Is it true that the VA Hospitals are immune to Wrongful death cases?
My dad died in one, and the cause of death on the death certificate is mixed drug overdose... I had asked a question about how to hire a lawyer.. but someone said that they are immune to wrongful death cases? Is this true? Can they really kill someone by overdoseing them and get away with it? He was only 52 and he was in the hospital for a problem with his foot. It was so unexpected. He was walking around and talking an hour before. He was not old and there was nothing even near life threatening wrong with him. He was no longer in the military.. he was discharged in the 70's.

- I would hope not!!! But they may have their behinds covered by a release that was signed or some other paperwork that is usually shoved in your face when you are so upset you can't concentrate. I would call a lawyer and ask. Good Luck and God Bless!!
- i work with a lady who's father died in VA in SLC utah, he was old and sick and they say that a lot of people die at VA hospitals and say to take them to a civilian hospital first, i think they sued, something about Over dosing too i think
- Okay. 1. The VA is not affiliated with the department of defense. An active duty service member is in no way related to the VA and they do not serve or treat active duty. 2. In general, the VA is praised for the quality of care CURRENTLY given. The 70 was was a different time. 4. Unless GROSS NEGLIGENCE can be pr oven, the Federal Government in general is IMMUNE to wrongful death or malpractice civil prosecutions.
- IF U HAVE ENOUGH MONEY..NO ONE IS IMMUNE.HOW CAN U ACCIDENTALLY KILL SOMEONE AND NOT BE CHARGED.
- Military hospitals, VA Hospitals, military doctors, etc., are ALL exempt from malpractice. They are covered under what is known as the "Feres Doctrine". Numerous wrongful death suits have been filed against the military only to have them tossed out due to this stupid rule. Military doctors are the ones the bill covers the most. There is a petition going around demanding Congress and the Supreme Court overturn this abomination. I signed it.
- You had some YOUNG jerk answer this..... He is so off. But, in part he's right. Our Gov't doesn't allow a VA Dr. to be sued.........BUT contact your State Rep's. or Sen. and ask Q's. It's not always true. Some or most of the Dr's responsible for our Vets are not DoD or VA qualified to treat these Vets. My Husband and "I" have been going through this for three years.
