Private Health Information Lawsuit?

I have filed a lawsuit againts the Hosipital, the employee, and my estranged spouse. My estranged spouse ask her friend that works at a local hospital to get her a copy of my medical records, which in turn my estranged wife is trying to use against me in the divorce and false criminal charge. Biddle V. Warren County General was upheld by the Ohio Supreme Court that patients do have the right to sue when information was released without authorization. There are several subsequent cases. However, it seems that most hosipitals settle before the case gets filed. The hosiptial did in writing confirm the HIPAA violation and terminated the employee and that emplyee confirmed that she did to at my estranged wifes request. Has anyone ever recieved a settlement here? If so how much? Thanks

  1. I don't think you're going to find many other people who have been in this situation. Even then, that information might not be helpful to you. No two cases are the same and there are a lot of variables. The fact that the hospital isn't disputing what happened doesn't mean that you automatically have a case. Your attorney has a better feel for your case than anybody here, so I suggest you take their advice regarding the settlement.
