Looking for an attorney who specializes in medical malpractice cases involving drug companies? Why do people think we should do away with medical malpractice? 1) Doctors make mistakes all the time. Should they not be held accountable for their mistakes? 2) Malpractice cases are RARELY won by patients. 3) Malpractice cases account for a very small percentage of overall health care costs in this country. Why do people look at Malpractice cases as being the problem with medical care in this country? Do you think the health care lobbyists in Washington, D.C. have something to do with this? My medical malpractice case was given a judgement of non-pros by the judge but wasn't dismissed. See Below> The defendent (the hospital) demended a jury trial, so a settlement is out of the question. What I want to know is whether or not my case will probably still go to court, since, as I mentioned above, it was given a judgement of non pros. For clarification, the legal term non pros means that I failed to execute my civil suit in a manner consistent with the law. I have been unable to find a licensed physician to agree to testify that my civil complaint definitely involved a situation which falls below the medical standard set by hospitals in the nearby area. Again, my case had not been dissmissed, and, therefore, that's why I'm asking on here what you think will come of it. The judgement of non pros was given this past April. I can't afford to hire an attorney. I've tried all sorts of lawyer referral networks and I've even petitioned the court to appoint me a lawyer as well as gotten nowhere. The problem has been that contingency fee lawyers have had doctors evaluate my case and refused it. They've told me that I have roughly a 50/50 chance of winning. What I want to know from the Yahoo! Answers community, is for you to please give me an answer to my question regarding the status if a medical malpractice case that has been given a judegement of non pros. The reason that I am going through with this case on my own, is that my medical malpractice related injuries are so extensive that I will wind up living in a low quality medic aid funded nursing home by the time I'm middle age, otherwise, if I don't. My parents are already senior citizens and it will only be a matter of time before they are unable to take care of me any further. "Only a fool would represent themselves in court" No choice!
What does the state/government do in cases of medical malpractice? When a patient has died or went disabled due to doctor's negligence it is clear that you can sue him/her. What does the medical authorities / court / state / government do in addition? Please, name the institutions and their corresponding activities in such cases. I need to know if the state or any other government controlled institution also files a suit against the doctor / hospital displayed malpractice and the way they do it. Thanks in advance for every serious answer! Is patient's death due to doctor's negligence criminalized in any state and thus prosecuted by the state or only patient's relatives could file in court?

Finding a Medical Malpractice Lawyer? I'm trying to find a lawyer to represent my dad in a medical malpractice case. Spoken to 3 Boston area attorneys who all say he seems to have a case. The problem is the big firm says it only takes multi million dollar cases, the smaller lawyers don't want to put up the money for expert witnesses. My question is IF he seems to have a case of neglect how can he find an attorney that will take the case and file the claim? Can he do it without a lawyer? Is there a way to reach muliple lawyers with one email blast to see if any takers?
Medical Malpractice Help Needed? I need to find information on old medical malpractice cases, any that have already been settled. If you can suggest a good form of resource from the internet or from a book that I can find in the library, I would greatly appreciate it.
How to solve the medical malpractice case? I need your excellent opinion and good informations. I have a problem to be solved immediately. I am 23 years old woman. never married, no experience in sexual intercourse, physically virgin. Perfectly healthy before this happen. 7 weeks ago, I felt pain in lower back and went to the pain clinic and consulted doctor. After consultation he gave me injections in my lower spine. It was about 5 o'clock in the afternoon. After that, I came home and slept but awakened by severe pain in my belly (the abdomen) 3 o'clock in the next morning. I called 911 and went to emergency room in hospital. They checked and told me there was a lot of blood in the belly and need immediate operation. Operations done immediately and taken about two and half hours and they got rid of blood about 700 ml. I was given two bags of blood transfusion during operation. They cut the velly about 15cm and I have a scar now. After operation, Doctor told me it was corpus luteum rupture. After leaving hospital, I went to the pain clinic and met the doctor who treated me and asked about the medicine which I had been injected 7 weeks ago. But doctor said it was only a coincidence and he did nothing wrong and refused more explanation and rejected giving me the document of medical diagnosis and treatment (medical chart). I asked him if he use the a hormone drug in injection and he said he never used a hormone drug in my treatment. And he just gave me a simple memo instead of full copy of chart. Contents of memo was " Lidocaine 5ml " only. Therefore I met the chief of hospital and he issued the document. Document of medical chart said as follows. 