Finding a Medical Malpractice Lawyer? I'm trying to find a lawyer to represent my dad in a medical malpractice case. Spoken to 3 Boston area attorneys who all say he seems to have a case. The problem is the big firm says it only takes multi million dollar cases, the smaller lawyers don't want to put up the money for expert witnesses. My question is IF he seems to have a case of neglect how can he find an attorney that will take the case and file the claim? Can he do it without a lawyer? Anyone know of any good lawyers for a medical malpractice involving a baby? I have talked to several but most only want to take the case if she had some mental defect or some handicapp that it caused. I had a C-Section and no one told me there was any problems with my daughter for the entire 5 days i was in the hospital. When i got her home i kept noticing a pus like substance on her baby blanket and my arm sleeves where her head would rest. She was born with alot of hair so i never notice anything. I pulled up the bottom of her hair and there was a burn in the back of her head. It was a burn that actually made a big gash that goes all the way across the bottom of her neck. She also had a light burn all the way around her head like a halo that lined up with the deep gash. The halo didnt scar but the deep gash in the back of her head did, but one lawyer told me it didnt matter because she has long hair and no one sees it any way. Thats not really the point is it?

Where do you find legitimate malpractice lawyers? My son was born last year and suffered severe facial trauma that resulted in 4 reconstruction surgeries so far and he will have more in the future. He was in a malpresentation but it was missed and the OB ordered many things that are contraindicated for his positioning in the birth canal. These contraindications are what caused the trauma and resulting surgeries. To compound the problem the OB did not document things correctly in my medical records (I assume to try to cover his butt) but the NICU records are correct and of course the many specialists my son has seen have documented everything. So I would really like to recover the money we have spent on my son's medical bills - I am not the sue happy type of person and I really don't know where to start. When I look online it seems that all the medical malpractice lawyers are what I consider ambulance chasers. I would like to sit down with a real person and explain what happened and just get some feedback on if we have a case and how to proceed. Honestly, I don't care about making ANY money from this - I just want his medical bills covered (even with our insurance we have spent thousands of dollars) so we can move on with our lives. So much happened to me that i will try and just give the facts.last august i went into the hospitol for a simple hernia removel. the doctor said something went wrong and the bowels were nicked.two years before that i had gastric gastric bypass and she said it was done wrong and redid it.i became very sick and had to have four major surgeries back to back another doctor came to my bedside and said his wife a wound care person was fired because of me and his exact words were(that is bullshit) he then said if i stay with my doctor i have now i will die.he scared the crap out of me.he said to let him take over my care and he would fly me to another hospitol. i was so scared cause i was all alone in the room with him and just didnt know what to think.i was then put into a coma for pain management and then my husband said they called him twice to gather my kids i was going to die.i then had a staph infection and i just cant stop thinking of it.

Medical Malpractice ? My great uncle ( My Dad's Uncle) has recently been in rather bad health. He had a kidney stone that got "stuck". When he went in the hospital, they put a stint in his heart. There wasn't anything wrong with his heart and he didn't need it.. Well, then after that, they tried to discharge him, they hadn't even looked into his kidney stone problem. (4got to tell you, the reason the put the stint in his heart is because of a blood-work mix-up) Anyway, we pointed out that they hadn't looked a t his kidneys...THEN, they put a stint in his kidneys... Two days later, they discharged him... Well, my family and I were staying in his house while he was in the hospital (We live about 100 miles away) When he came home, my mom and I came home, my dad stayed.. Uncle Gene started peeing blood, he thought it was fine, he let it go for a few days, about 3 days later, he is still peeing blood, so he calls his doctor, the dumb, redneck doctor told him that it would be ok and that he would see him in 2 weeks! Well, my dad went back up there today. As soon as he got there, he noticed that Uncle Gene had been bleeding more than he was telling us...So now, they are on their way to the doctors office... My dad told me that my both him and my uncle want me to find out how to file Medical Malpractice.... How do they? What type of lawyer do we need? I have spoken to a Medical malpractice lawyer and he wanted me to get a paper signed from my childs dr stating that if the E.R. dr would have cleaned wound , then child would not have gotten infection and been admitted to hospital. Well my childs dr signed it, so