If my medical malpractice attorney wants a meeting, do we have a case? Our daughter fell ill shortly after birth. During birth she contracted a bacteria, GBS. She experience late onset of the disease. It turned to Meningitis, and caused a stroke. She is now blind, her brain is severely damaged, and her muscle tone is low. The whole thing could have been prevented had my doctor given the antibiotics that were administered the whole 4 hours to work instead of speeding along my labor. Our attorney has had our records for 6 months. The hospital withheld part of our records 3 different times. We have a meeting next week. Does this mean we have a case? Would our attorney waste the time of a meeting to just let us down gently?

Need help finding a good Medical Malpractice Attorney near Fresno, Ca.? I am disabled with congestive heart failure. On 03/30/2009, my family doctor diagnosed me with Cellulitis and possible infection in the heart. I also had severe swelling and pain in both legs and was having a difficult time just walking. I was instructed to go to Madera Community Hospital Emergency Room as I needed to be hospitalized. I went to the Emergency Room and explained my medical problems. I was placed in a hallway (not a room) and publicly examined by a Physicians Assistant and the emergency room MD. Both concluded that I did not have cellulitis and felt it was a poor circulatory problem. I guess because I could hardly walk and I looked pretty bad, both of them questioned me repeatedly about being a “IV” or any other “street drug” user. I told them NO on both counts! They treated me like I was just there to get some drugs. I was given a prescription for Elavil and told to follow up with my family Doctor in 2 weeks. On April 03, 2009, after seeing my Cardiologist for the same problems, he had me admitted to Madera Community Hospital where I was diagnosed and treated for Cellulitis, Septicemia, and various heart related problems! I was released from the hospital on 04/08/2009. I've never been through anything like this before and any suggestions would be greatly appreciated. Thanks....
Should we hire a medical malpractice attorney? I know what all the lawyers are going to say but hear me out first :-)... Wife's father is elderly, has only 1 eye with a cataract. His ophthalmologist says no prob, we'll cut out the cataract and insert an artificial lens. Surgery is supposed to take 1hr, 2hr later he comes out and says he had problems, if necessary they'll go back in a couple days. That night patient is in pain, "seeing things" like flying monkeys, etc. Next day they unwrap the bandages and he's blind then he freaks. When told of the hallucinations the Dr. shrugs and walks out. Take him home, he starts really freaking, doesn't know who he is, there are spiders and monkeys climbing on him, he starts swinging and swearing at people, has no clue who/where he is, etc. Call the Dr, no response. Leave msg with Dr's. emergency No, no response. Finally take him to a different hospital ER, they have to restrain him he's totally screaming and checked out. Next another Dr. checks him out and says the cataract is still there but so is the new lens (and may be upside down), there's bleeding and swelling and possible detached retina. They try calling the Dr. no response. Finally new Dr. says I'm taking over and gets him admitted and a new surg team lined up. But they can't operate b/c they have not got the records from the 1st Dr (Dr. of record). Finally wife and anesthesiologist drive to his office and demand the paperwork, they claim they tried to fax but it didn't go through. Anesthesiologist reads the records and says OMG it sounds like since the procedure took so long he started to wake up during the time they were cutting on his eye, that might be why he has mentally checked out. Long and short the 2nd surgery appears to be successful so far still blurry but they think it'll improve. All docs and nurses are tiptoeing around but suggesting "you have a valid complaint". He spent 2 days in ER plus 4 more in ICU until the hallucinations subsided. He still can't walk without help so they're sending him to rehab tomorrow. 1st Dr. showed up just as 2nd surg was finished and wanted to know why we went to different hospital, different Dr? We said b/c you wouldn't return phone calls, he claims he never got them. We think he's hiding. Today the hospital sent a "patient advocate" who said he should file a complaint against the doc but "rather than hassle with an expensive lawyer we have a program set up by the insurance companies" everything will be paid for and he might even get something for pain and suffering. Ok clearly he has a claim but should be take the advice of the PA and avoid litigation? I know they are trying avoid legal expenses and that's understandable but perhaps there's a bigger motive- someone told us the 1st anesthesiologist and nurses should have stopped the procedure and hospital shouldn't knowingly let this guy in their OR- but on the other hand what if his eyesight is restored, can he even claim harm other than a couple days trying to hide from flying monkeys and spiders and being strapped to a bed so he did rip his IVs out? We are scared to death of what the bill is going to be when it comes. I would think the 1st guy's insurance would pick up the cost of the ER/ICU and 2nd operation without too much prodding, is there anything a lawyer can do that the insurance co's would not other than dragging it out for a long time?