1) Triamcinolone 40 mg/ml (1ml) 1 vial * 1 1 EPI 2) 2% Lidocaine 400mg/20ml (20ml) 1 vial * 1 1 EPI I known that the doctor lied me about using of hormone drug and dosages. He even lied me about the volume of medicine. In fact, I can not believe the credibility of the issued copy of document which issued by the chief of hospital. I have heard that hormon medicine like triamcinolone have big side effects to blood vessels. I think It affected seriously in rupture of the corpus luteum. I also so worry about relapse of this thing and any harm to the pregnancy in the future. But, I have not much informations about hormone medicine and informations in internet and guidebook in pharmaceutical company are superficial and can not understand. Hospital said that I must present them medical evidence about correlations with the use of triamcinolone and rupture of the corpus luteum. They refused talk. Please inform me of any opinion and idea to solve this problem. (1) Correlation with the use of triamcinolone and corpus luteum rupture (2) Side effect of triamcinolone (3) Any medical thesis or journal or report relevant to this case (4) Possibility of maltreatment during injection to spine (ovary exists near front of injection point) (5) How to find out this relevant source material or informations (6) How to handle this case (legal point or strategy) I fully sincerely appreciate you in advance. Thank you so much your long attention. Laura LAURAPALTON @YAHOO.COM

Is this a Medical Malpractice case? I went to the ER last night because of a pain in the back side of my head and my mouth is full of blisters; the doctor diagnosed me with "sinusitis and stomatitis" without even a blood test, urine test neither x rays! He prescribed me antibiotics, antihistamines and pain killers and sent me back home. What if I don't have any of those? and if I do have what he diagnosed , wouldn't the Hospital need tests in order to release me and prescribe me drugs? what should I do in this case?

how do I find out if my dr has ever had a medical malpractice case? It is not because I don't trust my dr. There was a dr from where I live that has a really reason for malpractice suit and since I just found out I was going to have another baby I wanted to make sure that my OB does not have alot of suit againt him. I love my OB, he did a great job with my last 2 children. I also work in the medical filed before I became a stay at home mom so I know all about unhappy people and suit for no real reason. But it is my right to find out about my OB and I wanted to make sure. Nothing wrong with that :-)

The patient sues Dr. Smith for medical malpractice and A)intentional tort C) battery B) assault D) negligence 4) in a medical malpractice case, a physician must give testimony at a deposition thats part of the________ process. A) confidentiality C) appeal B) trial D) discovery
I'm preparing for a doctor's deposition in a medical malpractice case .? I know what case specific questions I'm going to ask. Does anyone know any generic type questions that Doctors dont want to be asked?
what determines medical malpractice & does this man really have case? He was in a car accident & suffered a knee injury. He was sent to the ER via the ambulance. When there he told the doctor about the knee injury but the doctor never did any X-rays claiming the guy was too healthy. The doctor said that the knee would be sore but would heel in a few weeks & that the man can return to work the next day. After about 5 weeks the knee was much worse & the man goes to another doctor, this doctor orders test & it is found that the knee is injuried badly enough to require surgery. This new doctor asked why the ER never did Xrays & thinks that the injury would have heel with proper treatment (physical thepary) & if given proper rest (days/weeks off work) The new doctor states that the ER doctor neglected to do his job properly. Now this man thinks he has a medical malpractice case.
do i have a medical malpractice case? i went to the er on a sunday with pain in my left side.. they ran tests and scans and told me that i had a ovarian cyst..they gave me pain medicine and referred me to a doctor...i went home and called the doctor they referred me to on monday but they couldn't see me until that Thursday...well the pain got really bad so i went back to the er on monday and i was told that the cyst was large and all they did was give me stronger pain medicine and sent me home....then on tuesday i couldn't take it anymore so my uncle took me back to the er and said that we were not going to leave until something was done... so they admitted me and called a doctor and he said that i needed surgery and that it was really big... so i had my surgery on tuesday... during the surgery they discovered that i DIDN'T have an ovarian cyst but that my ovary had actually flipped and was filling with blood and was now the size of a basketball and had actually started to tear and even had pictures of it... they had to cut me in four places just to drain it and had to remove my left ovary.. they doctor who did my surgery told me that i was really really lucky and that he hadn't seen anything like that before.... all i want to know is if i have a medical malpractice case against the hospital or whoever??? i called one lawyer and they sent a letter saying that couldn't take it but that i should keep trying.... so should i try to find another lawyer.... i mean my ovary kept getting bigger and maybe if they would have done something on sunday then i would still have my ovary... when he said he hadnt seen it b4 he was talking about how big it had gotten..... also they seen that it was getting bigger and did nothing but give me stronger pain meds i live in FL im am 23 yrs old
DO I have a case of medical malpractice? My disc in my neck is loose and I have an infection now.? I know someone who had neck surgery a year ago. Do i have a case for medical malpractice? I went into a local walk in clinic where i told them i was having a sharp pain when i breathed. They did some stuff and told me it was probrobly just a pulled muscle and to call if it got worse. I had to make them do an x ray b/c they thought it wasnt serious but i knew i was in a lot of pain. So in the next week the sharp pain got worse and i called them and they said the doctor would call me back. Never got a call back and about 2 weeks later bairly being able to walk i went to the emergency room where i was told i had the worse case of phnemonia they had seen in ten years and had surgery and now have a scar larger then a ruler on my right side of my back and had to get a blood transfusion during surgery.