how much does that help my case? The infection that got into head wound was Strep B, a intestinal infection, so the only way it would have gotten infected if someones hands werent clean and if cleaned out it wouldnt have gotten infected. Hi clock, he got strep b infection in his head, and the only way to get that is from someones hands. My son had to be admitted for 3 days into hospital with 2 IV's and he was only 4. That could have been avoided if they would have taken 5 min. to clean it out and it was deep. Sandra, yes I know it could have come from any of us, but my point is IF THE DR WOULD HAVE CLEANED IT, LIKE HE IS SUPPOSE TO DO, WHICH HE DIDN'T MY SON WOULD NOT HAVE HAD TO BEEN ADMITTED INTO HOSPITAL. i need an immediate medical malpractice lawyer in san bernardino county to stand cin so my case will remain op? my sons appendix burst prior to his arriving at the hospital and he was left in er for 10 hours before having surgery. ended up in the hospital over a month and had to have part of his colon removed during a exploratory surgery. over 1000 pages of medical records show he was on pain meds like dolodid for 3 weeks and then on methadone after that. his doctor was very resistant and rude during this time and failed to do any of his 90 day after care obligation and also is no longer a doctor at the hospital.we had a lawyer who dumped us right after he filed the suit but right before a court date. i have appeared once in court as a temporary stand in attorney but on october 20, 2008 we have another court date in which i must have council present to represent us or the case will be closed for good as this will be the end of my 60 day extension that was granted to us by the judge during our last court hearing. this is a few of many details about this story and im sure that if given a chance the records will speak for themselves in our defense proving that we are right and that the doctor as well as the er are guilty of not giving my son the prompt and thorough care he needed while in their facility.
Should I consult a medical malpractice lawyer? I visited a Kaiser Permanente Ear, Nose, Throat specialist on Wednesday with what felt like a blockage in left ear. Upon meeting the Doctor, he proceeded to remove two pieces of ear wax that were lodged in my main ear canal. Following the removal of he wax he indicated that my ear drum appeared to be healthy, but that there was some dry skin surrounding the area. As he attempted to remove this skin, he uttered the word "Ooops" at which point I replied, "Oops?" while clinching my fists in pain. He quickly indicated that the dry skin he had removed had managed to break the thin layer of skin around the ear drum similar to what a scab might do if you had scratched it. At this point I was experiencing a moderate level of pain as my ear canal began to fill with blood. He continued to watch my ear canal for approximately 30 seconds before stating that he was going to attempt to stop the bleeding. As he pushed his device into the canal and touched my ear drum, I experienced another shooting pain which caused my fists to clinch yet again. He apologized at this point and said that the bleeding would likely stop soon and that I would be ok. It's now three days later and after nearly 2-3 hours of bleeding on Wednesday afternoon, the entire left side of my head is very sore. Additionally, I'm experiencing sharp stabbing pains inside my ear that consistently occur every 5-8 minutes. My question to anyone here is whether or not I should return to Kaiser (obviously a different doctor) or seek medical advice from a doctor who is not affiliated with the HMO in the event that there was negligence involved. I am looking for an aggressive medical malpractice lawyer to represent my grandfather.? My grandfather (82) is suffering from early dementia and had a few bouts with pneumonia. After he recovered from the pneumonia, he stayed in a rehab to regain his strength so he could return home. At the rehab, he suffered unnecessarily on at least 4 separate occasions due to the incompetence of the rehab staff which set him back terribly in his recovery. I need a good medical malpractice lawyer. Noone in my city or state will take it due to the hospital's power!? I had a surgery done due to heavy menstrual cycles. I was supposed to be off work for a week and a half. I developed an infection one week after the surgery. The dr continued to treat me with antibiotics and never did a culture to find out what it was. One month later, I was still sick and he said that he needed to consult with a plastic surgeon. I went to the plastic surgeon who immediately did a culture to find out what it was. I had interacoccus species and gram positive cocci. I had to have another surgery to fix the first surgery and when they finally released me back to work, my FMLA had ran out and I lost my job. My stomach is horrifying to look at and now I am out of a job too. Noone in the area will take my case because they golf together or go on trips together so they all say that it is a conflict of interest.PLEASE HELP! I have gone outside my state and still no luck. I have had someone call me back within the state but just figured that maybe someone on here has gone through something and knows of a good lawyer.