Looking for an attorney who specializes in medical malpractice cases involving drug companies? I was born in 1958 and exposed to a drug which originally marketed under the the name Thalidamide, but was administered in this country as Kevadon. It caused me to be born with a birth defect to my hands.I was told that there is a law firm that has a list of the doctors who prescibed the medication to women who were experiencing morning sickness while pregnant.Unfortunately for me the hospital I was born in (Provident-Baltimore City)destroyed all records.Although I'm now 49 yrs old I'm still experiencing problems. There also seems to be the matter of the statue of limitations. But I wouldn't have known about the drug Kevadon if it were not for my research into the drug Thalimide which was not suppose to be marketed in this country.I have no medical insurance to help me seek the medical attention I need with the current problems I'm having with my right hand.Do I have any way to compensated? Please if there's anyone who can help me let me know.
Medical malpractice attorneys: Can a doctor put "Dictated but not read" on his reports? What would happen if a doctor put this disclaimer and then got sued for malpractice? By this statement I believe he means he takes no responsibility for any errors there may be--many are done overseas and are full of errors. Does this let him off the hook? Obviously it is not ethical because if the doctor doesn't take responsibility, who could, but what about the legal effect? Thanks for explaining any legal angles. I edit these things and just got curious. I also wonder what happens when a case goes to court and an insurance company is involved.

Retaining attorney for possible MEDICAL MALPRACTICE suit, is it advisable if? suspecting some of the negligence/malpractice is due to GOVERNMENT imposed regulations such as "compliance agreements"? In other words if I suspect_and am starting to try and prove so_that some if not all negligence against patient has been caused because of stringency in an "agreement" from hospital with government after a settlement suit won by government, what would my chances of success be in taking the case to court against hospital? Also, if notwithstanding this "agreement" in which medical professionals might be "afraid" to issue more tests, treatments, etc. If I can find that based on the settlement amount paid by hospital, the patient, or patients are suffering negligence, should I be suing the government instead? PLEASE, if this sounds confusing or more information is needed I'm glad to provide it. I am NOT doing this for ANY monetary gain. I just want justice done.

What is the best way to get a medical malpractice adjuster to return my calls? I am trying to negotiate a settlement with a risk management company about medical malpractice, the hospital has pretty much admitted wrong doing, we haven't even seen a bill. I have given the adjuster all the medical records he has asked for but refuse to sign a release of info. He has not been returning my calls and involving an attorney won't necessarily mean a bigger settlement, what should I do?
How much does a medical malpractice lawsuit attorney cost? my mother wants to sue a hospital and was wondering how much a lawyer for medical malpractice would cost?
Medical Malpractice? I have a girlfriend who had cosmetic surgery done about a year ago. Since that time her body has not properly healed and she's had two staph infections in relation to the surgery. Everytime she went back to her plastic surgeon he kept telling her that her pain and discomfort was normal, and only to find that a couple months later it was an infection that should have been treated. He was very unproffesional and at one point began to get aggressive with her when she kept going back to him because she felt ill. I know that when you get cosmetic surgery done, there are documents you sign and etc....she is looking to find an attorney to handle this case. When she had spoke to the nurse at this facility the nurse informed her that the surgeon no longer worked there and that she was not the first to complain about him. She also added that the particular procedure my friend had done was not one that this doctor had been particularly familiar with. Of course that could be heresay and anyway,,,,my big question is. Is she wasting her time? Should she just deal with the disfigurement she is left with or is the matter worth pursuing? I know it's possible nobody here is an expert on this subject but I was just giving it a shot, thinking maybe somebody has either been through this or knows someone who has. She has horrible results due to this procedure. I'd just hate to see her depressed and beating herself up for nothing if there isn't anything she can even do anway.