Do I have a case for medical malpractice? I had a hysterectomy in the spring, no complications. At my six week checkup, my GYN said that I was healed and could resume normal activities including sex. A week later, after my husband and I had sex, my intestines came out and I had to be rushed to the hospital for emergency surgery. I was hospitalized for 5 days and now have chronic pelvic pain. Dr's commented that this is an extremely rare event but nobody will say my hysterectomy surgeon made a mistake, even though the intestine that came out looked perfect, there was no blood when it happened and there was no scars on the intestine indicating that they had been sutured in. I saw one of the top attys in our city and they said there is no proof of dr error. I have researched this and the #1 reason for this happening is poor surgical technique, there are also other reasons like obesity and diabetes, but that doesnt apply to me...my question is how can one prove malpractice if no dr will incriminate another? Please help me.

Do I Have A Medical Malpractice Case? Here's the situation... I was born with a very weak chin, which gave me an awkward profile. For years I debated doing something about it so finally I broke down and went to a plastic surgeon, who examined me, and reccomended a silicone chin implant for me. I never had a cosmetic procedure so I asked him how safe it was, and he assured me it is a very safe and simple procedure, etc. Therefore I agreed to the procedure. After the surgery I noticed a severe assymetrical bulge on the left portion of my lower gumline. It felt tight and sore and looked very odd. I followed up with my surgeon, but he assured me it was just a fibrous tissue capsule that had formed around the implant, and will dissipate quickly. Well, about a week ago, I had some pain, the bulge became more severe, and to my horror, when I looked in the mirror inside my mouth, i discovered that THE ACTUAL IMPLANT had broken through my gumline, and was partially protruding out just below my teeth, exactly where that so-called "fibrous tissue capsule had formed"...the doctor was wrong..the bulge, had been the IMPLANT ITSELF, which had been aligned incorrectly, and therefore extruded from my mouth. Not only had the doctor misaligned the implant, he wasn't even competent enough to realize that's what it was on a follow-up. I then immediately had to get the implant removed, and was smart enough to get it removed by a triple-board-certifed plastic surgeon. The surgeon explained to me the following: There's two ways to put in a chin implant...externally, by making a small incision just behind the chin, or internally, by making an incision in the gum tissue beneath the lower teeth. He explained that it is FAR safer to make use the external incision because it forms a much tighter pocket around the implant, and leaves nowhere for the implant to extrude easily (unlike through the gumline from the inside). He ALSO explained that it is INCREDIBLY INCOMPETENT to implant a LARGE chin implant through the mouth, because the larger the implant, the more it tried to extrude itself. And my implant, he discovered after removing, was one of the LARGEST implants on the market. Now I have to wait 3 months while the first failed implant heals before then getting a 2nd implant, which will cost an additional 4 thousand dollars. In addition to the obvious pain of removal, the psyhological horror of seeing an implant rip through your gum and hang out of my mouth, the embarassment of the next 3 months having a noticeably distorted profile from what people had grown accustom to, and an increased risk of chin ptosis or "witch's chin" in the future due to the immense muscular gloving created by using an internal access point on such a large implant....in addition to all that, I now find out that this was all on account of an incompetent surgeon ignorant to proper incision technique on an implant my size, never once stated to me the external incision was far safer (which would have made me request it), and then worst of all, eliminated any chance of being able to avoid removing the implant by failing to realize the misalingment even upon follow-up examination. I know I signed informed consent forms like any operation, but the concept was that I was signing off on the inherit dangers of a procedure being attempted within normal protocol...NOT a procedure that was being done completely wrong, that I had no way of knowing short of being a doctor myself, or being told by another doctor after the fact. Do I have a case here? Between the first surgery, the removal, and the 2nd surgery which I'm getting in January, the total medical bills will amount around 10,000 dollars. What I think I want to propose to a med-mal lawyer is that the incompetent doctor absorb the 10K in medical bills, and an equal amount in pain and suffering, to avoid me taking this to court. I think a 20K settlement for this ordeal is a reasonable out of court request. If you are a legal expert, tell me #1- if you think the doctor's gross ignorance regarding correct methodology for a procedure he reccomended is a form of medical malpractice. and... #2- If it's close enough that if he has any sense he'll agree to my reasonable demand to keep me from flooding the the internet with bas PR for him and taking him to court.
what determines medical malpractice & does this man really have case?

