Does any one know of any good medical law case sites? Im taking medical law and ethics and i would like to find some good sites for cases in the medical fields...if you know any that would be good. and they dont have to be in americas legal system either they can be from other countries.
Medical case scenario.. :) Law and Ethics? Mrs Jordan is a fifty-two-year old woman with Stevens-Johnson Syndrome, a rare disease that causes large, blister-like lesions to form on the skin and in mucous membranes. In fatal cases blisters form in the lungs and kidneys, causing pneumonia and kidney failure. Large, painful, weeping blisters cover her body, soaking her skin and bedding with bloody drainage.Three days ago she stopped breathing. She was coded, resuscitated, and placed on a ventilator. At the time of arrest her blood pressure regulatory mechanisms also stopped working. Doctors ordered intravenous dopamine to maintain a blood pressure high enough to circulate blood. Each day increasing levels of the drug have been needed to sustain an adequate blood pressure. How, before she went into the arrest, the patient has requested that she does not want to go on if she is such a state, has confirmed this with the family and they agree. Doctor says there is a 50/50 chance of life.. but he agrees to withdraw the dopamine becuase it is what the family wants. Nurse withdraw dopamine, rapidly the patient started to go downhill, 20 minutes later she died. What do u think about all this? Legally, ethically anything :)
Medical case scenario - Law and ethics -- Complex situation? There is this woman who was previously a heavy drug and alcohol user, her boyfriend left her for those reasons however soon after she foud out she was pregnant. She keeps the baby and tell the doctors and nurses that shes clean and has stopped everything. The nurse in order to keep her on track continues to educate her on the harm of these subtances on an unborn baby. When the baby is born, the doctor tells her her baby has fetal alcohol syndrome. HERE is he issue... The baby DOESNT really have this syndrome, it is a "strategie" that the doctor has used to "scare" her in order to give it up all together for ever. IT WORKED.. BUT the fault here is that the doctor is putting her through all this emotional trauma when there really isnt anything wrong with the baby. The nurse finds her crying and later finds out that the doctor is lying but the doctor tells her to keep quiet, that he will NOW tell the mother that the baby only has it mild.. Since Linda also had an ongoing commitment to working with Arlene, she realised that she was now in quite a difficult situation. While deception was generally to be avoided, there did seem to be something to be said for this strategy of the doctor’s. Again, lying might not help with attempts to deal with the issues underlying Arlene’s drinking; yet being truthful might make Arlene complacent – a real concern if there were to be later pregnancies. Suppose, after Linda had met with the doctor and learned of his strategy, but before she had made up her mind what to do about her basic problem, Arlene had confided to Linda that she had been drinking during the pregnancy, though not heavily. Suppose also that Arlene had indicated that the doctor’s diagnosis if foetal alcohol syndrome had really given her a jolt, and that she was now determined to try to limit her drinking. His supervisor, Nora Malone, has asked him to supervise the dining room while 20 residents eat their evening meal. Bill Heckler is an 80-year-old resident who is very alert. He tells Adam that he doesn’t like the meal that’s being served, and he wants to leave the dining room and go back to his own room. Adam is quite busy, since he has to watch the behavior of several patients who are confused. He’s concerned that patients might choke on their food or otherwise harm themselves. Adam becomes impatient with Bill and tells him that he cannot leave the room until everyone is finished eating. Adam then locks the dining room door. What are the beginning steps for creating a Medical Malpractice lawsuit? Never again will I choose medical issues to write about, it's quite difficult, which is why I keep referring for help here. I'm looking at how a lawsuit occurs, I mean, I know the patient is suing the doctor but what i'm asking is one, how to start off a paragraph to lightly explain how the lawsuit starts, and also what efforts go into the case; all the aspects, trial, etc. Thanks so much also, if anyone wants to add in their law/ethics view, it wouldn't be so bad :)

CASE STUDY: A Medical Office Manager (MOM) is setting up home health care services for a 78-year-old man who was recently diagnosed with diabetes. The home health care is needed to provide the man with education about his condition, as well as assess his self-care abilities. While discussing the services to be provided, the man informs the MOM that he only wants white people to come to his home. For example, physicians have long been discouraged from providing medical care for their own family members. Percival's Medical Ethics, published in 1803, argued for the separation of professional and personal identities in the care of family members. Today, the American Medical Association guidelines from the Council on Ethical and Judicial Affairs exhort physicians to refrain from treating themselves or immediate family, though it's not an outright prohibition. Is there a similar stance for law enforcement? In this case, the victim is immediate family of the detective. Although, would having a family member as a suspect alter an investigator's chances of working on a case? If this is sort of work is frowned upon, who along the chain of command would enforce the policy?

Can you correct my paper ? There is a long term debates about deadly sick person’s right to choose between the easy death and the life or, better to say, the rest of the life, full of the suffering from the agonizing pain. What would you choose ? I just finished reading of the essay “ A Crime of Compassion”, written by Barbara Huttmann. Her essay raises a moral issue about responsibility and respect for dying people, who are prefer to die peacefully instead of being revived to live a little bit longer and suffer from enormous scrutinizing pain. The doctors and the nurses have a compassion for the patients, but they also have to follow to the medical ethics and laws. This essay about the male nurse, who, out of the compassion, let a man sick with the cancer die because he knew that patient wanted it and asked multiple times to let him go. This is the moral issue that Barbara Huttmann wants to let us know about. From this essay it is clearly understandable that the medical people should have respect for the dying people and their free will, and in some special cases let them die. Deadly sick people, who has no chance for recovery, should have their right to die and their will should be “respected” by our society. As we all know all the doctors, before they start their medical career, give a Hypocrite's promise to do not take patient’s life away. In simple words they promise to keep the patients alive. I think this promise should have some additional changes. It should include:” I promise do not take patient’s life away no matter what and let this patient suffer longer from the agonizing pain at the end of his or her live”. I know it is sounds sarcastic, but this is true. Instead of releasing person from the pain, our society makes it even more painful for this person. According to essay, a man, who suffer from lung cancer, was resuscitated two-three time a day! There is a short paragraph in this essay that shows how this man was kept alive. “When Mac had wasted away to a sixty-pound skeleton kept alive by liquid food we poured down a tube, IV solutions we dripped into his veins, and oxygen we piped to a mask on his face, he begged us: “Mercy...for God’s sake, please just let me go.”
Religion without morality is a superstition? Doctors basically adhere to the ethics, customs and medical principles and lawyers are aware and devoted to law, its customs, ethics and principles. But, weirdly, why there are quite a lot religious officers (pegawai jabatan agama/ pegawai pencegah maksiat) out there who do not follow and obey religious guidelines or Islamic principles. History or Philosophy UnderGrad Major? Currently I'm a sophomore at Marquette, originally was in the sciences but have lost the passion I had for the subject. I've been very interested in both History and Philosophy since I was in high school and did very well in them. I'm not a terrific writer which deterred me from both majors. However I am considering going to Law School and would love to be a lawyer in ethic cases or even (due to my large background in the sciences, specifically health sciences) medical malpractice law fighting on the side of the hospital or doctor. I keep hearing both majors are good for law school and both of which I can take. Also, I have all the pre-med requirements except for Organic Chemistry. So I ask which do most law schools prefer and which would be more useful for when I want to go into teaching either at a law school (which would be pretty sweet) or even just at a university level (yeah i know you need more schooling for both which I am ok with since I plan on a continuous education throughout my life, so constant schooling or taking classes to stay with the times and to increase my academic knowledge.) Let me know your thoughts and if you feel I should even double major which would cost me another year in college but at this point I'd rather be well rounded and a good candidate for law school or grad school than to finish "on time" and only have a limited choice in options. Is Michael Jackson's doctor guilty in the eyes of the law? Drug abuse is rampant especially in celebrity groups. Michael Jackson is known or at least suspected to have been addicted to drugs. The doctor who was with him during his time of death gave him some medication which is alleged to be the cause of his death. His doctor is saying Michael begged him to give him at least one of those drugs. Medical experts appearing in the media are not in agreement as to whether those drugs caused his death especially given the minimal quantities given which would not kill a normal person. Moreso, Michael Jackson wanted those drugs. In light of the fact that Michael was an adult who may chose to or not to take certain drugs, should the doctor be found responsible?.The second question is " can doctors be held responsible in such cases where there is no overdose and where the results would be different if the same drugs were to be administered to a different person?. The third question is "isnt it simply a matter of professional ethics or simply work gone wrong as opposed to murder, just like a plumber, builder, mechanic or any other professional can make a mistake.

A question about Paralegal Ethics? My daughter has a discussion question that has us both kinda iffy on the answer. It is regarding if a paralegal broke the code of ethics when a person was injured. Any paralegals out there that can help us out? The firms paralegal, Jonah, is inside the local grocery store when a woman he knows slips on an unmarked puddle of water. Jonah rushes over to help the woman, who cannot stand and seems to have injured her leg. While waiting for the emergency medical team to arrive, the woman (who knows Jonah works at a law firm) asks Jonah if she should call an attorney. She also asks if his firm handles these types of cases. Jonah tells the woman that she will need to call an attorney and gives her the number of his firm. Has Jonah breached any ethical duties? We can understand that paralegals should not be giving out legal advice but by suggesting she should get an attorney, would this qualify as legal advice? Any help would be great, Thanks!
Health care question...what career matches up with these interests? I have always been very interested in health care, and I'm currently working as a hospital social worker in an inpatient unit. There are two areas of health care that I'm passionately interested in. The first is medical ethics. For example, my hospital will sometimes have cases where we need to have team consultations where we discuss a complicated case from multiple perspectives (e.g. legal, medical, familial, etc.). I find these types of cases fascinating, but don't know if there's a good career match for this interest apart from law (which I don't want to pursue). My second interest is working to make health care delivery more efficient. I am fascinated by the inefficiency of the current system in many areas (reimbursement, documentation, pricing structure, etc.). Once again, I'm not sure what type of job or training one would need to have to focus on these issues.