Has anybody ever sued the USAF for medical malpractice and could share some advice? I am currently in the USAF and I know that I cant sue the USAF but the medical issue is with my wife and as a civilian I believe that she sue on her own behalf but I an not 100% sure. Also, unsure of the process (I would assume that we would have to find an attorney that specializes in these types of cases). Any guidance would be helpful. Thanks
Concerning the malpractice case, yes I contacted a malpractice attorney and they jumped all over it? I had stacks of medical records with verified wrong doing and negilence. I had pictures of what had taken place. The attorneys were positivally going to go after the doctors who did this. They wanted to gather the evedence and build their case while the patient was healing to a point as to the best that they ever would and then they would file the case. The patient died shortly before the case was filed. I contacted the attorney to anounce the death and he told me that it was over. I ask him what he ment that it was over, this person lost thier life because of the doctors negilence and you tell me that it is over. He said that it was an economic issue now and that there wasn't any money to go after now and that he had million dollar cases on his desk to work on. He declined the case. I presented the medical records to three other malpractice attorneys who jumped on it only to later decline it as an economic issue. the patients long term care & pain & suffering was gone

Medical Malpractice- do I have a case? Or go for 2nd opinion first? Ok- in May of 2006, I had a ruptured ectopic pregnancy, which the Dr. removed surgically, along with my fallopian tube. He had gone through my previous c-section scar (2 yrs. previous), and opened it completely. Every time I went to him, I told him I felt that it was not healing correctly. He said "put powder on it". After about 5 follow up visits, I stopped going to see him. I owed $$ from the surgery (I do have insurance), and he wouldn't see me for my last follow-up unless I paid the balance in full. My scar has STILL not healed completely- it oozes, gets infected, clears up, and gets infected again. I finally made another appointment with a different Dr., but now my husband says I should see a malpractice attorney first, because the new Dr. is not going to admit that the other Dr. did something wrong. The only reason I'm even considering this is because I have a feeling that I will have to get cut open again, and then I'll have to miss work and be responsible for more med bills.
How are medical malpractice awards determined ? Specifically in California, how does the attorney determine how much to sue for? Does anyone know the outcome of cases of improper administration of Kenalog resulting in subcutaneous atrophy? Assuming the case does not go to trial, how does the physician's insurance company come up with a counter offer to settle? Thanks!

Finding a Medical Malpractice Lawyer? I'm trying to find a lawyer to represent my dad in a medical malpractice case. Spoken to 3 Boston area attorneys who all say he seems to have a case. The problem is the big firm says it only takes multi million dollar cases, the smaller lawyers don't want to put up the money for expert witnesses. My question is IF he seems to have a case of neglect how can he find an attorney that will take the case and file the claim? Can he do it without a lawyer? Is there a way to reach muliple lawyers with one email blast to see if any takers?
What kind of attorney do I need to hire for health insurance problems? I have been paying for Cobra for myself, my wife and baby girl. It isn't cheap. I have been having extreme difficulty filling prescriptions and it is medication I can't stop taking. We are in good standing with our payments. However, when I try and fill my prescriptions, my pharmacy tells me my insurance is terminated. I have gone back and forth with the Cobra company and Blue Cross and nothing is getting resolved after a month. I am at the point where something needs to be done, and I want to hire an attorney. What kind? Contract? Medical Malpractice? Anyone have any insight? Please help since we are paying out of pocket costs when we should be fully insured.