Dentist did a shotty job and refuses to fix...medical malpractice? To make a long story short so I can get to the main details of this situation, I had my teeth prepped for veneers near the first of October and wore temporary veneers until Nov 5th, might I add these temporary veneers looked amazing and I was told my permanents would look like this. Nov 5th is when I had my permanent veneers placed. My gums were beat to crap and looked horrible, as did the veneers. They looked NOTHING like the Halle Berry picture we sent to the lab tech. I went back on Nov 6th, the very next morning, and complained about how horrible they looked...I was told they would do whatever it takes to make me happy. This has been the famous line along this journey. They set me up for another appointment, today, Nov 11th. I went into the office today to tell the dentist, once again, that to make me happy I needed these veneers, all 8 of them, REDONE. I wanted them redone to look exacty like the temporary veneers I had on before, the ones that I was falsely told my permanents would look like. He said he couldn't take these off today because my gums still look like crap and need more time to heal, he said once they heal he can start doing things. He said he will do whatever it takes to make me happy, that's his main goal. He called the lab tech guy who makes the veneers and had him come and see my face and talk to me. All of this sounded great, my mother came back into the office with me to tell the dentist how shotty his work had been and we both really felt this dentist was going to do everything in his power to get me the new set of veneers. Well the lab tech guy saw all the faults in his and the dentists work and said "I will definitely make you a new set, let me discuss it with your dentist and see if he is willing" okay, so I already told my dentist "the only way I will be happy is if you REPLACE THIS ENTIRE SET OF VENEERS WITH NEW ONES, not try and contour these" his response "I will do whatever it takes to make you happy!" Well after the lab tech guy and the dentist had their discussion my dentist and his assistant come back in and lower my chair back and he says "I am going to do something to fix things temporarily so you can feel comfortable to go back into work and in the public" (Mind you I have been out of work for the past week and a half due to his shotty work) He started grinding away at the permanent veneers that are on my teeth (I thought this wasn't good to do, is it?) and it hurt very bad making me shiver non-stop, killing my nerves. He ground my teeth off without even asking my permission by the way. I looked in the mirror and wasn't very happy but decided it'd do for the mean time while I wait for my new set. I said "this will do for now until the new ones are made"...the my dentist got up and left the room. Then the assistant rinsed my mouth up and started cleaning everything up. Oddly, I never got to see the lab tech nor the dentist again and said to the assistant, where did they go? She said "oh you won't see them again today" I said "whats the conclusion, no one ever told me?" and she said "he's not replacing them, that's it...we want you to keep these that's why we just reshaped them" and I said "WHAT, he SAID he would DO WHATEVER IT TAKES TO MAKE ME HAPPY and he KNOWS the new set is what he left me believing!" My mother couldn't believe it either, she stood up and spoke for me as well. The assistant told me to SHUT MY MOUTH and not speak like that in their office, there were other clients. I asked for a refund to have another dentist finish his faulty work (not to mention he BROKE one of my veneers when putting it on and still hasn't rescheduled me to have it remade) and she said "YOU ARE NOT GETTING A REFUND AND YOU ARE NOT GETTING NEW VENEERS!" I cannot believe my dentist left the room and left his assistant to do "the dirty work" for him. How cowardly! I was told to leave the office and they came and talked to me outside because I was crying and they said I was disrupting their office. The assistant kept saying they decided they would just grind away from what I had and reshape them to my liking but I hate my canine and bicuspids, they are too small and they can't add to the tooth structure when they keep taking away from it. She said they will not change the veneers because they think in their medical opinions that the teeth look too nice, but I am the one that paid 7,000 dollars for these teeth..not them. Do I sound like I have a medical malpractice case? My dentist lied to me, right to my face. My mother was there as a witness and every time I have to go back into that office I will indefinitely make sure I have someone there as a witness, maybe even bring a video recorder or at least a tape recorder just incase I need documented proof in court later on down the road. Also I paid with Care Credit, which is a health loan company. Do you think the loan can be halted while this is being settled? I need SERIOUS help, please. Serious advice only. J
Can a 3rd party sue for medical malpractice on behalf of someone else without power of attorney or health prox? Parent A is in the hospital. Child A has health care proxy & power of attorney (in addition to being the executor of the will). Child B wants to sue the hospital for malpractice (possible case, though not airtight). Child A doesn't want to sue at all. Does Child B have any right to sue on behalf of Parent A (still living at this point)?