Do anyone know any Lawyers that would handle a Medical Malpractice Case that's over it's Statue Of Limitation? I had my son back in 2003 at DeKalb Medical and delivered him through an Emergency C-Section, My son was born Premature and wasn't breathing on his own also he had swallowed alot of my Bowel Movement and had several tubes going inside and out of his body, after the delivery of my son the Nurses told me he might not make it pull through I was really devastated and thought that my precious pride and joy wasn't gone make it. My son spent 2wks inside the Special Intensive Care Unit all I could do is Pray day in and day out for the Lord to pull my son through however my son did survive through it all but what I didn't understand is why the Doctors couldn't tell why this took place? Well for the longest I would have these severe Headaches which cause me to close my eyes and hold my head down until they would ease up or whatnot but me being me I would just eat and maybe take some pain medication for it and lye down but this particular day I just couldn't get rid of this Headache I was having so I set up an appointment to meet with an Physician to figure out what was causing these severe Headaches and while I was there they also did some Tests on me and the Doctor discovered some major problems that was going on in the insides of me, She stated that my Uterus was turned completely around and its connected to my Bowels and I'm thinking that that's what caused my son to have had the problems that he had when I delivered him...Now that my son is 5yrs of age and is blind in the left eye the Case I would've had is over The Statue Of Limitation so I wondered if anyone could have a specific Lawyer that would take this kind of Case because ever other Lawyer that I speak with keeps telling me that its nothing that could be done because of the Statue Of Limitation on this type of Case.
Can you tell me if this is medical malpractice? I had a c-section on September 26th. Recently I noticed something "plastic" hanging out of the incision area. It has turned black where it is attached to the skin. I have also had a burning sensation in the incision area. I did not notice this before my post-partum check-up but you would think that the doctor would have. I have no idea how to go about suing the doctor. Should I get medical treatment first? Do you think I have a medical malpractice case and if so you know a good malpractice lawyer? In May I got an abscess in my throat and I went to warmc a local hospital. When I got there they did 2 cat-scans and gave me ibuprofen and an IV solution. When the results came back they told me there was a tiny little abscess nothing to worry about go home it will clear up on its own. They diagnosed it as a sore throat and gave me a prescription for amoxicillin and told me if it doesn't get better in 3-5 days follow up with a physician. I came home and rested I was home no more than Two hours when I woke hardly able to breathe or swallow. I woke my mom and told her to take me to the ER. We went to Valley View the other local hospital and they did 2 more cat-scans and did a spinal tap to rule out meningitis. My blood pressure was very low I think it was like 76/39 and the er doctor told my mom that if we would have listened to Warmc and just forgot about it I would have been dead by morning. The doctor said that Warmc's cat-scans showed my abscess was half a centimeter wide he said that within that short period of time it grew to 2 centimeters in diameter. He told my mom that they were life flying me to Umc in Las Vegas were they were putting me in ICU, he also told her that I had about a 10% chance of making it out alive. They flew me to Vegas and had me in ICU for 4 days and they put me in the regular er for a day more after ICU. Both Umc and Valley View told us that Warmc should have kept me for observation and if they would have they could have possibly controlled this. Now my Insurance is taped out and I still owe over $55,000.00 in medical bills due to this and I lost 3 weeks of work. Please let me know if this sounds like a case and if you know any good lawyers thank you!
