Medical Malpractice

How long do you get to file a medical malpractice suit?

I believe we have a reason to file a medical malpractice suit for something that occured a long time ago. I understand that some cases can be valid if the patient realizes later that some form of malpractice has occured, but is there a such thing as too long? This isn't an out-to-get you-kind-of-thing, more of wanting fairness.

  1. In most states it's 2 years from the original incident or 2 years from the time harm was determined. You'll have to check with you state. Call a lawyer, they will tell you for free.
  2. It depends on the state and it may depend on the circumstances and on the victim. You need to see a malpractice attorney in your area.