What are the law governing use of a interpreter within a Hospital setting? I am a Security Guard at a hospital and just recently had to deal with a patient being admitted to are psych floor who was very upset about how things where going during the intake process. I tried to explain to her that this is how things are but she did not speak any English whatsoever, now this was late at night and interpreter services was gone for the night and are alternative a speakerphone that calls a interpreter service call center was adequate for this particular patient. However there was a ER Tech working that spoke both the patients language and English very well I asked her if she could please help me talk to the patient and try to get her to calm down but a nurse told me she was unable to because it was "unethical and illegal for her to interpret for me". Now I understand that there are rules and ethics surrounding interpreter services when working in a medical facility but in my case I was only asking for someone to help me break a language barrier so that I could better asses the situation and try to calm the patient down. all in all I just wanted to be able to ask her how I can help her and explain the rules of the unit and answer any questions she might have for me. I in no way wanted to ask her anything related to her medical treatment being provided to her by my facility. So in short my question is Is it really illegal for me to ask for someones help in the way I have just explained. (I am really just need to know now because if there are such laws I really don't see how they apply in this unique situation)

Do we have a case? and how do we do something about it? medical negligence? ok my girlfriend, a few weeks ago had a rod rod implant contraceptive put in her arm, once the procedure was complete the doctor told her it would be safe to have unprotected sex after 3weeks, and she kept drilling the the waiting period into her of 3WEEKS! in this same appointment she also was written a script for an antidepressant medication she has been on for a few months now. so following the doctors recommendations we waited 3 weeks, but the doctor didn't tell us the antidepressants she is on can affect the rod for up to a month! my girfriend is late and and has 1 positive supermarkt pregnency test and is going for another test at(with a differet doctor) today, shes been pregnant once before and is feeling the same way she did then(she misscarriaged at 5 months) so she is most likely pregnant. we are only 17 and cant handle a child right now we need to finish school and we cant rely on our parents nor can we tell them, they would dissown us.... can someone plz help? btw we our in australia nsw if thats makes a different on laws and ethics or something ok, yes some people believe, young people should not be having sex, but in australia it is legal after the age of 16, and yes i know i will have to own up to my decisions, but thats not answering the question, we will deal with it if we have to and we dont need people telling us what we should and shouldn't do, we make our own choices and we deal with the consquences.
QUESTION ABOUT MEDICAL MALPRATCICE? My wife had a hysterectomy about 2 years ago which was botched. After 6 or 7 major and minor surgeries to save her, wound care til the present and home nursing along with all the associated heartache... let's skip the details: We finally went to two different law firms to attempt to sue for malpractice. Both had "experts" review the medical records (we had to pay for them; not cheap). Both firms came to the conclusion that there was, indeed, Malpractice and something called Failure to Provide Expected Medical Care or some such thing. Anyway: Both firms said that, although the case had "merit" and proof, the "Return On Investment" was not adequate for them to accept the case. As one "honest" attorney said, "I've got a Mesarati sitting outside I've got to pay for...Sorry, Good bye". My Question: Where is the line between ethics and profit? This happened in Indiana where there is a cap on malpractice and other restrictions. Hey, if Obamacare comes in, can we revisit this? After I'm a UAW member (lol)... It's lost. If people put ethics over greed, the world would be a much better place? I was discussing this with my parents today (I'm 16). Over how there are people in professions cheat other people just so they can get a higher paycheck. For example, doctors. There are a lot of doctors who give their patients expensive medicines just so they can make more money. So they can live in a bigger house. Provide for their families more. Or, they try to get you to plan multiple appointments to solve an issue that could have been solved in 1 appointment. Or, lawyers. They know the law very well, so they should always have justice. But there are still many who work for people, and fight hard for them in court, when they know they weren't telling the truth. But it doesn't matter, because all that matters at the end of the day is making as much money as possible. How do these people feel good about themselves when they win the case, but they know its not whats just? What kind of sick people are these? The list goes on and on.. even with politicians and lobbyists that campaign for things they know are wrong, but do it because they have sponsors paying them to do so. Think of how wrong the world is because the world is corrupted by greed. Its not just high ranking people either.. everyday people. Putting themselves and their families above others, by ignoring ethics and being fueled by greed. And these people think they are good people? Many of these people claim to be religious? BS. If everybody in the world started to be fairer and actually use ethics, we wouldn't have a lot of problems. We wouldn't have the health insurance mess in the first place. We probably wouldn't have the huge oil spill in the Gulf of Mexico f***ing up so many people's lives as well as the environment, because BP would have thought its better to be safer and do what was necessary to prevent a spill, than risk it to save money. Governments wouldn't be corrupt.. there would be no theft, which means there probably would be a lot less violence. And many many more that I'm sure you could think of yourself. Like if people really gave a sh** about their jobs and actually helping people.. many good things would occur from that. Like I hate when you go to a doctor and they are acting like you are wasting their time.. they just want to go to the next patient soon. Like wtf, do they know how much that 1 appointment costs? I generally hate when people don't care about their job pretty much.. it also could be a teacher, who ist dedicated to really helping kids improve their education. teachers are a big deal.. they shape the future people in this world. Or when you go to a store and the workers don't want to help you out and kind of snub you off and stuff. Im the one giving you my money! If you are going to be a b**** about me contributing to your paycheck, then I'll just go shop somewhere else that cares about its customers, and don't worry, I'll tell all my friends to not shop at such an inconsiderate place. No matter what you do, please do it with some passion, or atleast pretend you give 2 sh**s about it, or it leaves a bad impression. and if you really care for what your doing your gonna do a better job at it, and if everyone did that the world would be vastly improved as when you do work you love you just wanna keep working hard at it. Dont think its just some far-off dream. You can make good decisions in your life because I think karma really does happen. And it makes a difference to other people when you are fair with them.. think of all the lives you'd be helping. that's what is going to get you to heaven, if you believe in it, not having the biggest house on the block. you dont need lots of money to be happy anyways.. rich people have issues just like everyone else.. sometimes even worse. my parents disagreed with me.. like my mom gave me the doctor example.. like some indian who worked really hard and got into a good college to be a medical doctor and is doing those things (which i consider to be scams) to give their kids the best life possible, at many other peoples expense. I think thats sad. I hope I'm not like that when I'm older.. Do I have a case against a nurse/hospital? My first pregnancy: I was told by the nurse not to walk on my own because I just had the baby. I had to go to the bathroom. So I rung the bell by my bedside. It took them a while to come. They finally came and helped me to the bathroom. When I was finished I rung the bell repeatedly and got no answer and no one came to get me. I can hear the nurses conversating outside. So I figured I can get off the toilet and crack the door to yell out for them. I past out. Don't know how long. I woke up looking at the ceiling with nurses around me. The next day after the medication wore off I felt very sharp pain in my hip. I couldn't even hold my newborn. I couldn't shift my body or anything. I had to lay flat during my hospital stay and when I arrived home. My doctor said I felt that way because of my vaginal delivery. but it's been 2 years. Im in school to be a medical assistant. My statute of limitations is not up. Im learning about med law and ethics. Do I really have a case. My hip still hurts every now and then to the point I can't get up or twist my body. Can I prove it to the court? How? what to do? What to expect? By the way, I live in Philadelphia if you are a lawyer Sway, how abut you sit on the toilet after a surgery (since your a guy). Comparable negligence is the case here if you have done your homework I believe comparable negligence is when the plaintiff and the defendant caused harm. Therefore the hospital is resonsible for half of my injury. If they would have came to me and put me back to bed, none of this would have happened. I was in a car accident, rear ended someone, no insurance, my passenger after 3 years is trying to sue for personal injury. Received a few stitches under eye. Filed 17 days before statue of limitations in California so case was filed. Seen this person after accident and they were doing fine not longer after the accident. Anyway I was hit with a summons which seeeeems very frivilous and as if it is being sent by a "oppurtunist" who is trying to get whatever it is they can. How do I reply back to this summons and case management order. Please be detailed. I understand if this person would be reasonable and go hey here are my medical bills etc...and here are the actual numbers. But to attempt to sue for pain and suffering, loss of wages etc... is ridiculous. I have seen this person driving, looking like life was just fine, this is very suspicious to claim any pain and suffering, if anyone went through pain and suffering it would be me I lost a vehicle, was sued by the other parties whom a paid some money...How can I bring these people back to reality... Postmortem sperm procurement: whose rights should prevail? please help its for my midterm!? this issue is one of my questions for my ethics midterm and if anyone can just give me their thoughts to help me gather mine and put them all together. thanks! here it is in a nutshell: husband died unexpectedly in an accident and his wife and him had been trying for years to conceive with no luck. after his death she requested postmortem sperm procurement. her husband had no advance directive stating or implying his wish to father a child or specifying his agreement to such procedure in case of his death. the hospital ethics comittee noted that under state law the spouse of the deceased is the surrogate decision maker so it rested with the wife. deceased husbands parents argued their son would have never wanted to father a child who would be raised with only one parent.the medical staff is divided becase half feel they had been trying for years so therefore husband wanted to father a child with his wife, other hald thought its unfair to do so with only one parent although many children have been raised perfectly fine this way. how should conflicting interests be handled by the hospital and whose rights should prevail?

