Leaving the scene of an accident in North Carolina?

My brother was driving down a dark road one night and a deer jump in front of his car. He slammed on the breaks, missed the deer but ran into a telephone poll. Someone gave him a ride to his sisters house because his head hurt and he doesn't have insurance so didn't want to go to a hospital. He developed a major migraine, and decided to call a tow truck the next day. By the next day, his car was gone! He left the scene of an accident but he was sick! Does anyone know what the penalties are for this in NC?

  1. To leave the scene of any accident is against the law.. Many do it and get away with it. But they don't leave the car at the scene. Your brother is lucky to be alive. He should have had the car towed that night. Now your brother is in trouble. Unless he claims he was not the one driving the car. After all no one except your brother witnessed the accident. The law don't care if he was "sick" the law is the law in any state. Never leave the scene of an accident. Unless it's a minor accident and two people exchange insurance information. If the law had the car impounded, the can run a check and see who owns the car, and if it had insurance on it at the time.
  2. I don't know what the penalties are, it all depends on the judge. He needs to go into court if there is a warrant out for him and explain that he was not feeling well and sought medical attention. As long as he was not drinking he should be okay. He better buy insurance before he goes into court though. I am sure it will be SR-22 now. Maybe it was never reported to the cops, then just get the insurance and learn from the past mistake.
  3. Have they charged him yet ? if not, tell him to call the Police and report it. Even if he is the only one injured he can still be charged with leaving the scene with injuries. He needs to report it !
  4. maybe if he reported the car stolen that night he could of gotten away with it but i think he will be getting in trouble not to many people get away with it if they leave the accident AND the car sorry
  5. It is unlikely that he will face much in the way of penalties. He will have a towing fee for the car and his auto insurance will be billed for any damage to the pole. He is better off reporting the accident himself than waiting to be tracked down.
  6. he needs to call the appropriate agency and explain what happened it might reduce his penatly
