Would a medical malpractice lawsuit be procedural law? I am confused on the difference between substantive and procedural law - I know that substantive is what gives rights/responsibilities and procedural is how a case is handled. But which would a medical malpractice lawsuit be?
What should we do to reform medical malpractice law? One of the issues with our healthcare pertains to medical malpractice. Hospitals are being sued millions and even tens of millions of dollars in some cases, and consequently the malpractice insurance companies are forced to increase premiums for physicians, which is contributing to the overall increase in the cost of healthcare for patients. Barack Obama states that something should be done, but he does not support caps on medical malpractice awards. If not set caps on awards, can we at least set caps on lawyer compensations? When a doctor is sued for $3 million, the patient nowadays doesn't even get to keep half of that because the lawyer takes millions. If we limit what lawyers can take, we could probably lower $3 million to $1.5 million yet the patient is awarded just the same. Any other thoughts?

Law School Program for Medical Malpractice? I'm applying to law schools, but I'm not sure which program is for medical malpractice. I thought concentrating in Health Law will eventually lead to practicing medical malpractice, but not quite sure. Can anyone help me out? Thanks
do i have a medical malpractice law suite? I had my baby april 13 of this year in Richmond va, she was 4 days late. i went in for a check up and my pressure was up so i went to labor&delivery and they induced me that day. i received cervadil tape that evening and pitocin early the next morning. my water broke in between these procedures. as they increased my pitocine the contractions became unbearable and i asked for an epidural. a few hours after receiving that i felt cold and was shivering, but my family and the nurses were saying i was burning up. they monitored my temp and around 3:30 scheduled for me to have a c section. i had the baby and we both had to have antibiotics from an infection. i stayed in the hospital for 4days and came hme ready to be a mom. fast forward a week. i went to have the staples removed and came home in soooo much pain and bleeding heavy from the incision. i went back to the doctor and she packed what i thought was a small opening. i went home thinking i would just have to have it packed but it was much worse. Hospital stay number 2: i was in so much pain i could barley pick the baby up. my stomach was so big with red whelps and hard to the touch, my doctor saw all of this when i went in to have it packed and she sent me home and told me to take motrin and ib proprin which did nothing!!! my sister came in my room later that night and i was at my wits end, i was trying to tough it out but i was in serious pain! it must have been written all over my face because she kept asking if i was ok and i said yea knowing it wasn't. she came over to me and gave me a hug and she gasped. "u r burning up, call an ambulance" but i felt soo cold. i had a temp of 104 and in the ambulance it was 106. i got to the hospital and theytold me i did have an infection. long long story short, i had to have surgury again to have infected tissue removed. right after this surgury i was left inthe bed for 22 hours laying in blood and drudged up. i complained to the nurse manager and she claimed she would look into it. i stayed ther for a week having panic attacks,breakdowns and being seen by cancer and infectious disease specialists.i had home care and was at the doctor 2 or more times a week after this incident. im just now back to my old self and my baby is almost four months. Something went wrong during my c section that caused this infection and i feel like the doctor that removed my staples should have assessed my wound better and had me tested for infection, i was so obvious!!!!!! even being left in the bed for 22 hours,why!?!?!?!?!? i want to call a lawyer i just thought i would get public opinion first

I have a beautiful healthy baby but can't move past everything....I know i'm being vague but any referrals or assistance you can give would be great. Also if anyone knows if there are any online groups or boards w/other people seeking action against their Ob or MD i would love to speak to others. Part of the problem is the serious emotional distress that accompanied this whole mess-i'm actually ashamed to say i thought most people claiming this weren't being honest-but now see malpractice in a whole new light. I guess because our society is so "lawsuit" happy I had trouble allowing myself to truly believe that I was not treated correctly. Thanks so much.
