Medical Malpractice

medical malpractice???

I was sent home from the hospital yet again this morning at six am. The baby has dropped so far down now that every time I walk it feels like he is ripping my insides, My contractions are still two to three minutes apart lasting for 35 - 45 seconds, & my back feels so sore like someone took a two by four and hit me with it. The contractions are the worst part bc they are really, really painful. They don't want me to go back to the hospital until my water breaks! I was due on the 29th. Isn't this bad medical practice? Can't they do anything?! I asked them about the doc breaking my water but he doesn't want to do it like other doctors, he wants to give me some weird thing called cytotec & insists that I take it instead bc he doesn't want to break my water due to he doesn't want to have to watch over me (he said he's busy even though there are seven maternity rooms at the ward and only two of them are in use and only one of them is his patient.) WHAT CAN I DO?!?! I can't even lay down! :( Meggan B - I have dialated to 5cm and contractions ARE continuous. I am NOT 36 wks I am going on 41 and a 1/2!!!!!!!!!!!!!!!!!!!!!!!! I said no to the Cytotec stuff bc I researched it and it's usually used for abortions and the nurse told me last night there is a strong risk it can lower the baby's heartrate immensely.

  1. This may sound completely irrational but I would sit in the waiting room at the hospital and wait. Scream in pain and just let them know how completely miserable you are. Can you change your doctor now? Are there other doctors in that practice that can induce you?
  2. if you are not dilated or showing any cervical change, you are not in true labor. Cytotec will actually soften your cervix to make it dilate. Cytotec is used very commonly on Labor and Deliver along with Cervidil to ripen the cervix
  3. Go to the hospital & refuse to leave until your baby comes out! that's what i would do!!
  4. If you are in labor, then they need to take care of you. They cannot force you to take anything if you don't want to. I would get hold of an attorney as soon as possible to see if they are being negligent. Good luck and God Bless.
  5. OMG, I can't believe your DR, you ARE in labor, Jeez, sometime it appears that those morons didn't even have a clue about what they are doing. Cytotec works, just try it. I never met a Dr so stupid, if you are in labor they are supposed to breake your water so the labor process speeds up. If I were you I'd show up tonight and BY NO MEANS I'd live the hospital, I'd demmand to get in. Good luck giving birth and Congratulations. Edited: I just read Megan's post, if you are 36 wks pg maybe they are trying to keep that baby in as long as possible. If you get too miserable just go back in there and don't leave.
  6. lots of hospitals will send you home in the early stages of labor. its not unusual. im sure its very irritating and annoying, but its done all the time. early stages of labor can last days. they probably have found that your contractions are not consistant enough to keep you, and further induce labor.
  7. i would say be careful----with my 1st my contractions never became regular and I was 4 centimeters for at lest 8 hrs was sent home 3 times again contractions never became regular and 1 hour after they sent me home the 3rd time my water broke and and I delivered my daughter in the car by myself.
  8. first off, there is absolutely, uncategorically, no grounds for malpractice here. so you need to be a smart girl and think of a way to get induced. Any woman can request an induction at 39 wks for any reason whatsoever and that is acceptable, but the doctor needs to also go along with it-sounds like yours does not want to. Is there another doc in the group that you can beg to induce you? IDK why you dont want the cytotec, that stuff usually works like a charm but I would not take it at home with that many contractions-only in the hospital under supervision. You could try a different hospital or tell them the baby is not moving well, that usually gets their attention
  9. I'd ask them where they want you to wait until your water breaks.
  10. I would definitely NOT leave that hospital. With my 2nd, my water broke and he was born 5 minutes later. No way I could have gotten to the hospital from home and I would have had to deliver him myself!!!
  11. well you need to focus on your baby first. if he will not break your water, i would get someone else to. and wouldent stop until another doctor did it. if that is what you want to do, then the doc should respect that unless it would harm your baby. when the baby is ready to come out, its ganna come out regardless if that doc has time or not. as far as the lawsuit call the state bar where you are located and ask them what lawfirm practices medical malpractice. some law firms like the one i work in handle everything, try to get one that focuses on med mal. you should be keeping up with every medical record you can get your hands on, write down everything that happens every time you go to the doc. o yeah, you wont get any money unless something happens to you or the baby. so just wait about calling them and see how everything goes with the baby
  12. i agree with the first who responded.. sit in the waiting room and let them know u r gonna have your son with or without them. then after your baby boy is born, lodge complaints with the hospital and the doctor. you are overdue and not everyones water breaks. if you have been firm with them be diligent even more. my water never broke neither did my sister in laws she was 5 cm never broke ihad my water broke w my first son. do not take the medicine if u dont feel compfortable. have someone drive you and make ascene with the staff what are they gonna do arrest a woman in labor? Good luck! with your son
  13. Go to the hospital, just like some of the others said and stay until you have that baby. Even if you just sit in the waiting area. I was 2.5 cm and not having contractions and they admitted me. Different hospital and different docs have different protocols but overall, if the patient is hurting and obviously in distress, ADMIT! If you are already at 5, as soon as your water breaks, you are going to go FAST. Don't stay home, have someone take you in again and this time don't leave.
  14. I would do the cytotec. It's used very often where I work and it often ripens the cervix, speeds up labor and who know?? this could even make your water break. If you use cytotec, then they would need you to be at the hospital anyway and you should be able to get pain medicine. At least, where i work, we always have patients admitted to labor and delivery for cytotec, it's not done at home. And we always offer pain medication if needed. I know not all drs/hospitals are the same so they may do things differently.
  15. Since you can barely breathe through the pain, and walking is not an option for you, I would recommend drinking a small bottle of castor oil. I did with both of my children, and even told my doctor that I was going to. He just laughed and said good luck. It has no harm on the baby, but staying in the belly too long does. You will basically spend the next few hours on the toilet, but at least you may speed up the labor process. Your water may break on its own while you sit there. No mess... Not to mention, you will do away with the need for an enema. Take some tylenol, even though it probably wont help much, and have your partner or a good friend massage you with eucalyptus oil. Then get in a bath, with lavender scent. It may not be a good idea to add the lavender to the water due to infection, maybe a candle or incense. This might help you to relax enough to where nature can take its course. You cannot progress if you are not in a semi relaxed state. If you can muster the strength to walk, do so... This could help you to at least tear the bag of water enough that you will start to leak fluid. At this point your doc has no choice than to deal with the situation.
  16. you always have a choice. this is your baby and your body. if you don't agree with this doctor, you always have the right to fire him and request the hospital provide you with someone else you feel is more efficient. if i were in your shoes with my wife, i would feel inclined to switch and would not put up with this. also, please, please don't consider taking cytotec.. it says right on the bottle that it is not to be used in pregnant women. it has been shown to be very dangerous depending on how a woman's body deals with it. i have heard horror stories about babies going into distress and dying from it. it is not like an iv solution they can turn off.. once they give the tablets.. it's russian roulette..