Would healthcare prices in the US lower if people stopped suing for Medical Malpractice? It seems that in the US, healthcare is always an issue, especially the rising prices. However there are alot of Medical Malpractice suits where it seems that people are raking in millions, which I think would cause prices to go up, becuase someone has to pay for the lawsuits/insurance. In Canada I read it is very hard to prove, and I am sure in Cuba, or many other countries if a doctor messes up, then tough. If we made malpractice harder to prove, or limit the amount someone gets from settlement, or better yet take away a good portions of a Lawyers take, would that help curb healthcare prices?
medical malpractice , need advice , lawyer , doctors? i am currently hospetilize in one the memorial hospitals in FL and have a huge medical malpractice , i am here my 11th day with no result the first doctor i had tried to discharge me after 2 days without examine me and without seeing me even for 1 second and by being in the hall way, she also claimed i am to fat to fit the MRI machines ,and need to go somewhere else and mind you i did the MRI right in this hospital after we change a doctor . i would like to sue the hospital and that specific doctor for medical malpractice i feel neglected and a shame , i feel that the doctor was rude and there was many accidents on the way that i cant even discuss over the net i was admitted on the 07/07/09 and after the mess with the doctor they all of a sudden changed the admission date to 07/10/09 , i have paper show that i was admitted on the 07/07/09 if i could only can get hold of my chart with all the doctors notes you will sure see a huge medical malpractice going on and a big mass and cover ups i came here with severe headache and leg pain that i cant even stand on my legs dizzy , vominiting , and buttom line cant function at all i still cant barley walk and my headache stayed the same for 3 weeks already stabing pains and that not a migraine ...... the first neurologist that checked me was after 10 days i am here, i am getting pumped with 8mg morphine every 3 hours , Valium pills every 12 hours , and more pain killers just to knock me out. they want to discharge me tomorrow with pain killer and that all , they said that did all the testes and all looks good and they cant do nothing. i feel like they didn't do there job right and my main issue was the cover up they trying to do with the main doctor that was on the case that came to my room yelling in front of nurses about me lying and also while i was in pain in my legs she pushed on my legs on purpose to show that i am not in pain and that was in front of nurses my wife and a nurse in charge . mind you that a second befor a nurse tried to check my legs and she couldent even take the socks off my feet coz of the pain i asked her not to be in my room no more and asked to change the doctor and she kept on signing medication and audits for me . it took me overall 6 days to be able to change her out of my case . there is many complains on the same doctor from nurses and paitents. i would like to know if i have a case in this matter . . i feel neglected , i feel hurt , ashamed , i haven't eat at all or drink for More then a week after she said i am to fat for there machines , i am sure that allot of that is because i have no health insurance. or some wierd reason but i am still not healthy. p.s today after i complain about even more pain they increases the morphine dose to 10mg every 3 hours , i am woozy and feel bad i need your help i need justice. i am getting over all like 80mg morph every 24hours i am afraid i will be addicted to that after 11 days in here ..... they want to discharge me with no withrewl from the morph just kick me home. what shel i do the had me in the MRI , MRA , CT , even lumber pucter that the doctor pinch my leg nerv twice and it hurt till now. all test came clean and the final answer is they dont know what wrong and sending me home like this. help any one ? p.s. i am on heavy drugs now and int's 1 am sorry if it's hard to understand me for susan the nurse : " You are getting a lot of Morphine for your complaints of pains. I am wondering where i can get answers to how to file a medical malpractice lawsuit without an attorney? Our son was killed in a hospital and unfortunately those responsible are getting away with it. Is there a statut of limitations on medical malpractice? My son was misdiagnosed with TB three years ago, he's only six now. It was rather tramatizing on him. He's more scared of X-rays than he is shots. That to me is really weird. I spent about $1000 on medicine. And the company is now billing me for about $2000 in medical bills, for a disease he never even had. Ok the skin test looked positive but it didn't feel positive there is supposed to be like a little rock under the skin. And the first x-ray he moved on but a good x-ray tech or doctor should be able to tell. The other 5 x-rays they took came out completely normal. We even had to take him to a specialist. But it was a long time ago and I can't afford a lawyer. If there isn't a time limit does anyone know a lawyer who takes payments or you only pay if you win type of thing in the san diego area? Or any other thoughts would be helpful. There has to be something... have you ever been told your 3 year old son was dieing, doctors need to be sure before they tell parents that.
How much settlement can you get for Medical malpractice when surgeon leaves a sponge inside of you? ? My mom had surgery on her colon 8 months ago and just last week fell ill even was hospitalized at 1 point and now they just found out they left either a sponge or gauze inside of her stomach and its now causing infection and she now has to have major surgery again to remove it before it becomes fatal. she has an attorney and it is being pursued lawyer said it will settle right out of court but how much can you get ? with pain suffering, mental anguish loss of wages etc...