medical negligence/malpractice law case? About a year ago my sister had that surgery for hyperdydrosis where they cut into you chest and snip something to make you not sweat. She used to sweat from the neck and above. Now, she claims that she sweats from the neck down. She is all pissed off saying the dr. who did the surgery neglected to tell her that she could sweat somewhere else. I told her I'm sure somewhere in her medical records or consent forms it should have stated what the possible side effects might be. Since she claims the dr. didn't tell her, she wants to sue for medical negligence. Suppose the dr. really didn't tell her about sweating other places, does she have a case? I told her I don't think any lawyer will take her case. Am I right? That's what I thought. She said she wasn't going to sue to monetary value, but it was the principle. I told her a lawyer is in business to make money and I don't think she'll find one that will work on a contingency basis especially when the surgery did what it was supposed to do. Thanks Rebecca. I think you hit the nail on the head! Dr's nowadays cover their ass. I'm sure he went over the side effects. From what I've read about the surgery itself, compensation sweating is very common.

Is there a school in Utah that offers a joint nursing/law degree? I'm planning to start my nursing undergrad at Westminster having the Army pay for it (ROTC) then applying for law school however if there is a joint nursing/law degree I would be more interested. I plan on going into medical malpractice law. I have an associates in General Studies.
Medical Law and possible malpractice? My wife and I recently had a baby. My wife had a condition which caused her pregnancy to be more painful than the typical person. Knowing this she requested an epidural. She was in labor for 18 hours and could feel each and every contraction after the epidural was given to her. Because she was feeling every contraction very strongly several anesthesiologists had to come visit her throughout this time and administer much more powerful medications. At hour 16 of 18 they found out that the pump that was delivering my wifes medication was broken and she did not get any of the epidural throughout the day. We just got the bill and they charged us for the full epidural and for all of the extra doctor visits and stronger medications. These visits/medications would not have been necessary had the pump worked. I called the company that billed us and they told us to mail a letter to the person in charge. I did and they never contacted me. We don't want to sue, but we don't want to pay full price for the botched epidural. Do we have any legal recourse? If so, what law would it fall under? Law School v. Medical School? So I just graduated from a competitive high school recently and I am waiting to begin my freshman year of college. Since the beginning of high school, I've been pretty set on becoming a lawyer. However, I've been receiving a lot of negative feedback about pursuing a career in law since job opportunities are running out quickly and there is a likelihood that I will not have a stable job seven or so years from now after earning a JD. Moreover, my parents have been pushing me towards a career in the medical field ever since I was little and they are still insistent that I do. I'll agree that it is the safer choice, but I'm still not certain yet. If anyone can offer any advice about what I should do with my life, it would be greatly appreciated. Also, if you have any information about medical malpractice law, that would be wonderful too. Thanks! I graduated valedictorian with a 4.23 GPA. I have taken twelve AP courses in total and scored a 4 or 5 on seven of the exams so far (results of the other five to come later). I am capable and have no fear of undertaking the challenges of either field. I kindly ask that everyone omit the advice "do what you love" or anything similar out of any answer. Trust me, that will not help me.
Medical malpractice: do we need laws putting caps on lawsuits? In my opinion, the only time malpractice suits should be for anything more than actual damages is when they stem from gross negligence or incompetence. A doctor sews a surgical instrument up in a patient, his a** is twisting in the wind. Medicine is not a perfect science. Patients respond differently to the same treatments; doctors don't always have all of the relevant information; decisions sometimes have to be made quickly without the aid of all possible diagnostic tests. Plus it is often difficult or impossible to know who will have what side effects.
Whats the best way to get Due Process & Equal Protection of the Law, on a Medical Malpractice Cover up in FL.? This Case stems from a Tube of similic Milk being put in the LUNGS of a 3 month old child by a nurse on 10/98. The Hospital deny this accident. in 9/00 a automatic extension was filed & on 1/01 a Notice of Intent was filed, which starts the process, a rejection letter was recieved and in 8/01 the Complaint was filed. and dismissed due to statute of limitation rule. but, if calculated properly, this is a timely complaint filed. The District & Supreme Court dismissed the case, now is there a Constitutional Issue of due process please advise me on what should be done at this stage.
