I woke up to face sheriff deputies at my bedside, who shackled me and carried me away in a blacked-out vehicle that looked like something for stray dogs. As I was taken away, no one would answer my questions, call my family or my doctors. I was treated like a non-person. I was on a mental ward for a hellish, mandatory, minimum stay of three days, after which time I was suddenly released , the doctors having determined there was nothing wrong with me, but not before subjecting me to some awful drugs that made me FEEL crazy and rendered me unable to move or call out for over twelve hours overnight in a locked room. My physical symptoms, which turned out to be a bad reaction to an OTC drug I'd taken, resolved on their own while I was in the place. Right now, I am going back and forth between feeling numb and being livid. I requested my records from the ER and went to the magistrate's office to get a copy of the commitment papers. I was stunned to learn that a doctor had signed it saying I had a plan to commit suicide by overdose! No such thing was ever said by me to a single person, and the doctor whose name was on the document was someone who never even saw or spoke to me! To clarify: I hadn't overdosed at all, and they DID know the medication I'd taken in low dose for three days. It just didn't agree with me, made me dizzy and screwed with my coordination. Symptoms began to resolve as soon as I missed two doses. The entire time in the ER I was coherent, calm, and able to describe the symptoms I was having, which were not even severe, just scaring me to death. At a shift change, the new attending came into my room, introduced herself, asked me about my symptoms, and got a puzzled look on her face when I answered. She asked, "Have you thought about or attempted suicide?" I was in shock. I told her, "NO!!! Absolutely not! Not EVER!!!" She then said, "Okay, there's been a mistake. I'll be back. Only she never came back. In the records I got from the ER, her name appears nowhere, and she made not a single note. But is it HER name that's on the commitment request, where she wrote: "Patient has clumsiness with plan to overdose."?! Only the clumsiness was fact.

How long do I have to file a lawsuit for medical malpractice? In August of 95 (12 yrs ago), after more than 4 yrs of being misdiagnosed, docs rushed me into surgery to remove my appendix when I was only 6 years old.Since I was an infant my parents had taken me to numerous doctors being I had chronic UTI's and vomiting. They would claim it was gas or accuse my parents of abuse. Nobody ever did an ultrasound. When they finally went in to remove my appendix due to "appendicitis" they found a black, walnut size kidney and realized they had made a mistake. They stitched me up and told my parents to come back a few weeks later to have the dead kidney taken out. Along with the kidney they took out as much of the ureter tube as possible but left about 1/4 of it. Over the last few years I have been getting reoccuring infections and UTI's yet again. Yesterday I went to a urologist because I had intense back pain and he determined that because they left part of my ureter tube it became a sac of infection that now requires further surgery. Can I still sue?

My roomate has had at least six root canals, six crowns and twice in one year had the same tooth infected resulting in a trip to the hospital. Today she went to the same dentist she has always gone to because she felt like the infected tooth she had replaced with a crown had some discomfort and "tasted gross". Anyway the dentist told her that it was infected again and she would need a replacement crown because the old one allowed bacteria to harbor under the crown. Pregnancy/Delivery- medical malpractice lawsuit? Four years ago, at the age of 18, I gave birth to my son via Ceserean. Only after the doctors overseeing me had me attempt nearly 30 hours of labor and pushing. I had been diagnosed with pre-eclampsia- a pre-eclamptic woman should never deliver vaginally. A few days after my surgery, I was told I had fluid in my lungs, and had GREAT trouble breathing, however I wasn't given lasix to relieve the fluid. I was instead discharged, only to return to my doctor the next morning because my breathing and fluid retention had gotten so bad that I was coughing up blood stained sputum. I ended up being admitted and treated for congestive heart failure. My heart is still a little weak. And this condition may keep me from having more children- a great pain that hurts more than any of the rest. Since it has been 4 years, is it still late to sue for medical malpractice? This happened in Ohio. I had waited because I didn't think I had a case. and I was just grateful to be alive. -I had very high blood pressure when they induced me for labor. I should not have been pushing.