Personal Injury / Medical Malpractice areas of the Law? Are Personal Injury / Medical Malpractice areas of the Law (Plaintiffs side only) intellectually and financially rewarding practice areas? I am looking for input and opinion from active Attorneys working on contingent fee basis. I am considering Law School (at 35 years old) and my interest is in Litigation. I am trying to obtain information on practice areas that have always intrigued me are of interest. Look forward to hearing back from any practicing Attorneys with their view from the battlefield.
In CA, What is a statue of limitation on a malpractice lawsuit ? at a medical hopsital? How long does a patient have to contact an attorney and bring a malpractice suit to court? Something happened about a year ago at a hospital (June of 2007 and it is 2008 now)( California )
Is it ethical to have more than one attorney review your case at the same time? I have a potential medical malpractice case. The statute of limitations runs out in about four months. I have a few attorneys in mind that might consider taking the case. But I'm not sure if it is considered a breach of ethics to give the medical records to several attorneys at the same time so that if the first one (or two) decline the case I have back-up. I'm thinking that attorneys incur some costs for research and records before deciding if they will take the case. What do you think?
has a wrongful death case ever been won where the person got a settlement for medical malpractice and died? I am trying to find out if anyone knows of a successful wrongful death suit where the victim has received a settlement from one of the doctors involved for medical malpractice. However, the hospital and others involved were not sued. I would like to know because in 2000 my father was a victim of medical malpractice and I have documented evidence that the cause of his death is directly attributable to the initial medical malpractice. I have spoken to a few attorney but they have all been less than helpful perhaps they view this case as one that will require some major effort so they are balking. In any event I am hoping that maybe someone out there may have some input regarding a particular direction that I can move in. Thanks in advance.
Do I have a case of malpractice against my doctor? I was having surgery and while the they were administering the anestesia they messed up my jaw. Now I can only open my mouth half way and it looks like I'm going to have to have surgery to correct it. Do I have a case of medical malpractice? How do I choose a legit attorney to ask? Thanks! Firstly, I am not an advocate of litigation, but I feel if this is going to cause me pain or inconvienience for the rest of my life then that is worth some compensation. I've had X-rays and my oral surgeon has ordered an MRI for tomorrow, so I'll find out then our next course of action. From the first maxofaciallary doctor I talked to (who said this was out of his area of expertise and couldn't help me...referring me to my current dr) it seemed like this was going to take a lot of therapy and after that entail wearing a biteplate for months! This, along with the pain, make me think someone should be liable.
Does this constitute Medical Malpractice? I went to a new Primary Care Physician. Filled them in on my complete medical history (I have a rare Auto-immune vasculitis disease). I called them a week after my first appointment, complaining of sneezing out blood. I was told to go to the ER and diagnosed with a high PT (also on coumadin). A few days later I called again because now I was coughing up blood. Went to see a nurse practitioner in the office and was sent for a sinus x-ray and a cbc (white blood cell count, hemoglobin, etc...). The nurse said "I'm not worried, you probably burst a vessel in your nose and keep damaging it when you sneeze" (I had been sneezing quite a bit). I got a call a week later with the results (everything was normal). I wasn't satisfied with their lack of concern that I was coughing up blood so I went to the Mayo Clinic and requested to see a Rheumatologist (I am new to the state and wanted to secure a PCP before securing a specialist, with the hope that the PCP would refer me to a good Rheumatologist). Come to find out ALL of the blood was coming from my lungs and the PCP's office failed to give me a referral to a Ear, Nose and Throat Specialist or a Rheumatologist. My illness, that was in remission, is now active. Had I not taken it upon myself to find a Rheumatologist, I could have ended up in the hospital in a few weeks, not to mention possibly with pneumonia with blood sitting in my lungs. Does anyone think this constitutes malpractice, before I go calling attorneys for consultations? mnwomen, I am definately dropping their office from my care. I just wanted to know if a threat of malpractice held water. Thanks everyone for your insight. I can see that a prusuit of malpractice would be frivilous but, I will be getting in contact with the Florida medical board today.