lawyer charged with breach of fiduciary responsibilities? Tyler TX's newest oldest "Elder Law Expert" lawyer is suing my elderly, uneducated, unsophisticated mother for unpaid legal fees. He billed my mom 2 1/2 times his estimate. Also, he did virtually nothing, and badly. He downloaded the *wrong* Medicaid application form at the 11th hour, right before Medicare's 100 days expired. (Medicaid was later denied.) In preparing to defend her against him in small claims court, I find that his own father sued him in 2006. He had been named as Trustee in his mother's Testamentary Trust. Ten years later, his father petitioned federal court to remove him as Trustee, recover trust property, and asked for emergency injunctive relief: His son the attorney had committed a breach of fiduciary duties. He had mishandled the estate, bought himself a house, sent the kids to college, placed his father in a sub-standard nursing home with no medical care, failed to provide an accounting of the assets when requested, etc.. After dragging his feet to provide court-ordered records, he asked that the case to be dismissed when his father died in 2007 (granted). I am now told that none of this can be brought up in my mother's case since it is "immaterial." However, I believe it speaks to the attorney's character, ethics, and mistreatment of the elderly. Any attorney who would act this way in any Trustee capacity, much less his own family's Trust, cannot be trusted with any elderly person's affairs. This attorney has moved to Tyler TX by way of Reno NV. Why? One clue is that Tyler TX is a town abundant in elderly and infirm people, and they are all sitting ducks for a predatory lawyer with a history of lying, cheating, and stealing who now has his "Elder Law Expert" shingle out. How can I get the word out about this unethical lawyer? My elderly mom's case is relatively small compared to his family's ~$780,000 estate. But if he takes ~$3,000 from every old person who is lured by his "Elder Law Expert" advertising, he will soon be able to recoup his losses from being removed as Trustee from his family's Trust. It isn't slander if it's true: The lawyer's father did, in fact, bring suit against him in federal court for mishandling the family Trust; he was, indeed, removed as Trustee. He did, in fact, mishandle my mother's case to the point where he gave her the wrong Medicaid application to fill out: He signed and dated it a mere *three days* before Medicare's 100 days was to expire, and left it up to her to fill it out (yet "File application for Medicaid" is on fee agreement.) Organ and Tissue Transplants Modern techniques of medical transplantation—surgically removing a diseased or malfunctioning kidney, heart, or other organ, and replacing it with a healthy organ from a donor—has brought new life and new hope to patients who, just a few generations ago, would have died. But the practice has also raised significant ethical questions. One such question centers on the cold reality of supply versus demand: At any moment, there are upwards of 150,000 people in the world awaiting transplants. A scarcity of donor organs usually means a long wait—during which some patients die. A large supply of organs is available from the roughly 200,000 patients worldwide who are declared brain-dead each year, but the problem has been to secure consent from family members and loved ones to remove organs for transplant. For many years medical ethicists have considered the question of whether ethical means can be found to increase the supply of donor organs. In the early 1980s, for example, American bioethicist Arthur Caplan of the University of Pennsylvania discussed the concept of presumed consent—the idea that, barring strenuous objection from family members, doctors could presume that a person declared brain-dead would be willing to donate organs to save others. Some Asian nations, as well as some European nations, including France, Belgium, Austria, and Spain, have such policies. The United States and Canada later enforced a concept advanced by Caplan of required request—a policy whereby hospital personnel would be legally required to seek permission from family members before harvesting organs. The adoption of this policy in the United States and Canada increased the supply of donated tissues, such as corneas and bone marrow, but failed to dramatically increase the supply of donor organs. Current United States and Canadian law bars the sale or purchase of donor organs. The United States does permit the sale of plasma and other bodily products, such as hair and sperm. Would financial incentives provide a stimulus for more people to make organs available? Some ethicists believe so, while others find the idea of marketing organs ethically objectionable. Other ethical issues are raised by the practice of xenotransplantation—the use of animal tissues and organs for human transplant. In 1984 the case of “Baby Fae” stimulated wide ethical discussion. Doctors transplanted a baboon heart into a newborn girl to replace her own fatally flawed heart. She died shortly after. Some critics contend that xenotransplantation poses a danger to human health because of the risk of transferring deadly animal viruses to the human population. This risk causes bioethicists to question if such practices are ethical. In recent years, one of the most promising areas related to transplantation will likely trigger ethical debate well into the future: the experimental use of tissues from aborted human fetuses. In one particularly active area of this research, scientists have experimented for more than a decade with grafting nerve cells from human fetuses into the brains of patients suffering from Parkinson disease. This disorder, caused by the mysterious death of brain cells that produce a chemical called dopamine, gradually causes patients to lose control of their muscles. In early studies some patients who received fetal cells showed improvement in their symptoms, as the transplanted cells demonstrated the capacity to produce dopamine. But the treatment also produced unpleasant side effects. This research, like all research that depends on human fetal cells, has also provoked debate. Critics question the ethics of using tissues from human fetuses for any research purposes. Ethical uncertainty hangs over a related area of research on human embryonic stem cells. Human embryos contain stem cells that have the ability to develop into almost any type of cell. Scientists hope to direct stem cells to produce certain types of human tissue. It is possible that someday these cells might be used for transplants or for growing new tissue that can be grafted into the human body. For example, scientists hope that stem cells might one day be used to replace nerve cells destroyed by spinal injury, or heart muscle cells damaged during a heart attack. Interest in this field was heightened considerably when scientists announced in 1998 that they had learned how to grow human embryonic stem cells in the laboratory. At present the U.S. government has banned federal funding for human-embryo research, although private biotechnology companies are exempt from this ban and have been vigorously pursuing research on embryonic cells. In 2000 the federally funded National Institutes of Health (NIH) ruled that this ban was not necessary for studies using cells derived from human embryos, since these cells are not embryos. The NIH established guidelines enabling federal funds to be used in cases where cells were derived from frozen embryos that were created for the purposes of fertility treatment but were not going to be used and were therefore slated for destruction. Other nations currently differ widely in their policies: France, for example, has forbidden human-embryo research. No laws in Canada regulate human-embryo research, although scientists or institutions receiving federal funding must follow strict guidelines governing research on human embryos. The United Kingdom has laws permitting some forms of human-embryo research, going so far as to create guidelines allowing scientists to apply cloning technology to human embryonic cells to create genetically identical cells for a potential patient. But the ethical questions remain: Is it morally acceptable to use tissue taken from human embryos? One recent development might change the nature of this argument. Scientists discovered in 1999 that stem cells taken from adult mice, and not human embryos, also display an ability to change their function. Some stem-cell research continued with the use of adult mouse cells. In 2007 government medical authorities in the United Kingdom approved the creation of embryos that combine human and animal cells for use in medical research. British researchers claimed the hybrid embryos were vital in the fight against disease. ETHICAL ISSUES A number of ethical issues haunt the transplant field. With few exceptions, donated organs go to the patient who is nearest death, even though a healthier patient might benefit more by living longer after the transplant. People who need a second, third, or fourth transplant because their prior transplants failed usually gain top priority, even though they are not likely to do as well as patients who have not already had a transplant. Some critics object to giving organs to patients whose organ failure was the result of their own actions, such as cirrhosis of the liver resulting from alcohol abuse. Money is also a major issue. Access to transplantation is impossible without access to good primary medical care and good insurance, both of which are largely unavailable to the poor. To be placed on the waiting list, patients must show they can pay for the transplant. In 2005 a kidney transplant cost about $116,000 and a liver transplant as much as $250,000 in the first year after the surgery. Many insurance companies do not cover such costs, particularly for the new procedures, such as lung, pancreas, or multiple organ transplants, which are still considered experimental. Although organs cannot be bought and sold legally in the United States, there is evidence that a black market in organs exists in China and other countries. Persistent allegations have been made of people traveling to China and paying for organ transplants. Human rights groups have reported evidence that the bodies of executed prisoners are the source for most of the organs transplanted in China. In the United States, where organ donation is voluntary, ethical questions arise over the nature of the consent and the use of incentives. Intensive donor solicitations in recent years have not made much of a dent in the shortages of organs. Even though many people sign organ donor cards, their families are often reluctant to grant permission at the moment of crisis. Some ethicists debate whether family members should have the right to refuse donation if the deceased signed an organ donor card. Presumed consent laws, in which everyone would be considered willing donors unless they have specifically said they were unwilling, have been tried in Europe and South America, and on a limited basis in Pennsylvania and Maryland. Some experts have suggested financial incentives, such as cash rebates, estate tax discounts, or payment for burial expenses. Others have suggested broadening the criteria used to determine death beyond the lack of all brain activity. This would permit a surgeon to use organs from anencephalic children, who are born without a brain, and from people in a persistent vegetative state. The implantation of tissues from aborted fetuses into the brain showed promise as a treatment for both Parkinson and Huntington’s disease. Experimental results were mixed, but the treatment raised its own set of ethical questions. The foremost is the question of abortion itself. The possibility of using embryonic stem cells to create replacement organs has faced opposition for similar reasons. Some researchers believe that this issue can be surmounted by growing cells in the laboratory or by genetically engineering a patient’s own skin cells. Fetal pig cells have also been used as a treatment for Parkinson and Huntington’s disease, but that raises other ethical issues regarding the treatment of animals. The money will be paid directly to the funeral homes, to prevent it