Im 16 pregnant my boyfriends 20 can he go to jail?
I'm 16 pregnant and my boyfriend in 20. My parents never have had any problem with us being together. I will be 17 when the baby is born and he will still be 20. I want to be able to tell the doctors he is the father because we want his name on the birth certificate. We are both afraid if the hospital at the time of the birth knows he is the father and is 4 years older than i am will have him arrested. Does anyone have advice or experience in a situation like this? p.s we live in North Carolina.

- i'm not sure, but i think it is "15 gets you 20", which means that if an 18 year old (or older) has sex with a 15 year old, then they get 20 years in jail. but don't depend on my information.
- You and he are fine.....it isn't an issue that he is 4 years older than you, that doesn't matter. All that matters is that the youngest (you) is over the age of consent for your location and you are. Look at the website I've linked and check your location. http://www.avert.org/aofconsent.htm
- He CAN go to jail if your parents press charges.
- The laws vary from state to state. Here in Florida as long as he's under 24, your over 16 and you consent, then it's technically (more) acceptable. Honestly I doubt, unless your parents press charges, there would be a problem. If you got married before the birth, then legally there is no way that he nor you can get in trouble. (unless someone proved that he had sex with you before you were married but that's all here-say plus you'd be married already).

- I was in the same situation as you are. And, NO he will not go to jail (Unless your mom and dad file charges- but, by the sounds of it - that won't happen) you can put his name on the birth certificate - they won't question it - or even look into it ... all they need is the signatures. So, don't worry about it - it will all be fine. i was 16 and pregnant - and bf was 19.

- depends on what state your in .. I was in that same boat at 16 and my dad tried pressing charges against him and i had to write out a statement saying that I agreed and all this and that to having intercourse with my boyfriend ... and I do not think that a hospital would file charges...
- He's not going to jail unless your parents press charges against him. Tell him he'd better sign those papers! :-) Besides, I think doctors like it when the father is present at the hospital.
- It depends on the age of consent and what is considered statutory rape in the state where conception occurred. In most states if the parents don't press charges there is no problem. - yes he will be arrested anyone even 2 years older than the other person can be arrested. Come on sixteen you are ruining your life, hello college, you should have enjoyed life while you were young, now you have the responsibility to take care of your kid and you could even get STDs! Didn't you learn anything in health class!