what if we can do if we suspect Medical malpractice? I literally believe this is a matter of life or death!! My aunt is suffering from a serious staph infection in her heart due to dirty utensils used in surgery last year. The hospital itself admitted to this, but since their son (power of attorney) was not aware of what this actually meant he did not thin twice. I want to know if there is anything we can do to try to make this right. I don't believe a person held in this high standard should get away with treating hundreds more people with the same carelessness> Someone please help. What can my cousin do in this situation, is there anything we CAN do!? My aunt is a diebetic, she also has heart problems and the two doctors she is seeing go against eachother about what medications the other is giving her. Literally throwing them in the trsh and offering their own suggestions every appt. We need some advice!
Medical Malpractice question - 2 week old baby? Medical Malpractice question - 2 week old baby? We got a prescription from the doctor at the hospital for our two week old daughters acid reflux and we had it filled at Walgreen's. A week and a half later we brought her to the doctor for a follow up and found out that the pharmacist at Walgreen's had filled the script wrong and we had been giving her 30 times the amount she was supposed to be getting per day!!! Well the company that represents Walgreen's called last night and offered us $1,000 if we would sign off saying that Walgreen's was no longer liable for anything that happens in the future relating to the overdose. So we have to get an attorney to figure out where to go from here because if we signed off on that and she has problems in the future, insurance wont cover it because it is a pre-existing condition. My cousins son had the same issue and he now has developmental disabilities, but they arent sure if that was caused due to the overdose. Any advice on where to go and what to do from here??
I need a medical malpractice law firm out of state. Please help me!? I live in Arizona and would like to get a attorney in Cailfornia, to go up against a BIG hospital in Arizona
How are award amounts determined in medical malpractice lawsuits when the harm is primarily mental distress? What is factored in and how do attorneys determine the amounts they sue for on a client's behalf in medical malpractice suits, and how might these amounts differ if the patient is put through more psychological trauma than physical? What about the length of time that the person is affected by the mistakes made? I ask this question because I was recently released after a three-day stay in a state mental hospital. I went to a local hospital ER with a physical complaint of equilibrium problems, resulting in several falls at home. Due to a miscommunication between physicians at a shift change, and as I unknowingly slept overnight, I wound up being involuntarily committed to a horrible mental institution with violent and severely mentally ill women. I woke up to face sheriff deputies at my bedside, who shackled me and carried me away in a blacked-out vehicle that looked like something for stray dogs. As I was taken away, no one would answer my questions, call my family or my doctors. I was treated like a non-person. I was on a mental ward for a hellish, mandatory, minimum stay of three days, after which time I was suddenly released , the doctors having determined there was nothing wrong with me, but not before subjecting me to some awful drugs that made me FEEL crazy and rendered me unable to move or call out for over twelve hours overnight in a locked room. My physical symptoms, which turned out to be a bad reaction to an OTC drug I'd taken, resolved on their own while I was in the place. Right now, I am going back and forth between feeling numb and being livid. I requested my records from the ER and went to the magistrate's office to get a copy of the commitment papers. I was stunned to learn that a doctor had signed it saying I had a plan to commit suicide by overdose! No such thing was ever said by me to a single person, and the doctor whose name was on the document was someone who never even saw or spoke to me! To clarify: I hadn't overdosed at all, and they DID know the medication I'd taken in low dose for three days. It just didn't agree with me, made me dizzy and screwed with my coordination. Symptoms began to resolve as soon as I missed two doses. The entire time in the ER I was coherent, calm, and able to describe the symptoms I was having, which were not even severe, just scaring me to death. At a shift change, the new attending came into my room, introduced herself, asked me about my symptoms, and got a puzzled look on her face when I answered. She asked, "Have you thought about or attempted suicide?" I was in shock. I told her, "NO!!! Absolutely not! Not EVER!!!" She then said, "Okay, there's been a mistake. I'll be back. Only she never came back. In the records I got from the ER, her name appears nowhere, and she made not a single note. But is it HER name that's on the commitment request, where she wrote: "Patient has clumsiness with plan to overdose."?! Only the clumsiness was fact.