Do you think I have a medical malpractice case and if so you know a good malpractice lawyer? In May I got an abscess in my throat and I went to warmc a local hospital. When I got there they did 2 cat-scans and gave me ibuprofen and an IV solution. When the results came back they told me there was a tiny little abscess nothing to worry about go home it will clear up on its own. They diagnosed it as a sore throat and gave me a prescription for amoxicillin and told me if it doesn't get better in 3-5 days follow up with a physician. I came home and rested I was home no more than Two hours when I woke hardly able to breathe or swallow. I woke my mom and told her to take me to the ER. We went to Valley View the other local hospital and they did 2 more cat-scans and did a spinal tap to rule out meningitis. My blood pressure was very low I think it was like 76/39 and the er doctor told my mom that if we would have listened to Warmc and just forgot about it I would have been dead by morning. The doctor said that Warmc's cat-scans showed my abscess was half a centimeter wide he said that within that short period of time it grew to 2 centimeters in diameter. He told my mom that they were life flying me to Umc in Las Vegas were they were putting me in ICU, he also told her that I had about a 10% chance of making it out alive. They flew me to Vegas and had me in ICU for 4 days and they put me in the regular er for a day more after ICU. Both Umc and Valley View told us that Warmc should have kept me for observation and if they would have they could have possibly controlled this. Now my Insurance is taped out and I still owe over $55,000.00 in medical bills due to this and I lost 3 weeks of work. Please let me know if this sounds like a case and if you know any good lawyers thank you!
Dentist did a shotty job on my veneers, refuses to fix...medical malpractice? What is a good example of a BAD Medical Malpractice Case? I am writing an essay and I need two examples of BAD medical malpractice cases to take to court. Any ideas?
Is this a medical malpractice case? My 13 year old son fell down the dtairs last night, and injured his foot, he couldn'r put pressure on it, and now used vrutches that we had from before...my wife called 911 and they told him to stay put until they got there. The doctor at hospital took xray's, came to see my son, said rudely, "There's no reason to have to call emergency 911 resue for something like this, I wouldn't recommend doing it again, if it's not necessary, save it for the people who really need it." As he said he was going to look at the xray's and be back, my wife saw him go to his desk, but didn't look at naything, talked to a nurse, and game back saying, "well, I don't think there's anything majorly wrong with his foot, it's probobly just a sprain, can he put pressure on it?" Our son got up and slowly put pressure on it, and walked with a hobble, and painful limp. He didn't give him any pain medication, or splint, cast, or even an ace wrap, and sent him home. should we have a lawsuite here?
Is this normal practice for a medical malpractice case? My daughter was paralyzed after rectal surgery on June 30, 2008. We contacted a law firm in July 2008 and we signed a retainer. We have yet to hear from them as to whether they will take the case or not. They never call us. Whenever we want information we always have to initiate the call. I think we rushed into it without doing our research on this well known law firm and they are located in the same state as the hospital. Should we contact another law firm and if so, would this original law firm still have to get paid for the work they've done, if any? Is this normal practice...should it take almost 8 months to tell the client if you will at least take the case or not?
need to find a medical expert witness for medical malpractice case? urologist removed kidneystone caused a bleeder, left on vacation, patient in severe pain, later finds out patient has nerve damage on same side of bleeder.Told by urologists partner "protocol says we have to stop the bleeding in 2 days if it does not stop on its own."Patient was then given 6 units of blood.Nine days later patient bursted open blood everywhere and a radiologist had to be called in to stop bleeding. As a result a coil was left in kidney.Day 12 urologist comes back from vacation and tells patient"when the radiologist went in to stop the bleeding a coil popped off and if you don't have it taken care of you will be right back where you started."