Medical malpractice?... Please Help! Anyones suggestions even if you have no law or medical background? Ok, i had implanon (a form of birth control that is inserted in your arm for up to 3 years) inserted in sept 08' after having my daughter. I went to have it removed just over a week ago and discovered it was not there. We had in office surgery and 2 sonograms. I contacted the doctor who "supposedly" inserted it and he said it could have fallen out of the needle before insertion. When he inserted it, he told me he could feel it and i would be protected, same with the followup exam a week later. Is this a case... Him saying i had birth control when he clearly DID NOT do his job (if you couldnt feel it in the beginning you were supposed to do a sonogram right away... If it was not there, put one in place then)? HELP ME! I did fall pregnant a year later, took a hpt with 3 positives, and had miscarried a few weeks later (i believe.. I did not have insurance to go to the doc).
How much does a medical malpractice attorney in CA make on average? I know I want to go to law school after I get my bachelor's, but I'm still undecided as to what branch of law I'm going to study. Right about now, I've got it narrowed down to corporate attorney, prosecuting attorney, and medical malpractice attorney. So I'm curious as to what they make, even if it's just an average or frame.

statute of limitations on a past medical bill? I had surgery 22 years ago which resulted in a medical malpractice law suit. Unfortunately I did not win the case but one of the doctors involved is trying to garnish my pay now. It is from 22 years ago. Can this be done? There was a judgement against me at one time which I never received notice of. Is there anything I can do to fight this garnishment? I am in New Jersey, Please advise if you have any info. Thank you
I think my mother in law should file a medical malpractice suit.? I will try to stick to the facts that I know.About 5 years ago they seen some scarring on her liver, and did nothing about it.She was diagnosed with hep c around the same time.She was put on interferon, she was on this for 3 years.She was in her doctors office one day and heard the assistant yelling at the doctor saying she can't be on this medicine any longer and he has to do something different.Within 5 minutes of her hearing that, the doctor came in and said she was in remisiion and did not need any more interferon shots, this was about 2 years ago.She has had problems since, pitting edema, swollen spleen, swolen liver..etc. Last year she had memory loss and confusion from the ammonia build up in the liver, she was put on medication to flush it out.In the last few weeks she was diagnosed with water in her belly and again the confusion was setting in,she was sent to the hospital, the hospital kept her for 5 days and sent her home saying she was just fat, she gained 30 lbs in a month and can not fit into her shoes.She can't even eat because of the swollen spleen, how can this be normal weight gain? Since she was released her liver doctor called her and told her she was never in remission and now has cirrohsis stage 4.Besides trying to get her well, which from what I read is not going to happen, is there any chance of a lawsuit here? She has never gotten a straight answer out of any of her doctors as to what is going on. I am not sure about the tort reform for NYC, but I can tell you that $300,000 will be plenty for her. I am doubtful of anything coming of this, I am just trying to seek out some options for her and some sort of compensation. She has been thru so much, and my 6 year old daughter loves her to no end, that alone will make me go to the end of the earth and back for her.I want her better first off, if there is a compensation for her, then that is a big plus.Thank you. By the way,CHF was ruled out by her heart doctor.She is seeing a new liver doctor now.
What are the beginning steps for creating a Medical Malpractice lawsuit? Never again will I choose medical issues to write about, it's quite difficult, which is why I keep referring for help here. What should i major in to get into law school? I want to go to College of Mount St. Joseph in Ohio, Indiana University or Purdue University. I want to know what I should major in for these places to get into law school. I have researched and found it isn't good to major in pre-law. Is this true? Do colleges not like that? Should I major in philosophy and minor in business? What classes should I take? Should I double major? Please give examples of what I should do for each place. Is there a statute of limitations on medical malpractice? We're in Oregon, and my mother-in-law just found out that the back surgery that she had over 15 years ago was done on the wrong side. All these years she has said that it didn't even feel like they fixed anything (pinched nerve) and recently had an mri done, and they told her that the surgery was done on the left, when it was supposed to have been done on the right. Is there anything she can do about this?