Simplest and easiest way to find MALPRACTICE attorney which can work in more than one state in USA? I have been gathering information about what appears to be negligence and malpractice done on family member currently in hospital. It is not the basic wrong medication_which that has happened as well_but rather what seems to family as systematic abandonment of normal, basic nurse supervision of patient in charge, and absolutely cloudy (at best) information from doctor concerning many aspects of patient's well being. I cannot mention words such as "prognosis" or even "course of treatment" because they gave up on her without even really trying. And have repeatedly tried to sell us off on just letting her die. PLEASE, since I have so much information to share with someone who would definetely be much more knowledgeable on these issues, and knowing that most attorneys would not even start to look at a case unless person goes into an agreement with them. And since I cannot affford to keep wasting time, mostly because I have to be much more vigilant of her condition now that I notice less care from medical professionals, can someone please tell me most direct way possible to find law firm which can work out of my state if necessary???
after the statue of limitations run out for medical malpractice is there anything else the victim can do? legally to make the dr/doctors involved take resposibility for the damage that they caused? I had eye surgery at Kaiser and I look like a freak my eye is 97% red all of the time and it looks like a ball of jelly. The surger was to straighten a crooked eye that I was born with it's technically called strabismis, my eye is still crooked but now instead of it going toward the left it's crooked towards the right. Then day after the surgery my eye was infected. I went back the surgeon said that it was normal and just healing well I wasn’t in a normal amount of pain so I got a second opinion & that doctor said something 2 the fact that it’s 2 soon 2 tell because she couldn’t see past the scaring tissue. I sought the advise of an attorney in SF he asked me 2 send pictures and a copy of my medical records,I did. He sent me a letter saying that he wouldn’t take my case (no time) he advised me about the SOL & told me 2 keep looking for an attorny. The SOL passed, is there anything that I can do?
What would be considered medical malpractice? When my huband was injured during basic training, his sargent sent him down for the therapist to have a look, the therapist was told there was loud popping in his back and proceeded to work on him without doing any tests to make sure nothing major was wrong. After this he got worse, so they sent him to a doctoer, who did nothing but take an x-ray and diagnose him with siatica, I don't think you can tell by an x-ray if someone has siatica, but now he's being discharged from the Army, and they're trying to say this was a pre-existing injury. Also everytime he asked the doctors what was wrong with his back, they just ignored him. I think it sounds like alot of medical malpractice, but I'm not an attorney, so I can't be for sure. Does any one know?

Does anyone know a good medical malpractice attorney? I was born 1958 with a birth defect as a result of my mother being prescribed Thalidomide aka Kevadon. Although I have been able to use my hands most of my life they are beginning to give me problems.I have no insurance to cover any medical expenses and was turned down for disability.I was told the statue of limitiations ran out to pursue any litigation against the pharmacutical company Merrell who marketed the drug. Can some one help me?
I am a rising 2L in law school; want to be a plaintiff attorney. Any recommendations for how to get a job? I have a chiropractic degree and want to work in medical malpractice. Medical Malpractice suit? I was injured during a surgery to another part of my body......I have an attorney...but don't understand all the steps that are being taken through this....If you have been through a similar situation and can give me a heads up, I would really appreciate it. I am injured permantly and pain is involved.