Do you think I have a medical malpractice case? I'm not sure whether it's worth my time or energy, but all my friends and family are telling me I need to get a lawyer. Anyway, my 11 year old daughter came down with stomach cramps and a fever on Jan 21st. On the 23rd it had gotten worse instead of better, so that morning at 4am I took her to a local ER. The doctor never touched her body, but took her vitals and she had a fever and was complaining of severe cramping in her stomach.. he got a urine sample to make sure there was not blood in her urine and there wasn't so... he told us that she was probably just constipated or maybe having menstral cramps or maybe had a virus. So we left and came home. That same day about 8 hours later, she had been asleep and woke up hurting really bad again and still running a fever. So it being Friday afternoon I decided to take her to her pediatrician to make sure everything was ok since the weekend was coming up. To make a long story short, the doctor said well the ER was probably right she is either constipated, has mentral cramps or a virus and sent us home. I then waited another 24 hours and she was way worse, so I took her to a different hospitals ER. They took her directly in and put her on an IV without any tests. Her cheeks were purple, she had dark circles under her eyes and her fever was 102.5. We spent 12 hours there while she tried to drink about 40 ounces of contrast in order to do a CT scan. The doctor got frustrated with her and screamed at her saying "Do you know how much money you are costing your mom and dad? If you don't drink this stuff right now I am going to strap your forhead and arms and legs down and shove a tube down your nose and put it in that way". Well of course we were all terrified and so I just begged her to drink it... but her heart rate was hovering at 160. When she had finally drank enough, they found that her appendix had ruptured and so I had her sent by ambulance to the nearist hospital with pediactric care for surgery. She spent 13 days in the hospital and has just been sent home with home health care. She has 2 drainage tubes and a pic IV line that I have to administer 2 antibiotics every 8 hours in. Her appendix had ruptured and had time to turn gangrene... and her entire abdomen was filled with infection. She barely made it through the ordeal and still has a lot of healing to do. If only the 1st doctor I took her to at the ER would have done a simple blood test, he would have seen that her white blood count was extremely elevated and maybe could have prevented some of the complications. Any of your opinions are greatly appreciated.
What should I wear to my Medical Malpractice case? I'm going to court in a few weeks and I'm not sure what to wear. This is actually a repeat thing, we appealed the last verdict and when it went to Florida Supreme Court, we won a new trial. I'm a stay at home mom and have always been one, so I don't want to dress too nice b/c that just isn't me, but I want to respect the court and dress right. The trial is going to be 3-5 days long, so I gotta come up with a few outfits. The other "problem" is that we moved to another state, so we have to travel & I cannot take all of my stuff with me. It has to be planned out and packed and ready to go. I'm thinking nice skinny jeans with baby doll tops (nice ones) and Mary Jane's as shoes. What about leggings? (The baby doll tops go past my butt, hiney, back-end). I don't wear heels & haven't for 15 years, so it'll pretty much have to be my Mary Jane's. I'm not trying to be anyone else but me, dressing up or dressing down for court & the jury. I'm just worried about it being "dressed down".
I've been subpeonad to testify against my husband (we are going through a divorce too) in a medical malpracti It is a medical malpractice case, what I know will bury my husband and possibly he will be charged with fraud if I testify, I know it is a crime to not testify when being subpeonaed. How should I testify/
What do you need to do to sue someone for medical malpractice? My grandmother just passed away from a massive stroke after having a tummy tuck done two days previous. They sent her home with a catheter still in and my grandfather was giving her blood thinners a day after the surgery she was still bleeding from the incision. We think that there was medical malpractice in this but we have no idea where to start to figure out if there really is a case or not. Please give us some idea on where to start and how to really know if there is a case to pursue. Thank you.
I'm a medical assistant and was subpeonaed to testify in a malpractice case where the physician.....? actually admitted he committed malpractice. My testimony was excluded for some reason. Can anyone tell me why? I was just curious.
Do I have a case of malpractice against my doctor? I was having surgery and while the they were administering the anestesia they messed up my jaw. Now I can only open my mouth half way and it looks like I'm going to have to have surgery to correct it. Do I have a case of medical malpractice? How do I choose a legit attorney to ask? Thanks! Firstly, I am not an advocate of litigation, but I feel if this is going to cause me pain or inconvienience for the rest of my life then that is worth some compensation. I've had X-rays and my oral surgeon has ordered an MRI for tomorrow, so I'll find out then our next course of action. From the first maxofaciallary doctor I talked to (who said this was out of his area of expertise and couldn't help me...referring me to my current dr) it seemed like this was going to take a lot of therapy and after that entail wearing a biteplate for months! This, along with the pain, make me think someone should be liable.
medical malpractice? Ok so i my b/f (we'll call him bob) has a medical case that he believes is worth taking to a court room. this is the what happen when he was 17 on of his testicals became swollen so he went to the doctor and they gave him a medication for it but it was the wrong medication that caused it become even more swollen he went back to the doctors and they gave him another medication that brought the swelling down but now his testical is 2 times smaller the the other and has possibly became sterile because of it also it happened about 4 years ago we want to know if he was to take it to the court room if he would have a fighting chance? well i found out that when he went back to the doctors and the doctor at the time told him point blank that he had given him the wrong medication
example of cases in medical technologist malpractice? casesof negligence og a medical technologist in a hospital or laboratory setting
Do I have a case; medical malpractice? Left arm was fractured in 4 places and dislocated at elbow. Doctor had set the bones improperly causing the need for more surgery and permanent deformation as well as limited use. These problems will persist for the rest of my life. The matter happened awhile ago, but was never resolved. I'm currently suffering from tendinitis and the inability to work. If I can take some legal action, where do I start? The doctor casted the arm before the swelling went down. This led to the bones slipping back out of the joint which required them to cut it open a second time. This doctor is well known for making blunders often.