from being used for other purposes, thus openly introducing a market in organs. Such a market has been until now considered anathema in the United States, a sentiment backed by a law banning trade in organs. Could that be changing? In the market for organs A May Time magazine essay by Charles Krauthammer suggested that it is acceptable that the poor will be more likely than the rich to be enticed by the Pennsylvania gambit, given that most societal harms fall more heavily on the poor. Why not a cash benefit? And, Krauthammer argues, if paying for organs would lead to a flourishing market, one that licks the great shortage in organs, breaking the taboo against such a trade is a price well worth paying. What about an organ market? The experience in third-world countries, such as India and Egypt, should give pause to all those who favor an outright market in organs. Poor people have their kidneys taken without being properly informed of the risk involved. Rich people can buy all the organs they need or want; those less fortunate often cannot scare up any. At the same time, the urgent need to increase the organ supply on these shores is well established. An estimated 4,000 Americans die each year because no organs can be found for them. And the quality of life of thousands more suffers because they cannot find needed corneas and kidneys. Increased organ donations also would significantly reduce health-care expenditures. For instance, it costs less to transplant a kidney and maintain a person on the follow-up treatment needed than to keep the same person on dialysis for four years. Many stay on dialysis much longer if no kidney is found. Is there any way to greatly increase the number of organ donors without opening a market in human parts, which many -- myself included -- find ethically highly troubling? Before chapter and verse can be spelled out, the underlying principle needs to be explicated. Social scientists have shown that we are social creatures who deeply yearn for the approval of others. These can be members of our family, friends, neighbors, and more generally, community members. The strong power of so-called significant others is exhibited in intense, sometimes extreme, forms through peer pressure on teenagers, gang members and soldiers in combat. Members of such groups will do practically anything their group prescribes, even endanger their own lives. Much milder forms of such social pressure are evident when we donate money to a church or a civic cause, both because we believe in the merit of doing so and because we yearn for the approval of those whose opinions matter to us. (Anonymous donations are surprisingly rare.) The case for moral suasion Currently the voice of the community that favors organ donations has no chance to be aired or heard. People who feel like donating on their own, and remember to do so, mark their Motor Vehicle forms accordingly, but nobody is there to encourage them to do so, to appreciate it when they do, and maybe look at them with regret when they do not. Typically the issue does not come up until someone is on the death bed and -- at this most difficult time -- physicians and other health-care personnel are expected to ask the members of their family to consent to organ donation. To give moral suasion more of a chance, two measures should be taken. First, we should provide a new form at physicians' and hospitals' waiting rooms, clinics, Red Cross stations and other places where volunteers gather. The form would state explicitly that "we the people would be most appreciative, and hold you in high regard, if you could find it in your heart to make a life-affirming donation by authorizing the use of your organs once they are no longer of service to you." The text then would describe briefly the severe shortage of donated organs and its many dire effects. The main focus of the text, however, would be the moral virtue of donating organs. The forms would close by stating that if you decline, for religious or any other reason, no explanation is needed. All said and done, it is up to you. Second, the names of those who made the pledge would be logged into computerized databases, accessible to physicians engaged in organ transplantation. (A new law may be needed to establish the validity of the endorsements of these forms and to prevent family members from overriding them.) If these lists also were open to the press, its reports might greatly increase the number of those who would sign up; it is the best tool to alert the community about who has -- and has not yet -- committed to make an organ donation. At the same time, at least initially, such publication might be considered too high handed. The new forms should be promoted through public-service announcements, and by public figures -- urging people to come forward, announcing that "I myself have just made the commitment to save lives by donating my organs should I no longer need them." The main point, though, is as elementary as it is important: Instead of waiting for each person to consider the matter, without any encouragement or recognition by their community, we should unabashedly stress that in our minds and hearts we cheer donating organs and celebrate those who pledge to do so. One need not a priori rule out a market in organs, despite all the ethical challenges it poses. NEW YORK — In a report published in a medical journal this month, two doctors describe a 6-year-old girl with profound, irreversible developmental disability who was given high doses of estrogen to permanently halt her growth so that her parents could continue to care for her at home. The controversial growth-attenuation treatment, which included hysterectomy, was requested by the child's parents and initiated after careful consultation and review by an ethics committee. In their report in the Archives of Pediatrics and Adolescent Medicine, Drs. Daniel F. Gunther and Douglas S. Diekema, both at the University of Washington in Seattle, explain the reasoning behind what they hope will generate a healthy debate. Gunther is at the Division of Pediatric Endocrinology, and Diekema is at the Center for Pediatric Bioethics. Caring for children with profound developmental disabilities can be difficult and demanding, they note. For children with severe combined neurologic and cognitive impairment who are unable to move without assistance, all the necessities of life — dressing, bathing, transporting — must be provided by caregivers, usually parents, and these tasks become increasing difficult, if not impossible, as the child increases in size. "Achieving permanent growth attenuation while the child is still young and of manageable size would remove one of the major obstacles to family care and might extend the time that parents with the ability, resources, and inclination to care for their child at home might be able to do so," Gunther and Diekema write. The parents of the 6-year-old, both of whom were college-educated professionals, indicated a strong desire to continue caring for their daughter. Despite having the neurologic development no greater than that of an infant, the 6-year-old responds to her parents and two healthy siblings — vocalizing and smiling in response to care and affection — and "clearly is an integral, and much loved, member of the family," the authors note. There is this woman who was previously a heavy drug and alcohol user, her boyfriend left her for those reasons however soon after she foud out she was pregnant. She keeps the baby and tell the doctors and nurses that shes clean and has stopped everything. The nurse in order to keep her on track continues to educate her on the harm of these subtances on an unborn baby. When the baby is born, the doctor tells her her baby has fetal alcohol syndrome. HERE is he issue... The baby DOESNT really have this syndrome, it is a "strategie" that the doctor has used to "scare" her in order to give it up all together for ever. IT WORKED.. BUT the fault here is that the doctor is putting her through all this emotional trauma when there really isnt anything wrong with the baby. The nurse finds her crying and later finds out that the doctor is lying but the doctor tells her to keep quiet, that he will NOW tell the mother that the baby only has it mild.. Since the nurse also had an ongoing commitment to working with the woman, she realised that she was now in quite a difficult situation. While deception was generally to be avoided, there did seem to be something to be said for this strategy of the doctor’s. Again, lying might not help with attempts to deal with the issues underlying the woman's drinking; yet being truthful might make The woman complacent – a real concern if there were to be later pregnancies. Suppose, after the nurse had met with the doctor and learned of his strategy, but before she had made up her mind what to do about her basic problem, the woman had confided to the nurse that she had been drinking during the pregnancy, though not heavily. Suppose also that the woman had indicated that the doctor’s diagnosis if foetal alcohol syndrome had really given her a jolt, and that she was now determined to try to limit her drinking. Need help with ideas? I need to write a fictitious story for a Medical Law & Ethics class using 26 terms. The terms do not need to be defined in the story. Fred Turley of Des Plaines, Ill., learned he didn’t have a daughter. And Wendy Lieb of Lewis Center, Ohio, made certain she wasn’t going to be a grandmother quite yet. In all three situations, crucial genetic information altered the lives of the people involved. And in each case, it came not from a doctor or other medical source, but from a $29.99 kit on a drugstore shelf. Reid, Turley and Lieb are among more than 800 customers who responded to the first wave of marketing for do-it-yourself DNA paternity tests sold as Identigene by Sorenson Genomics of Salt Lake City. Story continues below ↓ -------------------------------------------------------------------------------- advertisement -------------------------------------------------------------------------------- Sales in three western states — Washington, Oregon and California — were so brisk last fall that Rite Aid Corp. expanded the product this week to some 4,300 stores in 30 states across the country. “The running joke is that we’re the Maury Povich family,” said Reid, 37, who confirmed years of speculation about a former girlfriend’s son with a kit purchased at a Bellingham, Wash., store. “But why not do it privately? We did this as discreetly, as efficiently and as cost-effectively as possible.” For users like Reid, the tests provide easier answers to one of life’s crucial questions — Who’s your daddy? — said Douglas Fogg, chief operating officer of Identigene. “Everyone is purchasing the tests because they’re curious,” said Fogg, who expects to sell at least 52,000 tests this year. “They’re looking to establish questions about their own child or their own paternity.” But for genetics experts, drugstore marketing of DNA testing raises questions of accuracy and ethics. “From our perspective, direct-to-consumer genetic tests raise all the same issues for lax government oversight, potentially misleading or false advertising and the potential for making profound medical decisions on the basis of poorly interpreted or understood results,” said Rick Borchelt, a spokesman for the Genetics and Public Policy Center at Johns Hopkins University. At the very least, the kits have the potential to complicate the lives of the people who use them, legal experts cautioned. “We all need to take a step back and realize that this is different than many tests that you take,” said R. Alta Charo, a professor of law and bioethics at the University of Wisconsin at Madison. “This is a life-changing moment.” DNA tests join other diagnostic tools The paternity kits have taken their place on store shelves next to other diagnostic tests that don’t rely on DNA, including those for pregnancy, HIV and blood sugar, said Michael S. Watson, executive director of the American College of Medical Genetics. Unlike genetic tests for health conditions, tests that use DNA to determine paternity are fairly simple to provide and fairly easy to interpret, said Watson. They're subject to limited oversight, however, with