Is This Medical Malpractice? Doctors in the ER took Xrays that night and sent my fiancee home without a collar or anything. 3 days later they call and say "Well, we think you have a broken neck, come in for a collar." Then for the next 2 years he has severe pain shooting through his arms and legs and they act as if he is crazy and actually told him he had everything from "Fibromayalgia" to "Post Traumatic Stress Disorder" everything but what was really wrong in the first place. We were jerked around for about 2 years. They actually refused to give him medication for pain when he needed it. Until one day he collapses and seeks treament somewhere else. The new docs said that the whole thing stemmed from his broken neck not healing properly causing him nerve damage and the result of pending surgery for it. He now has a paralyzed hand and pending surgery that he should have had immediately after the accident. I want your opinion. If you are a doctor or attorney please state that in your answer. I have never sued anyone in my life. I am not a sue-monger. We have documented evidence to show he was not treated properly. We are not out to ruin anyone's life by suing them. This hospital also has had other cases where neglect resulted in death or young and old. There was no disclaimer on the release papers that said anything about "Doctors not being radialogists" Even so, the new doc we are seeing said by looking at the current X-ray that a child could have seen this break. If he would have moved the wrong way in the three days he went without a collar he could have been paralyzed from the neck down.
i need an immediate medical malpractice lawyer in san bernardino county to stand cin so my case will remain op? my sons appendix burst prior to his arriving at the hospital and he was left in er for 10 hours before having surgery. ended up in the hospital over a month and had to have part of his colon removed during a exploratory surgery. over 1000 pages of medical records show he was on pain meds like dolodid for 3 weeks and then on methadone after that. his doctor was very resistant and rude during this time and failed to do any of his 90 day after care obligation and also is no longer a doctor at the hospital.we had a lawyer who dumped us right after he filed the suit but right before a court date. i have appeared once in court as a temporary stand in attorney but on october 20, 2008 we have another court date in which i must have council present to represent us or the case will be closed for good as this will be the end of my 60 day extension that was granted to us by the judge during our last court hearing. this is a few of many details about this story and im sure that if given a chance the records will speak for themselves in our defense proving that we are right and that the doctor as well as the er are guilty of not giving my son the prompt and thorough care he needed while in their facility.
Can anyone point me to childbirth data showing women of c-sections that have died after childbirth...? and the child lived. i.e. determined that internal bleeding was the cause. Case: A 27 year old otherwise healthy woman who has given birth 2 other times without complications was said to have internal bleeding and never came to. Then experiencing renal failure and 30 pints of blood to be used. Any suggestions where this may be medical malpractice would also be appreciated. The child was born without complications and is doing fine. Further, anyone knowing of any GOOD medical malpractice attorneys in the Dallas/Fort Worth areas that are board certified and this is their only line of practice would be appreciated.

How can I get a debtor to stop calling? My son recently had emergency surgery and the medical bills are absolutely enormous (in excess of $86000 AFTER insurance pay outs). The hospital has hounded me for several months now, and I have told them that I have hired an attorney for medical negligence/medical malpractice and will not pay 1 cent to them. I have provided them my attorney's information but they will not contact them.
How can I, a person who is for the better part, poor, obtain the finances needed for a large court case? I am currently seeking an Attorney to represent a possible medical malpractice case. Unfortunately - the Attorney's are asking for boo-koo bucks, which I do not have. How can I, a person who is poor (compared to the money they are asking), obtain an Attorney then? Legal-Aid won't help ... they do not take medical malpractice cases. The Attorney's will not go 'pro-bono' (the case is too large). So - I thought I'd toss this out to all of you. Maybe you could help. There has got to be a way for me to afford the high cost of 'Expert Witnesses', 'Court Reporter', 'Court Fees' and the like. The Attorney's are willing to work on a contingency bases, however the fee's mentioned above must be paid by me. The average cost for an expert witness is $5,000 dollars per day. Any answers?
How long should it take for a Doctor to look over Medical Records and an Autopsy Report? My Attorney sent Hospital Medical Records and the Autopsy Report to a Medical Doctor for his Opinion in a Possible Wrongful Death or Malpractice Suit. He sent them about a week ago. How long should I expect the Doctors Review to take?