My cousin, Kevin, has a medical malpractice lawsuit filed. His problem is that he is trying to find a lawyer.? He tried two *contingency fee lawyers and all that the first one did was order his medical records, but that lawyer made him wait for 8 months before the lawyer said that he was going to have a doctor evaluate them. Afterward, that lawyer simply told him that he couldn't find a doctor to evaluate the records. The second lawyer filed the lawsuit for him, but that lawyer also said that he planned to have a doctor look at Kevin's medical records. That lawyer never did and later withdrew as his lawyer. Its a shame that Kevin had to get two lawyers that weren't serious about wanting to help him. They both cited his especially young age of 23 as being the reason that they chose to not really help him very much. Is there any advice that you can give Kevin, short or paying for an out of pocket fee lawyer? Kevin is now paralyzed from the rib cage downward and he had a stroke. *-Both of the lawyers that he tried to work with would have only made a profit if the case were won. We submitted a petition to the court over a month ago for the court to appoint a pro bono attorney. The petition was denied, even though the Court Administrator was the one who suggested that I submit it. The local Bar Association and every service that offers local legal aid charges $100 per hour or more. I'm sorry, but I really dislike to see my brother being confined to home hospital bed, while he's still in his 20's and without a competent publicly funded lawyer able to help him. Whenever someone murders another person, they are allowed to have the court appoint them with a lawyer if they can not afford one. What kind of justice system turns its back on medical negligence victims, while even murderers get a fair chance to have a publicly funded lawyer convince a jury that they should be found innocent? What kind of backwards world do we live in here? We're going to probably be forced to submit a form formally withdrawing the lawsuit, for lack of a lawyer.

Medical malpractice? Deal with Doctor or consult a lawyer? My friend went in for 1/2 hour outpatient procedure. When she woke up it was over 24 hours later with major surgery. spent many days in icu and missed a lot of work. The doctor made a mistake somewhere along the line. She does not want to put the doctor through the ringer, she understands it was a mistake. She does want her medical bills taken care of and I told her to get a little more to help with a mortgage, couple hundred thousand, not millions. So the question is would it be better to deal with the (doctor, hospital) or talk to a lawyer who will want to get a settlement for millions so he can make a lot of money and drive up insurance costs?
How to legally handle an unnecessary surgery (medical malpractice)? A teenager is rushed to the hospital. They wait all night until she's admitted next day by 6:00 AM. By 7:00 AM a doctor shows up and determines it's appendicitis and she has to undergo surgery (appendectomy). Her parents ask for a CT scan to be completely sure. Doctor says it'll take up to 2-3 hrs before getting the results and the girl needs immediate surgery. He gives instructions to send her to the OR but she waits 7 hrs in her room before she finally enters the OR at 2:30 PM. There is plenty of time to have a CT scan done but it's not done. Appendectomy goes fine but there is nothing wrong with the appendix. The doctor and hospital try to collect money for this and the girl's parents refuse to pay. They look for a lawyer but the case is not attractive money wise, so nobody wants to take it. Doctor’s office threatens to send the account to collections. The parents need help. Is there a way to find a legal representation for them or a doctor's board to report this medical wrong doing

I have an incredible story about medical and legal malpractice how do I let people know what to do t help them 2 hosp. committed malpractice. My walking out of one hosp. actually saved my life. A second hosp. left a drain tube in me and, my Lawyers commited legal malpractice. I am now disabeled, however, I know I saved my own life. Many other errors happened the American people need to know what to do. My life is forever changed, I've lost everything and my medical bills are incredible. My daughter was unable to go to her prom, senior trip, get her ring do any of the things one looks forward to in their Senior year. I have been in and out of hospitals and atty. offices for 7 years. A Judge was asked by the Appelate Court on my case and 16 others to remove himself from these cases--WHY-- How is it in America this can happen. Why was this Judge asked to remove himself from my case. By the way 2 of my cases have been thrown out on a technecality???? Any thoughts or clues I just don't know anymore. Well after 6 days of watching my stomach grow to an enormas size my intuition told me it was not gas so a friend of mine took me to another Hosp. were they did emergency surgery and removed 3 liters of urine in my body cavity I had sepsis, all my organs were burned and my intestines had to be removed and hand cleaned. The next day the Dr. inserter a tube into my kidney tru my back so i could urinate thru the tubes into the bag. That was a wonderful hosp and great surgeon that saved my life. It was the hosp. after that that left the drain tube and it wasn't discovered for nine months and I complained about the pain and