no review required by the Food and Drug Administration and no certification required under the federal Clinical Laboratory Improvement Amendments, or CLIA. The Identigene kit includes swabs for collecting cell samples from the inside of the cheeks of the child and the alleged father. Collection of the mother’s cells is optional, but strongly recommended to strengthen the results. The swabs are packaged and mailed to the Sorenson laboratory in Salt Lake City where they’re analyzed. Cast your vote Are at-home DNA paternity tests a good idea? The Sorenson lab is accredited by the AABB, the agency formerly known as the American Association of Blood Banks. Results are reported online, by phone or by mail in three to five business days. They come back as a probability figure that verifies paternity with 98 percent to 99 percent accuracy, Watson said. Total cost is about $150, including the price of the kit and a $119 laboratory processing fee. For another $200, users can purchase validated tests that meet legal requirements for determining paternity, Fogg said. Court use questionable But Susan Crockin, a lawyer who specializes in reproductive technology, said consumers shouldn’t count on the tests standing up in court. Video Who's your daddy? Today show “The jury’s still very much out on these tests in terms of reliability and establishing a chain of custody,” said Crockin, a consultant for the Johns Hopkins public policy center. Most of the users who have been buying the kits — which have gone on sale for as low as $17.99 — don’t plan to use the results to resolve legal issues, Fogg acknowledged. Instead, most are looking to answer social questions. And that's where the complexity comes in. Because the cell samples are taken in private, there’s the potential for fraud and deception, noted Charo, the ethics expert. “I can imagine rather peculiar circumstances in which somebody has a swab taken without their knowledge,” she said. “It raises questions about informed consent.” Even when people do consent, the results can be unsettling. Watson estimates that between 5 percent and 10 percent of genetic tests he's conducted show a child is not related to the presumed father. “It could break up families,” Watson said. “Some will be broken because that was the goal. Others will be broken up and that wasn't the goal.” But people who’ve used the at-home tests swear by the ease, the accuracy — and the results. After 20 years, a mystery solved For Reid, the paternity test opened the door to a new extended family. He’d always wondered whether the baby born to a former girlfriend was his, even though she insisted the child was fathered by another man. When the girlfriend contacted Reid on Facebook last summer, the pictures she sent of her oldest son raised the question anew. “My wife, said ‘Oh my, that’s you,’” said Reid, a nurse. Internet research pointed Reid to the Identigene test, which was cheaper and more convenient than other options. With cooperation from his former girlfriend and her son, they all took the tests, with results that altered everyone’s lives. “Our newest son has a family he never knew he had including grandparents, aunts, and three younger brothers who are all very excited to meet him,” Reid said. For Fred Turley, 55, the DNA test confirmed what his companion had told him: the 4-year-old girl he helped care for was not his. The news was disappointing, but clear, he said. “The bottom line is, I don’t have to live with the uncertainty about her being my daughter and wind up in a fight just to find out,” Turley said. “This won’t change how I feel about the girl. It will just remove what had become a major concern.” For Wendy Lieb, 41, the DNA test restored her 20-year-old son’s future. He’d already quit college, taken a job and assumed the responsibilities of pending parenthood after a girl he had sex with at a party claimed she was pregnant with his child. Lieb is relieved for her own child, of course, but also for everyone involved. As difficult as the situation has been, she said, it will be easier for them to adjust now, rather than years later. Last Rites for Indian Dead by Suzan Shown Harjo What if museums, universities, and government agencies could put your dead relatives on display or keep them in boxes to be cut up and otherwise studied? What if you believed that the spirits of the dead could not rest until their human remains were placed in a sacred area? The ordinary American would say there ought to be a law—and there is, for ordinary Americans. The problem for American Indians is that there are too many laws of the kind that make us the archeological property of the United States and too few of the kind that protect us from such insults. Some of my own Cheyenne relatives’ skulls are in the Smithsonian Institution today, along with those of at least 4,500 other Indian people who were violated in the 1800s by the U.S. Army for an “Indian Crania Study.” It wasn’t enough that these unarmed Cheyenne people were mowed down by the cavalry at the infamous Sand Creek massacre; many were decapitated and their heads shipped to Washington as freight. (The Army Medical Museum’s collection is now in the Smithsonian.) Some had been exhumed° only hours after being buried. Imagine their grieving families’ reaction on finding their loved ones disinterred° and headless. Some targets of the Army’s study were killed in noncombat situations and beheaded immediately. The officer’s account of the decapitation of the Apache chief Mangas Coloradas in 1863 shows the pseudoscientific nature of the exercise. “I weighed the brain and measured the skull,” the good doctor wrote, “and found that while the skull was smaller, the brain was larger than that of Daniel Webster.” These journal accounts exist in excruciating detail, yet missing are any records of overall comparisons, conclusions, or final reports of the Army study. Since it is unlike the Army not to leave a paper trail, one must wonder about the motive for its collection. The total Indian body count in the Smithsonian collection is more than 19,000, and it is not the largest in the country. It is not inconceivable that the 1.5 million of us living today are outnumbered by our dead stored in museums, educational institutions, federal agencies, state historical societies, and private collections. The Indian people are further dehumanized by being exhibited alongside the mastodons and dinosaurs and other extinct creatures. Where we have buried our dead in peace, more often than not the sites have been desecrated. For more than two hundred years, relic-hunting has been a popular pursuit. Lately, the market in Indian artifacts has brought this abhorrent activity to a fever pitch in some areas. And when scavengers come upon Indian burial sites, everything found becomes fair game, including sacred burial offerings, teeth, and skeletal remains.One unusually well-publicized example of Indian grave desecration occurred two years ago in a western Kentucky field known as Slack Farm, the site of an Indian village five centuries ago. Ten men—one with a business card stating “Have Shovel, Will Travel”—paid the landowner $10,000 to lease digging rights between planting seasons. They dug extensively on the forty-acre farm, rummaging through an estimated 650 graves, collecting burial goods, tools, and ceremonial items. Skeletons were strewn about like litter. What motivates people to do something like this? Financial gain is the first answer. Indian relic-collecting has become a multimillion-dollar industry. The price tag on a bead necklace can easily top $1,000; rare pieces fetch tens of thousands. And it is not just collectors of the macabre° who pay for skeletal remains. Scientists say that these deceased Indians are needed for research that someday could benefit the health and welfare of living Indians. But just how many dead Indians must they examine? Nineteen thousand? There is doubt as to whether permanent curation of our dead really benefits Indians. Dr. Emery A. Johnson, former assistant Surgeon General, recently observed, “I am not aware of any current medical diagnostic or treatment procedure that has been derived from research on such skeletal remains. Nor am I aware of any during the thirty-four years that I have been involved in American Indian . . . health care.” Indian remains are still being collected for racial biological studies. While the intentions may be honorable, the ethics of using human remains this way without the full consent of relatives must be questioned. Some relief for Indian people has come on the state level. Almost half of the states, including California, have passed laws protecting Indian burial sites and restricting the sale of Indian bones, burial offerings, and other sacred items. Rep. Charles E. Bennett (D-Fla.) and Sen. John McCain (R-Ariz.) have introduced bills that are a good start in invoking the federal government’s protection. However, no legislation has attacked the problem headon by imposing stiff penalties at the marketplace, or by changing laws that make dead Indians the nation’s property. Some universities—notably Stanford, Nebraska, Minnesota, and Seattle—have returned, or agreed to return, Indian human remains; it is fitting that institutions of higher education should lead the way.Congress is now deciding what to do with the government’s extensive collection of Indian human remains and associated funerary objects. The secretary of the Smithsonian, Robert McC. Adams, has been valiantly° attempting to apply modern ethics to yesterday’s excesses. This week, he announced that the Smithsonian would conduct an inventory and return all Indian skeletal remains that could be identified with specific tribes or living kin. But there remains a reluctance generally among collectors of Indian remains to take action of a scope that would have a quantitative impact and a healing quality. If they will not act on their own—and it is highly unlikely that they will—then Congress must act. The country must recognize that the bodies of dead American Indian people are not artifacts to be bought and sold as collector’s items. It is not appropriate to store tens of thousands of our ancestors for possible future research. They are our family. They deserve to be returned to their sacred burial grounds and given a chance to rest. The plunder of our people’s graves has gone on too long. If these critics are right, then America should be destroyed. And who can dispute some of their particulars? This country did have a history of slavery and racism continues to exist. There is much in our culture that is vulgar and decadent. But the critics are wrong about America, because they are missing the big picture. In their indignation over the sins of America, they ignore what is unique and good about American civilization. As an immigrant who has chosen to become an American citizen, I feel especially qualified to say what is special about America. Having grown up in a different society -- in my case, Bombay, India -- I am not only able to identify aspects of America that are invisible to the natives, but I am acutely conscious of the daily blessings that I enjoy in America. Here, then, is my list of the 10 great things about America. -- America provides an amazingly good life for the ordinary guy. Rich people live well everywhere. But what distinguishes America is that it provides an impressively high standard of living for the "common man." We now live in a country where construction workers regularly pay $4 for a nonfat latte, where maids drive nice cars and where plumbers take their families on vacation to Europe. Indeed, newcomers to the United States are struck by the amenities enjoyed by "poor" people. This fact was dramatized in the 1980s when CBS television broadcast a documentary, "People Like Us," intended to show the miseries of the poor during an ongoing recession. The Soviet Union also broadcast the documentary, with a view to embarrassing the Reagan administration. But by the testimony of former Soviet leaders, it had the opposite effect. Ordinary people across the Soviet Union saw that the poorest Americans have TV sets, microwave ovens and cars. They arrived at the same perception that I witnessed in an acquaintance of mine from Bombay who has been unsuccessfully trying to