Who is the worst plastic surgeon in the Philippines? I'll give you a hint: Edwin Magallona. Do not trust this man. He is absolutely incompetent and totally f*ed up my face. I used to be sort of pretty. Now I look like a hag. His website is full of lies. He needs to have his license revoked. And in case you didn't know, the Philippines has no medical malpractice law, so these kinds of butchers can get away with every horrible thing they do to naive people like me.
medical malpractice law? I needed all teeth extraction and full dentures. I got half my teeth extracted from another dentist then the other that were left (10 in the front) were extracted by my main dentist. However, he extracted ALL 10 at once. Is this allowed? My body temperature increased and I got a headache. He put the immediate dentures in right away. Not only that but he never told me that my insurance can only pay for the top dentures so he told them that he only extracted my top teeth and that he only made an upper denture. I found out that when the next annual cycle comes in (when I get another 1000 to use for dental work) he will use all of that up by telling them he did the lower denture and lower tooth extraction. If I tell my insurance what he is doing he is just going to send me the bill because everyone signs a form before all of these procedures are done. Not only THIS but the dentures are horrible and do not fit and he does NOT want to make any adjustments because the insurance does not pay well. I look ape-like with the dentures in my mouth and can only wear the upper denture. I haven't eaten properly in 12 months and have lost a total of 35 lbs. I can't go to a new dentist because he took all the money from the insurance plus whatever is coming is within the next annual cycle. If I get my own dentures I would have to pay out of my pocket. What are my options?

Lisa performed unprotected resuscitation on an inmate who has hepatitis C n being tested for HIV be4. So Lisa gave her blood sample to the lab testing for HIV. The lab showed she is HIV-positive. N after that, the lab reported the result to the inmate's prison business office n Lisa's company office chief of health service as speciful request by a staff there. after three weeks, more tests are performed n found that lisa is HIV-negative actually. So Lisa suited the lab for breach of confidentiality n caused her suffering from emotional depression. I means to ask is that what can be the possible questions i can ask my professor or what can be the charges against the department. 1. If the doctor can foresee the HIV(or other infectious disease) harm to other staff in prison, he discloses the report to the prison office(unauthorized in law to have patient confidentiality) due to his conscious. Is the doctor illegal? 2. Lisa's husband sues the laboratory's breach of confidentiality of his wife and he is suffered from mental depression as well. Can he win the claim even he is not related to the case direcetly? 3. In this case, the laboratory is sued. But what if one of the technician in lab intentionally with foresight to disclose patient's data, can the technician be sued directly instead of the whole laboratory? 4. Can lisa sue the lab because of lab giving wrong result of a critical test although some may say error is inevitable? 5. If a lab reports critical lab result to an authorized party, the patient is suffered by disclosure but she cant claim for any as its legal. But after that, the lab finds that they make mistake to the result, so can the patient sue the lab now?

I was born in 1958 and exposed to a drug which originally marketed under the the name Thalidamide,but was administered in this country as Kevadon.It caused me to be born with a birth defect to my hands.I was told that there is a law firm that has a list of the doctors who prescibed the medication to women who were experiencing morning sickness while pregnant.Unfortunately for me the hospital I was born in (Provident-Baltimore City)destroyed all records.Although I'm now 49 yrs old I'm still experiencing problems.There also seems to be the matter of the statue of limitations.But I wouldn't have known about the drug Kevadon if it were not for my research into the drug Thalimide which was not suppose to be marketed in this country.I have no medical insurance to help me seek the medical attention I need with the current problems I'm having with my right hand.Do I have any way to compensated?Please if there's anyone who can help me let me know.
Help with medical malpractice question? My mother in law got butchered by a doctor (series of GI sugeries) Another doctor told her that the sugeries were unessary and did much harm. She got an attorny but the second doctor wont talk to the lawyer so the case is going to fall apart. What can be done to make him talk....legally?

Before the states go bankrupt due to mandates of the upcoming Medical Health Care Bill, do you think some states would rather cede from the union? For instance, in the first few months after Texas reformed medical malpractice tort law they were able to save 2 billion dollars which went back into updating hospitals. Why would they put up with being strapped with this monstrosity when they are reforming their health care on their own?