Would a medical malpractice lawsuit be procedural law? I am confused on the difference between substantive and procedural law - I know that substantive is what gives rights/responsibilities and procedural is how a case is handled. But which would a medical malpractice lawsuit be?

what is the best way to find a really good lawyer that deals with Medical Malpractice ? me and my husband have had a problem with some doctor and believe he has neglected his medical duties when treating my husband. how do we find a real pro lawyer that has already won in similar cases?
Outcome Inevitable or Medical Malpractice? I went to a new OB Gyn on 6/15/2007 and was given a prescription for birth control, on 7/16/2007 I found I was pregnant. On 7/17/2007 I had a sonogram and was informed my pregnancy was ectopic, I was 6-8 weeks, and I was bleeding internally. I was sent to the emergency room where I had surgery and a portionof my right tube was removed along with the pregnancy. The doctor who gave me the prescription for birth control (ortho evra) did not bother giving me a pregnancy test only a pap smear. Had the doctor diagnosed me four weeks prior could the surgery have been avoided? Do I have a case for medical malpractice?
Has anybody ever sued the USAF for medical malpractice and could share some advice? I am currently in the USAF and I know that I cant sue the USAF but the medical issue is with my wife and as a civilian I believe that she sue on her own behalf but I an not 100% sure. Also, unsure of the process (I would assume that we would have to find an attorney that specializes in these types of cases). Any guidance would be helpful. Thanks
Medical malpractice statue of limitations...? I have a medical malpractice case but no lawyers want to look into it because the statue of limitations. I know I have a case, because many lawyers said they would have researched it if it was earlier but because i am 2 weeks away from the statue in DC they dont want to. I can not make myself believe there is no one that will help me or is willing to work with me. I know there are ways around it because in dc there is something that the statue may begin when there is knowledge of an error. I have also had 4 surgeries with the same doc for the same procedure so couldnt the lawyer begin the statue from one of the other surgeries and not the first one?? I can not make myself believe that there is nothing that can be done and i ahve to live the rest of my life in pain and the doctor doesnt have to lose 1 night of sleep over it...any advice??anybody? I didnt know that i really had a case or really knew of any statues...The kind of surgery i had requires 2 surgeries, 1 to place the device in your foot and one to take it out, in between i had 1 surgery a month after the first one to fix a screw that was incorrectly placed...I was hoping maybe the statue could begin from the 2nd surgery or even the 3rd?
How does a person deal with medical malpractice involving the VA hospitals? It seems that the VA is such a powerful institution that few lawyers have the resources or will to deal with their arrogance. This seems especially the case during times of foreign policy crisis such as now. But, I have a serious need to resolve the prolonged problems that I am having with these people.
How are medical malpractice awards determined ? Specifically in California, how does the attorney determine how much to sue for? Does anyone know the outcome of cases of improper administration of Kenalog resulting in subcutaneous atrophy? Assuming the case does not go to trial, how does the physician's insurance company come up with a counter offer to settle? Thanks!
medical malpractice? My father is a diabetic. He has been on pills to control his diabetes for like 3 years. He has had the same diabetic doctor for the whole time. He has most of his toes cut off due to the diabetes. Yesterday, he almost went into a sugar coma when his sugar tested 394. He was given insulin to bring it down. I was told by the nurse, that he will have to take insulin for the rest of his life. She said he probably needed a long time ago. She said that if he would have been given it before, he would probably have all his toes. I am thinking of pursing a lawsuit against his doctor. Do you think that I have a case?