move to the United States. I asked him, "Why are you so eager to come to America?" He replied, "I really want to live in a country where the poor people are fat." -- America offers more opportunity and social mobility than any other country, including the countries of Europe. America is the only country that has created a population of "self-made tycoons." Only in America could Pierre Omidyar, whose parents are Iranian and who grew up in Paris, have started a company like eBay. Only in America could Vinod Khosla, the son of an Indian army officer, become a leading venture capitalist, the shaper of the technology industry, and a billionaire to boot. Admittedly tycoons are not typical, but no country has created a better ladder than America for people to ascend from modest circumstances to success. -- Work and trade are respectable in America. Historically most cultures have despised the merchant and the laborer, regarding the former as vile and corrupt and the latter as degraded and vulgar. Some cultures, such as that of ancient Greece and medieval Islam, even held that it is better to acquire things through plunder than through trade or contract labor. But the American founders altered this moral hierarchy. They established a society in which the life of the businessman, and of the people who worked for him, would be a noble calling. In the American view, there is nothing vile or degraded about serving your customers either as a CEO or as a waiter. The ordinary life of production and supporting a family is more highly valued in the United States than in any other country. America is the only country in the world where we call the waiter "sir," as if he were a knight. -- America has achieved greater social equality than any other society. True, there are large inequalities of income and wealth in America. In purely economic terms, Europe is more egalitarian. But Americans are socially more equal than any other people, and this is unaffected by economic disparities. Alexis de Tocqueville noticed this egalitarianism a century and a half ago and it is, if anything, more prevalent today. For all his riches, Bill Gates could not approach the typical American and say, "Here's a $100 bill. I'll give it to you if you kiss my feet." Most likely, the person would tell Gates to go to hell! The American view is that the rich guy may have more money, but he isn't in any fundamental sense better than anyone else. -- People live longer, fuller lives in America. Although protesters rail against the American version of technological capitalism at trade meetings around the world, in reality the American system has given citizens many more years of life, and the means to live more intensely and actively. In 1900, the life expectancy in America was around 50 years; today, it is more than 75 years. Advances in medicine and agriculture are mainly responsible for the change. This extension of the life span means more years to enjoy life, more free time to devote to a good cause, and more occasions to do things with the grandchildren. In many countries, people who are old seem to have nothing to do: they just wait to die. In America the old are incredibly vigorous, and people in their seventies pursue the pleasures of life, including remarriage and sexual gratification, with a zeal that I find unnerving. -- In America the destiny of the young is not given to them, but created by them. Not long ago, I asked myself, "What would my life have been like if I had never come to the United States?" If I had remained in India, I would probably have lived my whole life within a five-mile radius of where I was born. I would undoubtedly have married a woman of my identical religious and socioeconomic background. I would almost certainly have become a medical doctor, or an engineer, or a computer programmer. I would have socialized entirely within my ethic community. I would have a whole set of opinions that could be predicted in advance; indeed, they would not be very different from what my father believed, or his father before him. In sum, my destiny would to a large degree have been given to me. In America, I have seen my life take a radically different course. In college I became interested in literature and politics, and I resolved to make a career as a writer. I married a woman whose ancestry is English, French, Scotch-Irish, German and American Indian. In my twenties I found myself working as a policy analyst in the White House, even though I was not an American citizen. No other country, I am sure, would have permitted a foreigner to work in its inner citadel of government. In most countries in the world, your fate and your identity are handed to you; in America, you determine them for yourself. America is a country where you get to write the script of your own life. Your life is like a blank sheet of paper, and you are the artist. This notion of being the architect of your own destiny is the incredibly powerful idea that is behind the worldwide appeal of America. Young people especially find irresistible the prospect of authoring the narrative of their own lives. -- America has gone further than any other society in establishing equality of rights. There is nothing distinctively American about slavery or bigotry. Slavery has existed in virtually every culture, and xenophobia, prejudice and discrimination are worldwide phenomena. Western civilization is the only civilization to mount a principled campaign against slavery; no country expended more treasure and blood to get rid of slavery than the United States. While racism remains a problem, this country has made strenuous efforts to eradicate discrimination, even to the extent of enacting policies that give legal preference in university admissions, jobs, and government contracts to members of minority groups. Such policies remain controversial, but the point is that it is extremely unlikely that a racist society would have permitted such policies in the first place. And surely African Americans like Jesse Jackson are vastly better off living in America than they would be if they were to live in, say, Ethiopia or Somalia. -- America has found a solution to the problem of religious and ethnic conflict that continues to divide and terrorize much of the world. Visitors to places like New York are amazed to see the way in which Serbs and Croatians, Sikhs and Hindus, Irish Catholics and Irish Protestants, Jews and Palestinians, all seem to work and live together in harmony. How is this possible when these same groups are spearing each other and burning each other's homes in so many places in the world? The American answer is twofold. First, separate the spheres of religion and government so that no religion is given official preference but all are free to practice their faith as they wish. Second, do not extend rights to racial or ethnic groups but only to individuals; in this way, all are equal in the eyes of the law, opportunity is open to anyone who can take advantage of it, and everybody who embraces the American way of life can "become American." Of course there are exceptions to these core principles, even in America. Racial preferences are one such exception, which explains why they are controversial. But in general, America is the only country in the world that extends full membership to outsiders. The typical American could come to India, live for 40 years, and take Indian citizenship. But he could not "become Indian." He wouldn't see himself that way, nor would most Indians see him that way. In America, by contrast, hundreds of millions have come from far-flung shores and over time they, or at least their children, have in a profound and full sense "become American." -- America has the kindest, gentlest foreign policy of any great power in world history. Critics of the United States are likely to react to this truth with sputtering outrage. They will point to long-standing American support for a Latin or Middle Eastern despot, or the unjust internment of the Japanese during World War II, or America's reluctance to impose sanctions on South Africa's apartheid regime. However one feels about these particular cases, let us concede to the critics the point that America is not always in the right. What the critics leave out is the other side of the ledger. Twice in the 20th century, the United States saved the world -- first from the Nazi threat, then from Soviet totalitarianism. What would have been the world's fate if America had not existed? After destroying Germany and Japan in World War II, the United States proceeded to rebuild both countries, and today they are American allies. Now we are doing the same thing in Afghanistan and Iraq. Consider, too, how magnanimous the United States has been to the former Soviet Union after its victory in the Cold War. For the most part America is an abstaining superpower; it shows no real interest in conquering and subjugating the rest of the world. (Imagine how the Soviets would have acted if they had won the Cold War.) On occasion the United States intervenes to overthrow a tyrannical regime or to halt massive human rights abuses in another country, but it never stays to rule that country. In Grenada, Haiti and Bosnia, the United States got in and then it got out. Moreover, when America does get into a war, as in Iraq, its troops are supremely careful to avoid targeting civilians and to minimize collateral damage. Even as America bombed the Taliban infrastructure and hideouts, U.S. planes dropped food to avert hardship and starvation of Afghan civilians. What other country does these things? -- America, the freest nation on Earth, is also the most virtuous nation on Earth. This point seems counterintuitive, given the amount of conspicuous vulgarity, vice and immorality in America. Some Islamic fundamentalists argue that their regimes are morally superior to the United States because they seek to foster virtue among the citizens. Virtue, these fundamentalists argue, is a higher principle than liberty. Indeed it is. And let us admit that in a free society, freedom will frequently be used badly. Freedom, by definition, includes the freedom to do good or evil, to act nobly or basely. But if freedom brings out the worst in people, it also brings out the best. The millions of Americans who live decent, praiseworthy lives desire our highest admiration because they have opted for the good when the good is not the only available option. Even amid the temptations of a rich and free society, they have remained on the straight path. Their virtue has special luster because it is freely chosen. By contrast, the societies that many Islamic fundamentalists seek would eliminate the possibility of virtue. If the supply of virtue is insufficient in a free society like America, it is almost nonexistent in an unfree society like Iran's. The reason is that coerced virtues are not virtues at all. Consider the woman who is required to wear a veil. There is no modesty in this, because she is being compelled. Compulsion cannot produce virtue, it can only produce the outward semblance of virtue. Thus a free society like America's is not merely more prosperous, more varied, more peaceful, and more tolerant -- it is also morally superior to the theocratic and authoritarian regimes that America's enemies advocate. "To make us love our country," Edmund Burke once said, "our country ought to be lovely." Burke's point is that we should love our country not just because it is ours, but also because it is good. America is far from perfect, and there is lots of room for improvement. In spite of its flaws, however, American life as it is lived today is the best life that our world has to offer. Ultimately America is worthy of our love and sacrifice because, more than any other society, it makes possible the good life, and the life that is good. Medical Malpractice - Negligence - Prescribing wrong medication? I'm doing a paper for my medical law and ethics class, and I'm writing a paper about a medical assistant prescribing medication to a patient without a doctor's knowledge, that in turn caused the patient to go into anaphylactic shock and die. Could criminal charges be brought against the medical assistant (for manslaughter or murder), or would this only be a civil case (wrongful death), or both?? Thanks!