Is there a way that you can find out how many vehicles a person owns.? I live in Michigan & I'm getting ready to take my ex-husband to court after 6 years of not having to pay ANY child support. We've gone before & he has always claimed to he's not working & can't affort to pay child support.The judge always take pitty on him & I get screwed over. He is on disability & get at least $1,700 a month for the, plus he gets money from the V.A from when he was in the Army & he suffered an injury. But it's not like he has any bills, I know that in 2005 he won this HUGE medical malpractice law suit. With the money he bought a farm with 20 acres & another 10 across the road from there. He has farm equipment. bulldozers, backhoes, semi truck, trailers, & much more. He pays cash for everything, I just need to prove it to the judge so that when we go to court it's not my word agianst his. Personally I don't care what he has or owns but after 6 years I'd really like him to have to do something for our kids. I'm not being one of those mother who with hold vists ~ as a matter of fact they are with HIS MOTHER until the 10th of this month. He has decided not to do ANYTHING for our children. No birthdays not Christmas' no visits. I'm not the bad parent here. I don't think he is either he just doesn't have his priorities in order. I never said we are having money problems ~ I'm just fed up with getting stuck holding to bad so to say. He fathered my 3 children & should have to DO SOMETHING for them. Maybe if he has to pay $50 or so a week that will remind him that he has 3 kids.
This is a question for Aussies. I want to go to Law school either next year or the year after. Now I want to? if I could do that course to become a lawyer part time? Becasue I also want to work part time as well and earn a bit of money on the side. I have not done year 12 when I was at school. I am 38 years old and if I do this degree I will be about 43-44 when I graduate, and start working and retire at 65. That would be about 20 years in the profession. I have not decided on what field I will specialise in yet. But which uni is the best to study the above? How long will it take me to study part time? And full time I hear about 3-5 years. Should i go to law school and go after vets fro medical malpratice? my cat was killed without my permission? my cat died of heart failure, and the vet ttech said she was going to kill him when i tolde her NOT TO. I told her I was taking my cat to another hospital and his heart stopped. I have been very depressed can't eat, cry everyday, and dont want to wake up to living night mare. i oversleep because waking up hurts. Possible Medical Malpractice? First off, for all the ppl that are gonna say im just looking to get money.... i want to say im not that big of a loser. My question.... When i was in the seventh grade, the school i went to had Nurses from the town health department come to check students for Scoliosis. That is when I found out I had the curve in my spine. My mother took me to our family doctor, and he sent me to have xrays took. After about an hour, i was called back into the doctors office. He told me and my mom that i did have scoliosis but it was not severe, It was a 7 degree curve. Until it reached a 15 degree curve there was nothing he could do but watch it to make sure it didn't get worse. So, a few years later, when i was seventeen i was experincing pain, so i went back to my doctor and had another xray. After he looked at them he told me that it had not changed... and pretty much told me that i was going to have to just live with it because itwasn'tt bad. (made me feel like i was a wimp that justcouldn'tt take pain) Everysensee then ive suffering with a almost constant pain, i can sneeze, or just bend over and my back will pop! I am 25 now and ive had 2 children just recently in may of this year. I was researching on the internet about scoliosis, when i came across a doctor that was studying women after childbirth, having their scoliosis getting worse.... so i decided that maybe mine had gotten worse. The family doctor i had went to before had retired, so i had to find me another one, my mother had recomended her doctor so i made me an appointment. I took my xrays from when i was 17, (which i had gotten when i was pregnant with my daughter in 2005, to show my OBGYN to make sure she could pass through my hips.... she was a big baby and im 5'2) When i showed my new doctor my xrays, and told him about what i had been going through...(tingling fingertips, stiffness, and pain) he ordered me to have xrays done to see if it had gotten worse. He gave me some anti inflamitory pills and had me make a appointment the next week. When i went back he told me that the new xrays and the xrays from when i was seventeen had been compaired, and that there had been very little change. I then asked him what was the degree, he told me it was a 22.5 degree curve. So that ment that it was well over 15 degrees when i was seventeen, and maybe my old family doctor could have done something to have prevented 8 years of pain. Im not wanting to ruin anyone, or cause a big deal... but i dont think its right. He should have atlease sent me to a scoliosis doctor, if he didnt know how to treat it. the doctor also got in trouble in 2004 for giving anyone that came in wanting pain pills, he would give them anything they wanted. i found this on website talking about the laws of medical malpratice............ I want to know if my mom has grounds for a law suit? I need to describe some of the health problems my mother has before I ask my question. First she is a diabetic, suffers from high blood pressure, high cholesterol and many more health problems. She suffers from depression and severe anxiety as well. Last year she was diagnosed with COPD and Congestive Heart Failure (the right side isn't working at all) She was actually given less than 60 days to live by her doctor. Thankfully shes still with us, she was placed on 2-3liters of oxygen 24/7.She recently went into a sleep clinic to be monitored over night. The nurse removed her oxygen and left it off all night. The next morning when I picked her up I asked her if she had her portable oxygen and the nurse said to make sure she had it because the blood work shows she needs it. Well duh, we already knew that so why did she leave the oxygen off her all night even when my mom felt like she needed it. My mom remembers the nurse as being someone that confronted her in the grocery store over some personal issues. Basically the nurse doesent like my mom. Do we have a law suit,medical malpractice or patient endangerment or anything of that sort. I want to say NO we are not sue happy and we have never sued anyone. I just don't think the nurse should be taking it upon herself to go against the orders of not only a cardiologist but the pulmonary doctor's as well. Thanks
Medical Malpractice Arbitration Plaintiff Consolidation? Myself and 2 sisters have filed a demand for arbitration and listed each of us as plaintiffs. The malpractice concerns the death of our Mom. The large HMO hospital in Southern California has a large law firm representing their interests as respondents. The law firm sent each of us 5 documents with questions and production of documents (5 docs times 3 sisters = 15 replies). I want to know if there is a motion or procedure I could use to consolidate our Arbitration so that the 3 of us will be considered 1 plaintiff. The law firm has requested copies of all documents, records, notes, etc... to each of us individually, but there is no way that we should be required to copy and submit 3 copies of the same information regarding the treatment of our Mom. How can I get the Respondent and/or arbitrator to group the 3 of us as 1 plaintiff?

What would constitute medical malpractice and negligence? First and foremost I want to thank you all for your time and advice. The reason I'm posting on here, it's because I'm running out of option's. I've talked to slime ball lawyers that simply put don't want to get off their lazy butts and do work and assure me my father can't win. Our situation starts of with a Doctor on August 27th. My dad is 51 years and had been complain of prostate problem and rectal pain with some tenderness and swelling. He goes to the doctor, and the doctor doesn't spend more than 5 minutes but orders some blood work and tells him to come back the following day. My dad goes back the next day. He tells the doctor that the pain is even more sever and that the swelling is worse if he could please check his prostate. The doctor told him not to worry because he did have an infection and prescribed keflex 500 QID and Tylenol 1 or 2 PRN. and follow up in two weeks. Well buy labor day, my father was in so much pain, he was walking bowed, this is a man that migrated from Mexico and has worked in agricultre since he was 12 and he was begging with tears in his eyes to take him to an urgent care. In the Urgent Care the doctor took a quick rectal examination saw what the first doctor had prescribed, told us that the medication was worthless and sent him to the ER. Once in the ER a surgeon was called, and surgery was done to remove and drain two abscess the size of fist in rectum that where spreading to his glutes. The doctor said everything was fine and he would be back home in 3 days. Everything was fine for two night's, his care was impecable. The family was tired so he told us he would be fine alone. When we came back 16 hours later a stentch came from his room like rotting fletch and you can tell that he was sick again. He was complaing of severe pain that morphine was helping, when the nurse came to check on the dressing we where all suprised to find out that one of the nurses had just been putting new dressing over the old one. I don't know if there is a link but they rushed him into surgery to remove some more of the infection. Today we got the suprise of our life that the doctor has decided to major surgery and remove some of colon that is infected and preform a colonostomy and he will carry a clonostomy bag for six weeks. If the infection doesnt get him first. I don't know anything about law, I'm just starting getting my feet wet trying to get into the medical field now I'm questiong that. Something or somebody did something wrong what do I do to find out and get him justice. I'm in central California any refferals would be greaty appreciated......God Bless
Is this a medical malpractice suit?????? My father-in-law had a triple bi-pass surgery a few days ago. An x-ray revealed that a sponge had been left inside his chest. The doctor who made this horrendous mistake admitted to doing so. My father-in-law had to have his chest openend up again to have the sponge removed. So far he is doing ok, however this is unacceptable medical practice in my opinion. Would this be grounds for a lawsuit? I spoke to a paralegal who said that it is NOT because the dr. admitted that he did it. We definitley want to pursue legal action. Where do we stand with such a case??

