Am I required to pay the New York State surcharge on medical bills?

I have had many medical bills over the last several years. I have an HMO, and my insurance has paid at the contracted rate, and I have paid my copay, which is $75 for emergency room visits, $100 for hospitalizations and surgery. Only two times out of the many times have I been charged the New York State surcharge: once on my actual $75.00 copay (even though I've been to the same hospital seven other times and never had this added on to my emergency room copay) currently on a bill that was paid at the contracted rate, and now the hospital is trying to charge me almost 10 grand plus the new york state surcharge of about 850 bucks. This does not seem right to me. Anyone know where I can find this information or do you know how this is supposed to work? Thanks!

  1. Yes, I do believe you are responsible for payment of the surcharge. If there have been instances where you weren't asked to pay it, I think you just got a break. Don't look a gift horse in the mouth!