What about Citibank ethics? To whom it may concern: I have a right to know who lied to the dfeh I, Damari Stratford filed a complaint with the DFEH, Ann Luekeman did the investigation. After the case was closed I requested a complete copy of all materials submitted to the DFEH at Ca. Dept. of Fair Employment and Housing, 111 N. Market Street, Suite 810, San Jose, Ca 95112. When I received the copies, the names of the employees and the attorney at Citibank were crossed out in black ink. I feel I have a right to know who said what and why they lied about me. I feel I have a right to know the name of the attorney submitting these false statements about me. Please forward me a copy with out the names being crossed off, at no charge to me since I have already paid for a complete copy. I have reported these people to the New York Bar Association and I can’t go forward without the name of this lawyer which submitted false statements. I am not pursuing a complaint against the DFEH, as the Attorney General’s Office has asked me, I simply want the attorney General to ask Ann Luekeman for the name of this attorney so I may file a complaint for unethical and unprofessional conduct by Citibank lawyer and employees, again the DFEH made their decision with false statements from Citibank employee Kathleen Munoz and Jeff Ursino, which were the two people interviewed by Ann Luekeman.. I was fired while I was out sick, the managers states in a note added to my personnel file that he had called me to see if I would be coming into work on Dec. 13th but yet with my letter of termination he returned to me the faxed in doctors note, faxed in at 3:44p.m. on 12/12/05 by my doctor, which clearly stated that I would be out from 12/12-12/16/05. He sent me my letter of termination thru UPS, which arrive on 12/15/05. The manager knew that I was out on work related stress and I had a workers comp case pending. The manager states that I was fired for not complying with my warning and I asked how I could comply if I wasn’t there to comply so then I get a letter from HR stating that I was fired for failure to follow the call in process but my doctor had called in for me on the 12th due to my stress level and blood pressure. The doctor had spoken to the supervisor on the 12th so they were aware that I wouldn’t be in on the 13th and my doctor has the notes on my file that she had made a call in for me. Citibank did not follow their own procedures when they fired me. The EEOC has given me the right to sue and the letter arrived on 2/17/06 so my 90 days have started. The DFEH has also launched their own investigation which Citibank received notice on 1/23/06 and should be responding to the notice any day now, (as of 3/8/06they haven’t responded). I had an outstanding performance history with the bank; I had worked there for 4 years 2 months 6 days. I was the head teller one of the notary and the only Spanish-speaking teller. I have at least 40 letters of support from Citibank clients and I can prove that the manager was not equal with all the employees and although he was aware of the teller cooking the books under the direction of the supervisor none of them were put on corrective action yet I was written up for missing my first Saturday and then again when I missed my 2nd Saturday although I had a doctors note to be out of work due to my blood pressure and stress brought on by the manage and the unfairness in treatment. I had been threaten with job abandonment but at that time I hadn’t missed any work long enough to be accused for this. Citibank violated code 132A of the worker comp law and I do have an attorney for that but they are unable to deal with all the other issues. I have a strong feeling that the manager never told HR that my doctor had called in for me nor did he share my doctors note with them, he is to get approval from HR before firing me yet fired me by 4:30 pm or so, I had also emailed him that day at 1:45 pm and explained that my doctor had spoken to the supervisor and faxed in a note, again he was aware that I wouldn’t be in. The manager had called my cell phone and left a message at about 10:25 am, he states that he called because I hadn’t called in a half an hour prior to my shift, which started at 8:30 a.m., why did it take him 2 hrs before calling me? And I would bet that the supervisor had made arrangements to have a teller there to cover my shift since my doctor called her. Please help my family and I. I have sent you a copy of my time card for that week and other information regarding their statement to the DFEH. Why does Citibank tell the DFEH that I was fired and Ronan of the US Dept. of Labor that I am still employed. They also told Ronan that they would send me a letter explaining how I am still employed, but I never received this letter, why? The manager of the branch then accused me of job abandonment which led to my termination via UPS delivery on December 15, 2005, while I was at home on medical leave. Subsequent to my termination, I received numerous correspondences that referenced me as terminated, no longer with the company, and as a former employee. My 401K and pension have both been forwarded to me. However, when interviewed by the Department of Fair Employment and Housing, Citibank representatives reported that I was terminated due to not personally reporting my absence, but rather having medical documentation reported by my physician. When interviewed by the U. S. Department Wage and Hours Division, Citibank representatives reported on August 8, 2006, that I was still an employee of the company and that a letter indicating such would be forwarded to me. To date, this letter has not been received. I have continued to be in contact with several clients that have stated that Citibank representatives indicated that I was either on vacation, or that I voluntarily resigned in order to work with my husband in his new business. This is absolutely untrue. It was my intention to continue my employment as the benefits were extremely important to me, as well as to my family. Clearly, there has been a gross misrepresentation by Citibank, either to its clients or to the U. S. Department Wage and Hours Division. It is my position that I was unfairly terminated by Citibank. The unscrupulous behavior of Citibank and its representatives, locally and at the corporate level, is unacceptable. It is also my opinion that if a corporation as large as Citibank is representing itself on a local level, the local management and staff should act accordingly. A large part of the attraction of the Monterey area is the sense of community that is felt here on a day to day basis. If Citibank is allowed to misrepresent its actions to clients and government agencies, where will the corporate takeover end? Why do the employees at branch 915 in Carmel, Ca., tell their clients that I left the bank to go work for my husband, instead of telling them the truth which is that I was fired on 12/13/05 via UPS & their HR- Connect One system has me as an active employee out on disability and now I am an active employee on leave of absence with pay. So, am I fired or on leave of absence??? If I am on leave of absence then why don’t they say that instead of lying to the clients and telling them that I left to work for my husband. On 5/31/06 Sharon Law Tucker sent me her new business card and asked me to call her because she had miss placed my phone number during the phone call she mentioned that it was Laura Richardson which told her a few months ago that I left to work for my husband, is there anyone at the Carmel branch that can tell the truth??? The letter I’ve include with this email is from a concern client of Citibank My question is will the teller be fired and if not why not? This teller left out about $10,000.00 in the unlocked front drawer 2 different times with in a two week period and had two shortages in one year, one for $100.00 and the other for $450.00. Where the cash drawer is concern two employees signed the vault book stating they witness her put the cash away, obviously not true. One of these two employees had the bank pay for her daughters overdrafts and the manage was aware, against company policy. This teller entered false referrals into the systems to make the banks numbers look better and this was done under the supervision and direction of the supervisor, when I brought this up to the manager none of the three tellers which input false referrals were written up, falsifying bank documents and no write up but I get written up for missing a Saturday, why? Unfair and unequal treatment by the manager. Where are the ethics? As I’ve stated, the unethical employees still have jobs and I get fired after the manager receives my email on 12/13/05 at about 1:45 p.m., and he acknowledges receiving it, it clearing answers his question/comment that he was calling to see if I was coming. The email states that my doctor had called in and spoke to Kathleen: as well as faxing in my doctors note which the manager returned to me with my termination letter received two days after I had been fried with no check, with no break down explanation, no vacation pay, misleading information and so on, note clearly stating my disability time off. Did he read the doctors note? Did he let upper management know that my doctor had call and faxed information? The manager called I returned his call but he was with a client. I requested to communicate via email and I emailed him, Kathleen and Human Resource, so why was I fired sometime after he received my email and the end of the day if he was just calling to see if I was coming in and if not to contact HR? March 25, 2006 Dear Ms. Deloney, I would like to take a moment and thank you for responding to my comments regarding Damari and the manager. I am sure that you are a very busy and important person and I appreciate your time. Damari is truly missed at the bank, since her unfair termination by the manger, the atmosphere at the bank is boring to say the least. Damari added life and laughter and she enjoyed serving the customers. I feel deeply, that the manager made a huge mistake in dismissing her while she was ill. What kind of a manager would dismiss an employee while they are ill? As I say this, I now have further concerns about another teller name Andrea. I was in the bank and was told that she has injured her knee and will be out of work for about six weeks. I’m sure that Andrea has a doctors note as Damari did, I hope that the manager doesn’t make the same mistake and decides to terminate her and mail her a letter before she returns as he did Damari when he terminated her instead of waiting for her to get well and return to work. Although I would understand if he were let her go as she spends most of her time at work doing her homework , reading and she isn’t available everyday. Andrea will move on, on her own to become a teacher, this is what she goes to school for two days a week. By her going to school, I feel this puts a strain on the staff. I understand that the rest of the tellers along with Kathleen are now having to work six days a week and Kathleen is running a window: she doesn’t have the charm or customer service skills which Damari offered the bank. We go into the bank often and we rarely see that manager. I feel that it would be in the best interest of the bank to find a permanent manager as soon as possible, one whom appreciates competent employees as Damari. Frankly, I don’t understand how a temporary manager was given the authority to dismiss an employee such as Damari with her wonderful skills , talents and dedication to her job. Therefore my concerns are now for Andrea whom doesn‘t compare with the kind of service Damari offered your customers. As I stated before, the other tellers spend too much time speaking to customers about personal things and shopping on the computer instead of banking conversations. I frequently witness them reading and eating while at their windows: this is very unprofessional. I feel it would be in the best interest to Citibank to launch a complete investigation on the manager, as you stated would be done and seriously consider removing him from Carmel. In my opinion since he arrived the atmosphere is tense and if I can sense it I am sure that other customers do. This manager has taken all the personal touch and charm out of the bank and I feel the employees fear for their jobs: no one should have to work under those conditions. Citibank claims that I didn't follow the call-in procedure yet my doctor called on 12/12 & faxed in a notice which stated that I would be out from the 12th-16th. CITIBANK IS NOT BEING HONEST WITH DFEH THIS IS A LETTER I SENT MY GOVERNOR Dear Governor, First Lady and Staff, I have been awake since 1:05 a.m. I was having a difficult time sleeping again due to my conversation with Ann Lueckeman from the DFEH. Ann and I spoke on 3/08/06, Citibank apparently faxed in their reply on 3/07/06. Ann read to me some of the statements that Citibank made on their reply Citibank states: that I called in on 11/15/05 and that I stated that I would be out the rest of the week, this is a lie!!! I happen to have my time card for the week ending 11/19/05 and it clearly shows that I worked the 15th, I was off the 16th and I worked the 17th and that I was out sick