Medical malpractice- Should I file lawsuit? In 2005 I had surgery to fuse my vertebrae in my neck. It didn't "take", and I had to have a second one to attempt fusion again. This time through the back of my neck.It turns out that when the surgeon did the first one he misplaced one of the screws. I have to take morphine for the pain. The worst part about it is that when he went back in, he didn't repair the first mess-up even though it was obvious on the cat-scan I had prior to the surgery, which is what caused the first fusion to fail. Now I have to have a third operation to repair his obvious error, and it will happen next year. I plan to have a different doctor do it, for obvious reasons. I will most likely have this pain for the rest of my life. I am totally disabled now. I was hurt at work too. Would you file suit? Will I have to pay Worker's comp back? If so, do you think that's fair? Wouldn't you? One last question: Do you think that I'd win my case if I file? Maybe law students could debate this subject.
Do I have a malpractice law suit? My husband was not dx'd with high blood pressure and he died.? He died from a heart attack which was from the high blood pressure. He was 49. He went to the GP in 1986 initially for it because of a medical screening at work which showed it was in the high range. In the GP was in the 138/75. They suggested no further up; he went a few more times for an eye problem until, 2003. They had only taken his BP once again. It was 158/95. Again, no suggest further up. I am having a problem with a lawyer in taking this. I live in PA, there is a 2 year statue of limitations, but what about a " discovery " date? I only recently discovered this happened, even though I asked for the medical records after he died, it had taken them 6 months to send me them, and I was at the time treating lymphoma. Can you sue for wrongful death/medical malpractice of an unborn child that wasin the mothers womb for 9months? So heres the story, my sister in law was due for a scheduled C-Section this past Tuesday the 3rd of June. She wound up going to the hosp on Monday morning because she didnt feel the baby move since Sunday. She gets to the hospital and the doctor tells her there is no hope the baby is gone. This was 12noon monday, the doctor didnt arrive to remove the baby from her until 8:00 that night. The messed up thing is the baby died because she didnt have enough fluid and the cord was wrapped around her neck. My sister in law went to the doc 2 weeks ago saying she felt like her water broke and there was blood, they checked her and told her shes ok to go home. But they did NOT give her a sonogram. And she was NOT scheduled to come to doctors appointments the last month of her pregnancy. Her last appointment was May8, they scheduled her for her C-section on June2 and said bye see you then.The hospital/doctor had no remorse, they were even laughing during the c section.Do you think this is case?

How can lawyers charge what they want, but make laws about medical costs and milk costs?? Lawyers are making laws about how much people can charge for services. They make laws about malpractice and medical insurance, yet it seems they can charge $350.00/ hour without having to be accountable to anyone, and the Bar Association makes it harder to pass in some states to avoid competition. Does this seem ethical? Most representatives that make the laws went to law school and have a law degree. What I meant is that those people with law degrees making the laws are not regulating how lawyers can treat their clients, but are regulating how doctors treat their patients. Someone should be regulating the quality of services that lawyers provide just as a doctor's practice is regulated for the quality of medicine--if a doctor misses something, he can be sued. It should be same with lawyers not doing a good job.