after an x-ray was done 9mos. later the Dr.'s felt a foreign object had been left in me although they wern't sure what after surgery it was found to be a drain tube. My atty. missed a filing date amoung other things however I am running out of words. I am laughing I truly am shocked at how narrow minded some of you are. When an atty. looks you in the face and says you will never believe this but I now havw committed legal malpractice on you, you now have the right to sue me. You all are right the only way to get anyone to believe except for the one's who have experienced this with me is to try to tell my story on some show along with my Dr.'s and documentation and anyone else they would like to speak who has seen this. medical malpractice lawsuit in 2003, i had an operation for a herina operation only and without my knowledge they took out my gallbladder at the same time. a gallbladder is not a hernia and in 2008, i just found out about it and that is why i can not lose weight and i have been in pain for 5 years and there is a bulge in the middle of my stomach and it hurts and no doctor will fix it. is the statute of limitations is up according to lawyers. is that true ? because i want to sue for medical malpractice.

Medical Malpractice suit? I need to file a medical malpractice suit, however I fear if I try to get medical records they may change stuff in file. I would be filing on behalf of the Estate of..., who is my mother. I am administrator of her estate. She was going to pursue this before but unfortunately she passed away before that happened. She had an illness which has no cure but can be slowed to extend life if caught early. She got tests and she called for months trying to get the results. She didn't receive the results until 6 months later. The doctor who initially performed the testing went on maternity leave. The practice dropped the ball. Should I speak to a lawyer first or try and get her medical records and see if I can dig up anything there? don't even want the money, other than to set up a full scholarship in her name at the School of Nursing she graduated from. I am so lost and and I don't know where to start. I only know what my mom told me when she was alive.

malpractice lawyer? wondering if anyone knows of a lawyer in canada that would be good to talk to about a medical malpractice case. i had a bad experience a few years ago and would like it to be validated. my intestines were perferated and leaking for days and did a bunch of damage along with destroying all my reproductive organs which were perfectly healthy. three doctors in a row claimed i was suffering from an std, the humiliation and grief that caused alone was tremendous, i have never had an std. they all just look at the previous diagnosis and ignore the pain, treating my like some cheap tramp that deserves the pain. i have asked for advice from a couple different lawyers and nobody seems to want to deal with it. is that the way it is in canada? it's not fair, i'll never be the same. there should be some kind of compensation for thier ignorance. not just dumb excuses that at my age these things aren't common so they had no reason to think that my symptoms and cries for help were valid. I feel since they took blood, pap, and pee tests they could've seen it wasn't an std. i'm not a doctor but there must have been signs of a serious infection in my blood, they never mentioned any of the results, they didn't investigate the situation individually, they just looked at the past report and agreed with thier co-worker. in the province i live in they had all these cut backs and lack of beds, closed down entire floors and hospitals, if they had room they would've been able to make some time for me. it's not i suppose the doctors faults for that, thats why every good one leaves the country. thier wage is controlled(specialists are only aloud to work a few days of the month). takes months to get anything done, the waiting lists are long, you can't get a family doctor. they shut down all the psyciatric hospitals and the patients all live on the streets. why should the people have to suffer and die to save money for who? i paid $130.00 p/m for just myself for medical, it stinks!

Medical malpractice statue of limitations...? I have a medical malpractice case but no lawyers want to look into it because the statue of limitations. I know I have a case, because many lawyers said they would have researched it if it was earlier but because i am 2 weeks away from the statue in DC they dont want to. I can not make myself believe there is no one that will help me or is willing to work with me. I know there are ways around it because in dc there is something that the statue may begin when there is knowledge of an error. I have also had 4 surgeries with the same doc for the same procedure so couldnt the lawyer begin the statue from one of the other surgeries and not the first one?? I can not make myself believe that there is nothing that can be done and i ahve to live the rest of my life in pain and the doctor doesnt have to lose 1 night of sleep over it...any advice??anybody? I didnt know that i really had a case or really knew of any statues...The kind of surgery i had requires 2 surgeries, 1 to place the device in your foot and one to take it out, in between i had 1 surgery a month after the first one to fix a screw that was incorrectly placed...I was hoping maybe the statue could begin from the 2nd surgery or even the 3rd?