on the 18th and 19th and that the manager approved my time. Citibank states that I refused to work on Saturdays but they don't mention that I, unlike them, was willing to meet them half way. Citibank is not telling the truth. To further support that I was at work on the 15th and 17th I have my journal notes with specific times of things that occurred on those two days. How does an honest and ethical person fight against unethical people who lie? How can I protect myself if I can't afford an attorney and I can't find one to work on a contingency basis? The other night, on TV, my husband and I heard that the government spends 4 million to train wasp and I can't get help from The White House or our Senators or Congress, to defend myself against a corporation which is taking advantage and lying about this situation? The only one that has offered to help is the Governors office and although I appreciate the letter and the call from the Governors office this does not get me an attorney. I was fired while I was out sick, the managers states in a note added to my personnel file that he had called me to see if I would be coming into work on Dec. 13th but yet with my letter of termination he returned to me the faxed in doctors note, faxed in at 3:44p.m. on 12/12/05 by my doctor, which clearly stated that I would be out from 12/12-12/16/05. He sent me my letter of termination thru UPS, which arrive on 12/15/05. The manager knew that I was out on work related stress and I had a workers comp case pending. The manager states that I was fired for not complying with my warning and I asked how I could comply if I wasn't there to comply so then I get a letter from HR stating that I was fired for failure to follow the call in process but my doctor had called in for me on the 12th due to my stress level and blood pressure. The doctor had spoken to the supervisor on the 12th so they were aware that I wouldn't be in on the 13th and my doctor has the notes on my file that she had made a call in for me. Citibank did not follow their own procedures when they fired me. The EEOC has given me the right to sue and the letter arrived on 2/17/06 so my 90 days have started. The DFEH has also launched their own investigation which Citibank received notice on 1/23/06 and should be responding to the notice any day now, (as of 3/8/06they haven’t responded). I had an outstanding performance history with the bank; I had worked there for 4 years 2 months 6 days. I was the head teller one of the notary and the only Spanish-speaking teller. I have at least 40 letters of support from Citibank clients and I can prove that the manager was not equal with all the employees and although he was aware of the teller cooking the books under the direction of the supervisor none of them were put on corrective action yet I was written up for missing my first Saturday and then again when I missed my 2nd Saturday although I had a doctors note to be out of work due to my blood pressure and stress brought on by the manage and the unfairness in treatment. I had been threaten with job abandonment but at that time I hadn't missed any work long enough to be accused for this. Citibank violated code 132A of the worker comp law and I do have an attorney for that but they are unable to deal with all the other issues. I have a strong feeling that the manager never told HR that my doctor had called in for me nor did he share my doctors note with them, he is to get approval from HR before firing me yet fired me by 4:30 pm or so, I had also emailed him that day at 1:45 pm and explained that my doctor had spoken to the supervisor and faxed in a note, again he was aware that I wouldn’t be in. As I explained on the phone, I have lost 25 pounds since Jeff Ursino first threaten me with job abandonment, I don't sleep well, I grind my teeth , I have gone to the emergency room for chest pains and a heart doctor and so much more. I have nightmares. From my house I see Highway 1, a constant reminded of the unjust done to me. I have seen about 10 different doctors and I have been given about ten different medications, I have been seeing a therapist every Friday since Nov. 2005 and I have only missed 2 appointments with him. My job was very important to my family and I, I have cashed in my IRA and 401k, my pension is on the way, I have sold some stocks at a lost to insure I have funds and all this because I was fired and I don't know how long I will be ill and I have bills. I have spent hours doing paper work for things such as unemployment, disability, activating credit protection dealing with connect one, Met Life. health insurance and more. I don't know how my benefits are being paid, I am not being directly billed and no one sends me the information I requested. I have lost my employee rate on my credit card and I still have to make payments to one of them. I did call him, he was with a client, I called his cell phone, he didn't answer, I emailed him, he received it and didn't respond but instead fired me, he lies, he returns my doctors note which stated the time I would be off, they lie to the DFEH, why wasn't the research done thoroughly in the first place, why were both of my write ups sloppy with incorrect dates and information? I wasn't fired for my performance, Jeff just wanted to hurt me more and this was his way. I was told that the center didn't have enough employees for some one to have Saturdays off but even though the center is short staff he fires me and allows Andrea to be out every Tuesday and Thursday but yet we were short staffed. I can't believe that all of this has happened to me for being ill and yet other employees did things that were more of a risk to the center than being out ill. I am sorry for raising my voice at you, I hope you understand it isn't directed at you, it is about the situation which Jeff created. I can't deal with more paper work and I don't trust anything Jeff or Kathleen say, they are unethical and will say anything to make themselves look good. At this point I will not be reading the attached Arbitration policy which you attached to this email, I can't deal with more paper work, I will research other avenues and continue to tell my story since I can't sleep. I don't understand what we have to say to each other. I feel that you and Citigroup will stand behind Jeff Ursino no matter what really happened. Jeff states that he called to see if I was coming in 2 hours after my shift was to begin and if not to call HR. I did call him and emailed him but he ignored that and fired me. He returned my note which stated that I would be out and yet called to see if I was coming in, did he not read the note he returned with my letter of termination and did not Kathleen let him know that my doctor called in at least I did something about it and my doctor and I were just protecting my health. Why did they lie? You said that they got bad information and now will submit a new response to the DFEH why not check your facts first before submitting information to the DFEH? why, because Jeff Ursino couldn't tell the truth. I gave him my address and asked him to put this in writing and mail it to me, he said he would get the letter out to me on Saturday Dear Governor Arnold Schwarzenegger, 01/28/06 My name is Damari Carollo Stratford, my daughter, Leah Carollo, attends Seaside High School and I wanted to personally thank you for visiting the school on Friday, January 27, 2006. My husband, Jeff Stratford and I have a small plumbing business named JND Plumbing, Inc., we, as a company, we donated money to the volley ball team to purchase 36 warm up uniforms for the girls. My daughter was on the freshman team and I was team mom and proud of it. I never missed a game and I drove to all the away games with team players in my mini van. I made sure they had sandwiches, fruit and water for all the away games and water for all the home games and practices. On, December 13th, Citibank in Carmel, California wrongfully terminated me. On, Dec. 15th, 2005 I received a letter via UPS telling me that I had been terminated on the 13th. At the time I was terminated I was in the middle of a pending workers comp case which wasn’t denied until Dec. 21st, 2005, this is in violation of code 132A of the workers comp law. Also, I had been out of work since the 6th of December with a doctor’s note, 2 notes that excused me from work from the 6th thru the 16th. I was out due do work related stress and anxiety. My doctor called in for me, upon my request, spoke to Kathleen and faxed in my doctors note on 12/12/05. According to HR, Chrys Smith, I was terminated for ‘ failure to follow call in procedure’ on 12/13/05. My doctors note which had been faxed in on the 12th was returned to me with my letter of termination from Jeff Ursine, acting manager of the branch. The note clearly stated that I would be out from the 12th thru the 16th. I went and spoke to an attorney in Salinas, California and after about 45 minutes to an hour of listening to what I had to say, they took the case on a contingency basis. Also, I have filed a complaint with the EEOC and they have launched an investigation on my behalf. I was not allowed an exit interview, which is their policy, nor was I ever asked to turn in my keys, which is also their policy. I was a very good employee and my reviews can prove this, one of them even stated the I ‘ Greatly exceeded expectations’. I was the Head teller, a Notary and the only Spanish-speaking teller. Before some one is terminated they are, per their own policy, to consider the employees performance. I worked the for 4 years 2 months and 6 days. RE: letter dated 06/05/06 Case # 0505382006 Citibank advised you that Human Resources and Employment Legal Departments have handles this internal matter. How did they handle this matter? They lie to clients about why I am not there. They tell clients that I left to work for my husband, this is a lie. Lisa Austin from Citibank Benefits departments states that when I come back to work they will set up payments for arrears regarding my benefits yet how can I go back to work if they fired me? Citibank states in a letter to a former clients on 3/13/06 that they would like to thank her for the comments on “our former” employee. Citibank lied to the DFEH and they are telling lies to clients, what else will they lie about? Citibank never offered me FMLA, violated Labor codes and this is all I get? I would like details of what was said. If Citibank will lie to the DFEH and clients they will lie to you also. You say you can’t provide me assistance but Citibank gets away with lies, wrongful termination, etc. I was not fired at work I was fired while at home, ill with a doctors note. How can they get away with ruining my life and lying to clients about it. Their Human resources department has had me listed as terminated, then on short term disability and now on leave of absences, so which is it? Am I suppose to go back to work there when my doctor releases me from disability. If I am an active employee on leave of absences then why did they send me my pension, change me employee rate on my credit card and make me do something with my 401k? Sincerely Damari To whom it may concern, 10/03/2007 A CRY FOR HELP Please help the little person fight corporate America and their lies and false statements On, Feb. 16, 2006 someone representing Citigroup Inc at One Court Square, 14th Floor, Long Island City, NY 11120, submitted a rebuttal to Ann Luekeman, Consultant for the Department of Fair Employment and Housing at 111 N Market Street, Suite 810, San Jose Ca 95112, and the statement entered is false and full of lies . Ann Luekeman also conducted the interviews for the investigation and was also lied to by Jeff Ursino and Kathleen Munoz during their interviews. I feel that the case needs to be investigated due to the fact that the DFEH made their decision with false statements submitted by Citigroup attorney and their employees. Sheri Paulo, the Employee Relations director for Citigroup was aware of the false information submitted yet even though they/she said they would submit a new statement they did not and stood by the lies knowing they were lies. I was wrongfully termination, harassed, by Jeff Ursino, and I can’t understand how an attorney lies to the DFEH and then they aren’t held accountable. This is unethical behavior on all those whom lied and I have to pay for their lies. Citigroup violated several Ca labor codes in the process of firing me nor did Citibank follow their own firing procedures. I was not offered FMLA until months later. I am begging that someone out there will help a mother who was simply trying to work be a mom and a wife making a honest living yet the manager and supervisor both lied as well as the Citigroup lawyers. Their lawyers requested more time to answer the DFEH yet submitted false information and this is unethical, please help us. I have been on disability since I was fired on 12/13/05 via UPS, I did not know I had lost my job until 12/15/05 because I was out on a workers comp pending case when I was fired. Violation 132A.My last pay check was direct deposited into my checking account, it was not included with my letter of termination. I would like to know who submitted these false statements for Citicorp and or Citibank and Citigroup.