Anyone know anything about medical laws or regulations regarding Episiotomy? I just gave birth to my daughter on the 11th of this month and I had what my doctor called a star cut and episiotomy which he used only his hands/fingers to rip me open during the process according to my husband, I wasnt paying attention at the time considering. Is that legal to use your fingers to tear a woman open for labor or is it procedure to have to use scissors? I have been hiding from my ex-husband (stalker) for 13 years, when I took my son to the dentist a few months back someone who works there recognized the name (i guess??) and gave him my phone number, told him what kind of car I drive, and told him that I am disabled. I know the privacy act and HIPAA are on my side to protect my info...and the dentist was so rude and mean about the whole thing...I am wanting to sue her (blippin' bleep)...lol...but I cant figure out who knows the hipaa laws, it isn't medical malpractice, so if you know please help me out...thanks so much for taking the time to help me. shell

Her name is Margie this is a #2 wife after he lost his first wife she died after giving birth to her twins it was medical malpractice and it was wrong and very hard for my brother then he met this nasty person after 3yrs. went by and he sued the hospital and the doctor for their incompetence.
If health care costs are an issue, why do dems support trial lawyers & frivolous law suits? An obvious solution to the problem is capping the jury awards on negligence and personal injury lawsuits by tort reform. Medical providers pass on a huge expense to the consumer for malpractice insurance and run many needless medical procedures all because of greedy and unethical trial lawyers, who prey on the medical community. Michael Moore did a biased documentary on health care costs but instead of targeting the true villians- trial lawyers, he simply carried the socialist flag and attacked corporations (the mortal enemy of socialists). Did you know the USA is the only large country in the world that does not apply the English rule of law, where the losing party pays the winning party. Only in America, someone can file a frivolous law suit, hiring a trial lawyer on contingency (the parasite takes 30% - 40%) causing the defendant to spend unlimited funds to defend themself & if the palintiff loses, he doesn't reimburse the defendant for the costs they incurred. Huh?
This is a question for Aussies. I want to go to Law school either next year or the year after. Now I want to? if I could do that course to become a lawyer part time? Becasue I also want to work part time as well and earn a bit of money on the side. I have not done year 12 when I was at school. I am 38 years old and if I do this degree I will be about 43-44 when I graduate, and start working and retire at 65. That would be about 20 years in the profession. What Universities in Melbourne is the best one to study either corperate Law, Medical Malpractice, Aviation Law, employment Law or immergration Law. I have not decided on what field I will specialise in yet. But which uni is the best to study the above? How long will it take me to study part time? And full time I hear about 3-5 years. Is there a way that you can find out how many vehicles a person owns.? I'm getting ready to take my ex-husband to court after 6 years of not having to pay ANY child support. We've gone before & he has always claimed to he's not working & can't affort to pay child support.The judge always take pitty on him & I get screwed over. He is on disability & get at least $1,700 a month for the, plus he gets money from the V.A from when he was in the Army & he suffered an injury. But it's not like he has any bills, I know that in 2005 he won this HUGE medical malpractice law suit. With the money he bought a farm with 20 acres & another 10 across the road from there. He has farm equipment. bulldozers, backhoes, semi truck, trailers, & much more. He pays cash for everything, I just need to prove it to the judge so that when we go to court it's not my word agianst his. Personally I don't care what he has or owns but after 6 years I'd really like him to have to do something for our kids. I know that laws differ from one state to another so I just wanted to add that I live in Michigan.

medical/healthcare lawsuits? what kind of medical lawsuits do you find interesting? i have to do a paper on a medical case of some kind, but i dont really know where to start! because i find law boring, i want to work on a case thats interesting! are there any cases you know of or topics you could suggest that you are interested in? it could be malpractice cases, personal lawsuites against health care industries, ect. for example i have a classmate that is doing her paper on a case about the misdiagnosis of ADHD in children. thanks for any suggestions!