What if the spouse preceded the victim in death and the children are all well above the age 18? My cousin, Kevin, has a medical malpractice lawsuit filed. His problem is that he is trying to find a lawyer.? He tried two *contingency fee lawyers and all that the first one did was order his medical records, but that lawyer made him wait for 8 months before the lawyer said that he was going to have a doctor evaluate them. Afterward, that lawyer simply told him that he couldn't find a doctor to evaluate the records. The second lawyer filed the lawsuit for him, but that lawyer also said that he planned to have a doctor look at Kevin's medical records. That lawyer never did and later withdrew as his lawyer. Its a shame that Kevin had to get two lawyers that weren't serious about wanting to help him. They both cited his especially young age of 23 as being the reason that they chose to not really help him very much. Is there any advice that you can give Kevin, short or paying for an out of pocket fee lawyer? Kevin is now paralyzed from the rib cage downward and he had a stroke. *-Both of the lawyers that he tried to work with would have only made a profit if the case were won. We submitted a petition to the court over a month ago for the court to appoint a pro bono attorney. The petition was denied, even though the Court Administrator was the one who suggested that I submit it. The local Bar Association and every service that offers local legal aid charges $100 per hour or more. I'm sorry, but I really dislike to see my brother being confined to home hospital bed, while he's still in his 20's and without a competent publicly funded lawyer able to help him. Whenever someone murders another person, they are allowed to have the court appoint them with a lawyer if they can not afford one. What kind of justice system turns its back on medical negligence victims, while even murderers get a fair chance to have a publicly funded lawyer convince a jury that they should be found innocent? What kind of backwards world do we live in here? We're going to probably be forced to submit a form formally withdrawing the lawsuit, for lack of a lawyer.

Am I able to file a medical malpractice lawsuit? My left testicular is dead due to testicular torsion. It has affected my mood and completely screwed me up, and I'm very likely infertile. Here's the story; I have been to several doctors every since the age of 8 or so, because of an inflated testicle, not one of these doctors really ever diagnosed it, or treated it. Two of them said "it could be testicular torsion", but did not treat it, at all. Just gave me some pain killers and sent me back home, with my testicle twice the size it should be and in severe pain. I'm wondering if it's too late to file a lawsuit, the last time I went to a doctor about the (live) testicle was about 4 years ago, when it grew in size again (fifth time I believe), and he basically touched it and whatnot then said thing like "it could be this, it could be that", specifically stating that it could be testicular torsion. Well, my testicle has been dead for about 3 years now, give or take, but being a naive kid (I'm 18 by the way) I could have never imagined it could be the doctors fault. Court papers served for medical debt written off 2007? I have been served court papers to appear for a medical debt that is involved in a medical malpractice lawsuit. The paperwork behind the papers served state that the debt was "written off - uncollectable." These papers reflect that the original creditor (which is an ambulance service) issued the paperwork, not a collection agency. How can they try to garnish my check when they have written off the debt? This was not issued by a collection agency. It was not sold to a collection agency, it was the original creditor.