How can lawyers charge what they want, but make laws about medical costs and milk costs?? Lawyers are making laws about how much people can charge for services. They make laws about malpractice and medical insurance, yet it seems they can charge $350.00/ hour without having to be accountable to anyone, and the Bar Association makes it harder to pass in some states to avoid competition. Does this seem ethical? Most representatives that make the laws went to law school and have a law degree. What I meant is that those people with law degrees making the laws are not regulating how lawyers can treat their clients, but are regulating how doctors treat their patients. Someone should be regulating the quality of services that lawyers provide just as a doctor's practice is regulated for the quality of medicine--if a doctor misses something, he can be sued. It should be same with lawyers not doing a good job.
How do I begin a medical malpractice lawsuit? Very long story short: I lived in NY for several years and now I live in Mass. My old primary doctor essentially blew (for 4 years) off a very common tell-tale sign of something very wrong, which has now turned out to be cancer. I have a very cut and dry case from what I've pieced together, so what is the first step I need to take to get this case moving forward? Does anyone know a good lawyer in Phila for? a botched eye surgery? The surgery was supposed to decompress my right eye that was bulging. Not only does it look like nothing was done at all and no improvement, but there's also something wrong with my lower eyelid. And it really bothers me that this Dr. got paid for this. I feel she should be held accountable. I'm so self-conscious. I notice when speaking to people that they are distracted. I imagine I would need a medical malpractice lawyer. Is is medical malpractice? My son was born with a genetic blood disorder and had to have is spleen removed at the age of 7. He takes amoxicillin everyday to fight infections off. He had surgery on his ear to patch a hole in his ear drum. The doctor had made a Rx for antibiotics, but told us not to give it to him when I questioned him about the fact as to whether to discontinue his current Rx for amoxicillin so that he may take the Rx that doctor had prescribed. Three days later he was back in the hospital with a staph infection that was metacillin resistant. Now the doctors are saying that he will need another surgery to repair the hole because the first surgery did not take due to the infection. He also suffers with hearing loss in that ear that was not efident before the surgery. What I am trying to decide is if there is enough damage in a lawyers or a doctors eyes to say that my son has suffered a loss. I know that he has and I have because of the emotional strain of having to go through another surgery. The doctor was told of my sons condition and about his current use of the Rx and he basically admitted to me that my son had probally picked up the infection at the hospital. Should he be held liable for not Rx him an antibiotic that was stronger. He did not even remember that my son was taking medication until I brought it up to him in post opt. The consulting doctor was not even the one who did the surgery it was his associate. By the was I am getting my son seen at a different hospital where they know of his medical condition. I am not going to let the same doc do another surgery when he messed up and did not Rx a better medication. My son is scared to death and so am I.Then antother surgery may not even take. The first one should have done the job, according to the doc. he had done many and they worked, but he did not do the surgery. This was a routine surgery that turned out to be not so routine. I do not understand why he did not speak with my sons regular doc to be sure.
What qualifies as Medical Malpractice and should I look into filing a lawsuit? My mother fractured her skull on Jan7,08 and was in the hospital for over 2 months. She was unconscious most of that time and during got a blood infection from her pickline as well as from nurses not always using gloves. Also she still has a large bed sore on her bottom that was almost to the bone and is not healing well. I had to write a letter to the CEO of the hospital just to get the nurses to pay more attention to her. She was rarely turned and even sat in her own bowel movement for hours at a time when she was semiconscious, and had feces in her bed sore at times. She also was positive for MRSA in her lungs after getting a breathing tube. Has anyone else dealt with a situation like this and sought legal action? Is it worth it to talk to a lawyer?