What type of attorney do you need to file a civil lawsuit? What type of attorney would you need to file a civil lawsuit against a state for disrimination and professional malpractice (other than medical)?
Woman accuses doctors of gang raping her - comical hoax or violent reality or Halloween horror story? --------knicoles1127@yahoo.com> wrote:-------- Someone in my immediate family just endured the indignancy and horror of having an awake colonoscopy at AMC*. While the procedure was begun without her consent, she cried out in pain repeatedly and begged for the physician to stop, which he did not. A nurse and patient care tech were involved with holding different parts of her body down to prevent her from flailing, etc. Upon describing the experience, after which the doctor left her without treating her pain with so much as a tylenol, she explained the incident as feeling like she'd been 'raped' - and we would like to take legal action. Immediately. The more high profile and scarier the lawyer, the better. Medical Malpractice? Ok so here is the short version.... The hospital preformed a surgery on my da Tuesday, they screwed up and admitted today that a Tech wasn't wathing monitors properly so they didn't open the shunt in time and my dad suffered in there words"catastrophic brain injury". We spoke to Risk management today also. They are fully admitting it's there fault.....so question is...hire an attorney NOW or wait til he is hopefully stable. A retires attorney told me to wait...get more info from the hospital while they are talking. We have 2 years in our state to file. We actually retained an attorney before I spoke to this other one who said she would get started now!! We have 3 days to cancel her so what do you think???? We don't want to piss off the hospital while dad is still unstable. I Excuse my spelling I'm tired and stressed...I really question whether he will survive this. It's really bad... Second question...how long should we wait?? Obviously if he dies it doesn't matter we just want to guarentee he is taken care of for life!! Hs is paralyzed on his left side now and can't even eat! They can't insert a feeding tube because he can't sit up....it's freakin crazy The hospital says they have disciplined the tech that was responsible. The hospital has put the bill on hold. So know cost so far. Unless they start changing there story!!
Can someone tell me what my Attorney might be thinking? I sent him some Hospital Medical Records and an Autopsy Report. He told me it looked like a Suspicious Death, But he wanted another Attorney to look them over, He said He was baffled also. So they sent the Reports to a Medical Doctor for his Opinion. Does my Attorney think there was Malpractice or what? and if he Does why won't he tell me?
Can you reccomend....? a VERY good medical malpractice attorney in Kansas City, MO? Thank you!
Is it malpractice, criminal or some other type of suit when a Doctor tampers with medical info? A medical doctor, who never examine me, was hired by the SSA Disability Administration to review my medical records, submit a written report of my medical conditions, tests, surgerys, and either approve or deny my claim for Disabilty Ins. The Dr.completely falsified the info, added info that is non-existent, in order to deny my claim. It is not a mistake here or there, but the whole report. He violated my constititional rights, caused an unfair denials & Hearing, caused me to lose everthing, suffer physically, emotionally, and has slandered me as a fake. I can absolutely prove this. My former attorney withheld his knowledge of this. Unhappy, I questioned him on some things, he dropped my case, sent his file; in it the false review, dated over year before I finally got a hearing! Even though this involves a Social Security Disability Case, my new disabitlity attorney informs me that I cannot even appeal my case based on this & is appealing on another procedure error. I want Justice
Question about dental malpractice lawsuit? My previous dentist (in an HMO network) overprepared (removed too much tooth structure) two of my molars for a crown. The crown will not stay glued on because of it. I talked to a lawyer who said dental malpractice lawsuits are harder to prove than medical malpractice. He said the cost of the lawsuit would exceed the cost of getting it fixed. Are there any non profit attorneys that would help me sue if I can't pay the legal fees? I want to have my previous dentist pay to get my tooth fixed by the specialist. I have to go through painful oral surgery (crown lengthening) to get the crowns to stay glued on. I am suffering severely from another dentist's mistake. Does anyone have experience suing a dentist and winning?