He ended up having a total knee replacement. In our small town, he was diagnosed as having low-grade sarcoma, meaning surgery would get the tumor. We then went to the nearest big city, where he was diagnosed by the surgeon as being mid-grade, meaning he would need chemo as well as surgery. The chemo gave him horrible side effects as well as made him permanently sterile. He almost died from the side effects because his throat swelled shut and he was SOOOOOO sick for 6 months. Turns out it was low-grade all along and removing the knee surgically got all the cancer. All that chemo was unnecessary. Does he have a malpractice lawsuit? What do you think of this ? (Medical Malpractice)? My sister went to her doctors visit when she was 10 wks pregnant. They could not find a heartbeat, She then was told to go home come back the following week so they could check again. She went, they said she had miscarried and and that the fetus had been dead for 6 wks they sent her home with ibuprofen to pass the fetus and to return again a week later, so she did. That day they did nothing but ask her questions and sent her on her way back home. Before she ever got into the driveway to her house she start hemorrhaging causing her to almost bleed to death. IS THIS A MEDICAL MALPRACTICE LAWSUIT? Ok im a 49yr old female and fell in 10/07 roughly around that period i was told that i needed arthoscopic surgery had that done. Had a Total Knee replacement in 7/08 went to rehab for two weeks still couldnt get knee straight and was in pain. Had Knee manipulation done as well as clear scar tissue 9/08 and just had another arthoscopic to clear scar tissue again. Now i am in extreme pain and kept going back to the doctors who performed the surgery there is hole in my leg from the last surgery and asked the doctor why and he said portal that is used for the arthoscopy healed over the portal. It is still bleeding in that area, 3 weeks after the last arthoscopic surgery. Kept going back to the doctors that did the first 4 surgerys and they said it looked better that i need to be aggressive with my Physical Therapy. In the past few day i have been in pain more than ever. Went to a new doctor for a second opinion and he said it is probably infected and there is a chance it might need to be amputated now i feel cheated and wondering is this i malpractice suit and if so how much? My old primary doctor essentially blew (for 4 years) off a very common tell-tale sign of something very wrong, which has now turned out to be cancer. Do I have a medical malpractice lawsuit? My boyfriend recently broke his leg which required surgery. He had no visible wounds and checked out fine after the surgery. When he went to the flow-up they said everything was great and changed the dressings and cast. However, for the following days after that he complained that the top of his foot hurt really bad and was going numb. He was able to get an appointment about 4 days later and when they removed the dressings there was a puncture wound about the size of a half dollar. Would healthcare prices in the US lower if people stopped suing for Medical Malpractice? It seems that in the US, healthcare is always an issue, especially the rising prices. However there are alot of Medical Malpractice suits where it seems that people are raking in millions, which I think would cause prices to go up, becuase someone has to pay for the lawsuits/insurance. In Canada I read it is very hard to prove, and I am sure in Cuba, or many other countries if a doctor messes up, then tough. If we made malpractice harder to prove, or limit the amount someone gets from settlement, or better yet take away a good portions of a Lawyers take, would that help curb healthcare prices?

Filing a lawsuit for medical malpractice? I want to file one on behalf of my mother's estate. I am 100% sure I have a case against them. The problem is money. I am forking over so much in probate that I am even coming out of pocket as executor to cover the estate so it makes it through the process. Estate money is tied up within the home. I have been searching for a lawyer. I got a response back from one but he charges a $100 consult fee. Now if I shop around at that price it could get pretty costly. I really don't want to resort to Ken Nugent so what can I do? I don't want to let these people get away with what they did but being in probate is difficult. I need to get things rolling though at least on one case because statute of limitations will become an issue soon. I think people should know that people like George Bush and the Republicans are trying to impose medical malpractice caps on lawsuits for pain and suffering of limits up to $250,000. This includes injuries involving death, blindness, paralysis, loss of a limb, and many other horrific injuries that could happen to any of us. These people defend this in the name of health care costs; meanwhile, there are many studies which show there is no correlation between med mal insurance and lawsuit caps. medical malpractice? My father is a diabetic. He has been on pills to control his diabetes for like 3 years. He has had the same diabetic doctor for the whole time. He has most of his toes cut off due to the diabetes. Yesterday, he almost went into a sugar coma when his sugar tested 394. He was given insulin to bring it down. I was told by the nurse, that he will have to take insulin for the rest of his life. She said he probably needed a long time ago. Medical malpractice- Should I file lawsuit? In 2005 I had surgery to fuse my vertebrae in my neck. It didn't "take", and I had to have a second one to attempt fusion again. This time through the back of my neck.It turns out that when the surgeon did the first one he misplaced one of the screws. I have to take morphine for the pain. The worst part about it is that when he went back in, he didn't repair the first mess-up even though it was obvious on the cat-scan I had prior to the surgery, which is what caused the first fusion to fail. Now I have to have a third operation to repair his obvious error, and it will happen next year. I plan to have a different doctor do it, for obvious reasons. I will most likely have this pain for the rest of my life. I am totally disabled now. I was hurt at work too. Would you file suit? Will I have to pay Worker's comp back? What qualifies as Medical Malpractice and should I look into filing a lawsuit? My mother fractured her skull on Jan7,08 and was in the hospital for over 2 months. She was unconscious most of that time and during got a blood infection from her pickline as well as from nurses not always using gloves. Also she still has a large bed sore on her bottom that was almost to the bone and is not healing well. I had to write a letter to the CEO of the hospital just to get the nurses to pay more attention to her. She was rarely turned and even sat in her own bowel movement for hours at a time when she was semiconscious, and had feces in her bed sore at times.
