Can you be charged with a dwi in north carolina if you weren't even driving.?

i was riding my motorcycle with a girlfriend when she panicked and crashed. She doesn't have a motorcycle license. It was assumed that Iwas the driver. I had been drinking but I was definitely not the operator. I was hurt and hospitalized. I woke up in the hospital with a dui ticket and I was on the back seat. Any suggestions? Should I turn her in? I'm scared she'll go to jail for leaving the scene and no license. Then again, I'm scared I'll go to jail as well.

1. If you tell them you weren't driving, the charges would likely be dropped... If she was not drunk while driving, her charges for driving without a proper license would likely be far less severe, and definitely not involve jail time.
2. Tell the truth to the police and deal with what happens.
3. don't do anything hasty,if its your first time they just have you pay a fine and probably some dui classes..and it also depends how much you like this girl(ha ha)
