won't "spill the beans . This is in minnestoa. What law (statute) allows this? Is this law unique to Minnesota, or are there similar laws in other states? Olympics Junkie, please look up minnesota statute 144.335 under patients rights and read it to the end of the chapter, it isn't very long. I know that i can't email you but you can email me with your Thoughts/ opinion. They give a reason at the end for this flagrantly unconstitutional law but it doesn't hold water. What is the real reason for it ? Your thoughts / opinions. Good work nemisis. but you missed the giant loophole at the very end of your answer. The part where it says " if the health care provider reasonably feels that the info would affect the patient physicaly or mentally , or if the info would cause the patient to harm himself or another person then the provider may with hold the info from the patient. Don't you see, the doctor upon finding a terminal or catastrophic condition immediatly call the appropriate 3rd party (that being whoever you name in the clinic info sheet as the person they are supposed to call on said patients behalf due do a medical emergency. then the doctors talk it over with the 3rd party and decide if they should tell the patient. If together they decide not to inform the patient, then the patient dosn't have a snowball chance in hell of getting a diagnosis. But I was unaware of the repealing of the statute. Is it repealed? The repealing probably only affects the cases after 2007? RIGHT ? Am i still screwed?
medical and law ethics? i am a second year veterinary technician student at a state university in New York, and currently am taking a clinical techniques course to learn how to do collect samples from animals and run tests on them. so my problem, my professor requires the students to perform an intravenous blood draw on a human partner, and have that same person obtain a sample from you the same way. I have never drawn blood on an human being, nor has my partner. like many people I have a certain "fear" of needles, when I have to get blood work done for medical reasons ,I force myself to do it and I always end up passing out and getting a migraine from getting all worked up. i do not understand why it is okay to let an untrained, unlicesned person stick a needle in my arm to obtain a sample when it has not been ordered by my physician to do so, and my professor tells me if i do not take part in this i will fail the course. if anyone has any advice, or knows anything about the laws that might pertain to this situation, i would really appreciate it. *** I can understand this procedure for nursing and other medical programs, but I am 2 months away from becoming a VETERINARY technician, i will never, ever, need to know how to draw blood on a human being.

Help, whats ur opion on medical law suits? I had surgery on my elbow, 7 months ago, have had bad pain in shoulder since, I was told I have a frozen shoulder, rotator cuff or bicept tendonitis. My elbow is still at a 45 degree angle, pt cant help due to shoulder. Was given MRI last week, Now have been told I have a complete rotator cuff tendon tear, bone edema, and injury to anterior superior glenoid labra. It happened during surgery, I havn't used r arm for 7 months. Elbow was WC, who is responible for elbow, who pays the bill. WC denies shoulder. I really like the Orth Surgeon that did the surgery, and the hospital. I know it wasn't intentional, and I dont want hard fillings. I need surgery on shoulder, Comp wants to settle, but elbow won't straighten until shoulder is taken care of. I have an attn but still don't have any answers. I've never been one to sue or take advantage of anyone. I just want med bills paid, pain to stop, use of arm, and 2 get back 2 work.

Ontario Labour Law - Medical Leave? I have to get my wisdom teeth removed under general anasthetic. It will require minimum of two weekdays recovery time, possibly three. I am a permanent, fulltime employee for a private business in Ontario. law school and medical school? why is the average gpa of accepted students to medical school so much higher than the average gpa of accepted students to law school? but the acceptance rate is about the same for both. i understand physicians have more responsibilities. but in general the competitiveness is about the same. so in order for those average gpa's to be the way they are. if you look at schools alot more students are pre law. Honestly looks like students going into law school (in general) are just not as smart, or maybe they don't try hard enough. but that too doesn't make sense, because the pre law classes are easier than pre med classes. =/
Is law school or medical school the right choice?? I am 23 and I have a Sociology degree and will finish my MBA in a year. I am thinking about going to law school in the future however I have always wanted to go to medical school too. I started college as a biology major but struggled through my sciences for 2 years before changing my major altogether. I thought about going back to school and giving the medical route another try but I don’t want to waste my time if my struggles now are just things to come in medical school. I struggled mostly in physics and math. My transcript for the first two years as a biology major does not look too impressive and as far as the science classes I got A’s and B’s in, they did not come easy for me at all. It wasn’t until I changed majors that I started bringing my grades up. Does it sound like I would set myself up for disappointment if I try the medical route again or do I need to stay with what I am good in?

Act 6 medical claim law? My insurance paid the hospital less than the amount charged. The insurance company said that in compliance with Act 6, the insurance company usually pays the minimum percentage based on the region. After the hospital receives that minimum amount, they are not to charge the patient for the balance since Act 6 is the law. Is this true?

Question : Does anyone know of a medical malpractice lawyer or law m.d. in Boston...Preferably a female??? Question Details: I had a baby 9months ago and seriously can't get over the horrible experience. I have never sued or brought legal action against anyone. It would take me alot more than this paragraph to explain the whole situation-but its very complicated with several different issues. Basicly as a result I feel like my life is ruined. I have a beautiful healthy baby but can't move past everything....I know i'm being vague but any referrals or assistance you can give would be great. Also if anyone knows if there are any online groups or boards w/other people seeking action against their Ob or MD i would love to speak to others. Part of the problem is the serious emotional distress that accompanied this whole mess-i'm actually ashamed to say i thought most people claiming this weren't being honest-but now see malpractice in a whole new light. I guess because our society is so "lawsuit" happy I had trouble allowing myself to truly believe that I was not treated correctly. Thanks so much.

If an employee violates the medical hippa law by going through another employees chart in a medical office? what should i do, if i dont trust my own office manager to deal with this. They are good friends. This employee got told on, but she didn't even get reprimanded. she is still at work violating all kinds of patient confidentiality laws. what other channels should i go through to report this individual, if i dont trust the boss or human resources where she has friends. The main Dr. as far as i know already knows, and just had a discussion. I think I need to go to the higher ups. I don't know if i mentioned, the chart she looked through was mine. I just found out Saturday And i noticed the office didn't do a thing about it. Who should i contact in a chain of command? I work at this office and am also a patient, out of convenience for them, so i wouldn't miss work. Go figure, stupid ofnme.
Medical Confidentiality- Law? My 14 year old son went to a doctors appointment/ my friend works in that same office and she told me he was there. I called the pediatrician because I want to know why my son was there. They told me that they can give me no information. What would be my legal rights as a parent?