Time frame to file suit in NY for medical malpractice? I signed with my lawyer on 10/2006 and have yet to see anything being done.. nothing at all have I recieved from them that they are working on anything... they said they are still requesting my medical records and that they have until sometime in 2008 to file with I believe the state. How do I know they are not wasting my time with them and that I need to find a new lawyer... Question about dental malpractice lawsuit? My previous dentist (in an HMO network) overprepared (removed too much tooth structure) two of my molars for a crown. The crown will not stay glued on because of it. I talked to a lawyer who said dental malpractice lawsuits are harder to prove than medical malpractice. He said the cost of the lawsuit would exceed the cost of getting it fixed. Are there any non profit attorneys that would help me sue if I can't pay the legal fees? I want to have my previous dentist pay to get my tooth fixed by the specialist. I have to go through painful oral surgery (crown lengthening) to get the crowns to stay glued on. I am suffering severely from another dentist's mistake. Does anyone have experience suing a dentist and winning?
Filing a lawsuit for medical malpractice? I want to file one on behalf of my mother's estate. I am 100% sure I have a case against them. The problem is money. I am forking over so much in probate that I am even coming out of pocket as executor to cover the estate so it makes it through the process. Estate money is tied up within the home. I have been searching for a lawyer. I got a response back from one but he charges a $100 consult fee. Now if I shop around at that price it could get pretty costly. I really don't want to resort to Ken Nugent so what can I do? I don't want to let these people get away with what they did but being in probate is difficult. I need to get things rolling though at least on one case because statute of limitations will become an issue soon. It was a case my mother was in the process of pursuing before she was too weak and struggling just to stay alive. What really ticks me off is they want over $15,000 for killing my mother.
medical malpractice or just gross?? OK, I has a cyst drained from the back of my leg in 2005. It was deep ( the size of a pinky finger, as wide and deep ) The hospital had homecare nurses come to my house to dress and pack the wound (ribbon packing). I was told it healed OK. I was infected mid 2006, and I had a CT scan to see if there was a fistula into my bones. No fistula and everything checked out OK. BUT..... Last night I felt something hard where the scar is, and ending up pulling out about 6 inches of packing! it was black and fossilized and smelled bad. I'm seeing my GP in the morning to see if I'm incubating anything else in there. Should I contact a lawyer and sue the nursing company? or forget about it?
CORRUPT USA: schools, medical, court (lawyers, judges), cops, corporations, govt? Schools: Make a ton of money from taxes before college, changing area taxes from 300 to 3500. Then if you go to college, it cost a lot more unless you suck more money from taxpayers. Teachers the only ones getting the win win because they get a paycheck every week and the student just gets a piece of paper and might end up working at mcdonalds. Medial: Our doctors don't work as hard as other countries doctors and get paid wayyyy more, they whine it's because of health malpractice insurance, but blame the insurance and not the people you messed up on, I was in a hospital once and saw a nurse doing all the work and all the doctor did was walk in the room, look at a paper, and initial it and leave the room, i'm sure he gets paid way more than the nurse but did way less work. Court (lawyers, judges): I've seen a courtroom where a lawyer couldn't do his job in a proper manner, it's like a homeless person off the street can do this job. The judge will always favor against you. If you are against a cop in a us court, the judge will 100% favor the cop cause it's your word against his and your word don't mean crap against the cops word cause the state gotta make money. Cops: They wait at speed zone signs trying their best to give you a ticket. This weasel activity must be stopped. They really don't care about your well being, they just care about making money on you. I was in a 55mph zone and didn't speed and got pulled over for going 55 in a 35mph zone but the 35mph zone was 1/10th of a mile ahead. Corporations: I've seen math figures that sicken me. Corporate heads getting millions and millions leaving a company that has no money to begin with cause they're business is diminishing. It's like they get as much as they want and it don't matter what's right or wrong in the amount of what they get. Govt: for allowing all these functions before me to continue to be unfair to the middle class person. For overspending our tax dollars on garbage.
Part time doctor/Lawyer? I need to know how many years I will need to spend in college if I want to choose either medical malpractice lawyer or a medical physician as my oocupation, and what if I try to be both, then how many years will I need to spend?Will I need to take certain courses?