Medical Malpractice? I have a girlfriend who had cosmetic surgery done about a year ago. Since that time her body has not properly healed and she's had two staph infections in relation to the surgery. Everytime she went back to her plastic surgeon he kept telling her that her pain and discomfort was normal, and only to find that a couple months later it was an infection that should have been treated. He was very unproffesional and at one point began to get aggressive with her when she kept going back to him because she felt ill. I know that when you get cosmetic surgery done, there are documents you sign and etc....she is looking to find an attorney to handle this case. When she had spoke to the nurse at this facility the nurse informed her that the surgeon no longer worked there and that she was not the first to complain about him. She also added that the particular procedure my friend had done was not one that this doctor had been particularly familiar with. Of course that could be heresay and anyway,,,,my big question is. Is she wasting her time? Should she just deal with the disfigurement she is left with or is the matter worth pursuing? I know it's possible nobody here is an expert on this subject but I was just giving it a shot, thinking maybe somebody has either been through this or knows someone who has. She has horrible results due to this procedure. I'd just hate to see her depressed and beating herself up for nothing if there isn't anything she can even do anway.
do I have case of medical malpractice against surgeon? had hair transplant surgery 20 days ago.The scar from the donor area (strip) is not flat but bulges out like a bump, detectable to the touch specially and significantly on the lover level of it.I have allot of scars where sutures where removed and big gaps of areas where is no hair growth Looks butchered. On advice of my surgeon stiches were removed 9 days after surgery.they were removed by person who has had no experience or qualifications in doing that (I was her second client and it was performed in cosmetic saloon where she is an emploee, the surgery was also performed there). She had significant problems to do it and it was very very painful when she was cutting them and pulling them.I found out after the stitches were removed that I had disolvable sutures!!Is it medicaly correct disolvable stiches to be removed by cutting and pulling from non trained person?I can prove this facts.I don't know do I have legal claim.please respond I am disturbed.
Medical malpractice help? Lost hearing 1 1/2 years ago 2 week after PA administered heavy syringing to the affected ear. ENT noted on Med records, no active bleeding at this time. Ear graphs show flat lines on the affected ear with a mountain on the unaffected ear. I cant get anyone to tell me why? Was this due to the syringing or just a freak mishap in my ear. No, I am not old, 43 years old. Do I have a malpractice case or just tough luck? I am not out to get anyone, I just want my hearing back and the doctors dont seem to have any interest in helping me. What is your suggestion?
Medical Malpractice? Please help.? My son has been having stomach problems since April. He had been to the same hospital several times for the problem. 3 times by squad. The pain was unbarable. He had the same tests done everytime. He had CAT scans, x-rays, colonoscopy, you name it he had it. They have treated him for irritable bowel syndrom, spastic colon, H-pylori, even thought he had chrons decease. The last visit to the hospital they said he had a blockage and they were just not going to feed him until it worked itself out. The pain was untolarable. He was also sepsis. They decided to cut back on his pain medicines to help him have a bowel movement. Nothing happened. He was just in horrible pain. After laying there for 13 days, no food, dying of pain they decided to do exploritory surgery. When they got in there he had a ruptured meckel's diverticulium and a paracolic abscess. I been told that if the abscess would have busted he would have died. He was already really sick. Is this a malpractice case? Let me add also, my son is 23 and now has an temp. ileostomy and had to have a very large open would due to the fact there was so much infection they could not even close the wound. Halfway through his hospital stay he had a horrible nurse that got his medicince changed. They gave him a anxity medicine that made him so delusional he checked himself out of the hospital he he was so sick and out of it they found him naked on the bathroom floor in the emergency room. He was readmitted to a different floor.
malpractice lawyer? wondering if anyone knows of a lawyer in canada that would be good to talk to about a medical malpractice case. i had a bad experience a few years ago and would like it to be validated. my intestines were perferated and leaking for days and did a bunch of damage along with destroying all my reproductive organs which were perfectly healthy. three doctors in a row claimed i was suffering from an std, the humiliation and grief that caused alone was tremendous, i have never had an std. they all just look at the previous diagnosis and ignore the pain, treating my like some cheap tramp that deserves the pain. i have asked for advice from a couple different lawyers and nobody seems to want to deal with it. is that the way it is in canada? it's not fair, i'll never be the same. there should be some kind of compensation for thier ignorance. not just dumb excuses that at my age these things aren't common so they had no reason to think that my symptoms and cries for help were valid. I feel since they took blood, pap, and pee tests they could've seen it wasn't an std. i'm not a doctor but there must have been signs of a serious infection in my blood, they never mentioned any of the results, they didn't investigate the situation individually, they just looked at the past report and agreed with thier co-worker. in the province i live in they had all these cut backs and lack of beds, closed down entire floors and hospitals, if they had room they would've been able to make some time for me. it's not i suppose the doctors faults for that, thats why every good one leaves the country. thier wage is controlled(specialists are only aloud to work a few days of the month). takes months to get anything done, the waiting lists are long, you can't get a family doctor. they shut down all the psyciatric hospitals and the patients all live on the streets. why should the people have to suffer and die to save money for who? i paid $130.00 p/m for just myself for medical, it stinks!
