Is it possible to fight a double parking ticket in NYC. I was still in the car listening to the radio?
Today I was in Washington Heights near NY Presbyterian hospital. Officer goes to my window and says that "you are getting a summons for double parking". Other officer writes up the ticket. Is it possible for to fight a double parking ticket since I was still in the car? Or am I just wasting my time? Fine for DP in NYC $115. Thanks in advance.

- You were technically "standing" as you were with the vehicle. Not certain as to how that would hold up in traffic court, but I suggest that you contest the ticket and perhaps your accuser will not show up on the court date. If the Officer does show, plead no contest and pay it.... kind of a risky gamble, but its worth a shot to save $115

- i have fought a bunch of those ,not in new york, but in other places,and have yet to win one time,id pay it and just go on,he could have asked you to move on,but since he wrote the ticket,you wont win this one,i had a glove box full,and wasn't going to pay them once,one morning i looked out,and they was towing my car away,so if i was you id pay it and go on,your getting off fairly cheap,it could be a lot worse,you can beat a speeding ticket easier than you can beat a parking ticket now days,good luck with it.
- Let's see, car was stopped, yep, you were parked! What the heck difference does it make that you were sitting in the car? Your car was sitting still in the driving lane! Duh! And don't try the defence that you were just waiting for a spot to open up. Unless there is a car in the process of exiting a parking spot, you are not waiting for that spot, and the court system tends to frown upon lying in court. To the person who suggests asking for a trial by jury: this is a parking ticket, give your head a shake.
- I have no idea, but it may help to call the court clerk's office where you have the summons and try finding out what your options are ahead of time, maybe a lesser payment or something?. I do that for speeding tickets anyways... I don't know what double parking is either, but in Oklahoma, you aren't parked unless you are out of your car and/or the car is off. In which case you should argue that you didn't realize you were parked illegally and since you were just pulled over in your car with it still on (even if the engine wasn't on) and that the officer should of just told you to move and you would of been fully cooperative and not let it happen again... If it happens again, you have to right to see the law in their book I believe, so have them show you, then just let them know you are going to hire the best lawyer you can find just to fight this ticket and win just because of principle of the thing, even if it is just $100, that really pisses them off and will get you out of quite a few tickets. They write you tickets because they think they can convict you of it, if you say "ok yes sir" and nod at everything, they think you will just pay, if you argue, sometimes they take the bluff and leave you alone...
- I would fight it...besides what do you have to lose (but time). Just be prepared to pay just in case. Usually they will offer you a 30 extension, then 7 week then 3month extension to pay, at your 1st court date. Of course this is not always the case, but has happened to me both times that I have been to court. I never had to pay b/c the officer never showed. The officer only has to show if after you go to your initial court date, and request a (future) trial and the officer has to come to the next court date (your trial). I would request a trial by jury, since most ppl on here agree that the officer was wrong. Good luck, hope this helps
